How is the New Jersey real estate salesperson exam structured?
The PSI-administered exam has 110 questions split into an 80-question national portion and a 30-question New Jersey state portion. You must score 70% on each section. New Jersey requires 75 hours of pre-license education before testing, and the state has no licensing reciprocity, so out-of-state licensees must complete all New Jersey requirements.
What is the New Jersey attorney review period?
After a standard New Jersey real estate contract prepared by a broker is signed, a 3-business-day attorney review period begins. During those three business days, an attorney for either the buyer or seller can disapprove the contract and cancel it. If no attorney disapproves within the period, the contract becomes legally binding.
How does New Jersey's Realty Transfer Fee work?
The Realty Transfer Fee is paid by the seller on a sliding scale that increases with the sale price, starting around $2 per $500 of consideration on lower-priced sales and rising to about $6.05 per $500 on amounts over $1 million. Non-resident sellers must also have estimated Gross Income Tax (GIT) withheld at closing.
Why is the NJ Law Against Discrimination important for the exam?
The New Jersey Law Against Discrimination (LAD) is broader than federal fair housing law, adding protected classes such as marital status, domestic partnership or civil union status, sexual orientation, gender identity, nationality, ancestry, and source of lawful income. Violations can lead to significant civil penalties, so the state portion tests LAD heavily.
Does New Jersey offer real estate license reciprocity?
No. New Jersey has no reciprocity with any other state. Licensees moving from another state must satisfy all New Jersey requirements, including the 75-hour pre-license course and passing both portions of the New Jersey exam, regardless of experience elsewhere.
What continuing education does New Jersey require to renew?
New Jersey salespersons must complete 12 hours of NJREC-approved continuing education each 2-year renewal cycle, including required core topics covering ethics, fair housing, and recent law changes. Failing to complete CE prevents license renewal until the requirement is met.
