Fixture vs. trade fixture vs. emblements
A fixture (e.g., built-in cabinets) is personal property that became real property once attached. A trade fixture is personal property a tenant installs for business use and may remove before the lease ends. Emblements (annual crops) stay personal property to the grower even though they're planted in the ground.

Frequently Asked Questions
How many questions are on the Arizona real estate salesperson exam in 2026?
Effective January 1, 2026, ADRE/Pearson VUE split the salesperson exam into two separately scheduled exams: the General/National exam (80 scored + 5 unscored pretest = 85 items, 150 minutes) and the Arizona State exam (60 scored + 5 unscored pretest = 65 items, 90 minutes). You must score 75% on EACH exam independently — there is no longer a single combined 180-question sitting. Both can be scheduled back-to-back for a combo discount.
What is the Arizona Contract Writing Course, and when do I take it?
After you pass both the General and State exams, but before ADRE will activate your salesperson license, you must complete a separate 6-hour Arizona Contract Writing Course. This is in addition to — not part of — the 90 hours of pre-license education you complete before sitting the exams.
What is Arizona's retake policy if I fail a section?
You must wait only 24 hours after a failed attempt before scheduling a retake of that specific exam (General or State) — Arizona does not use an escalating multi-week wait like some other licensing exams. If you fail the same exam a second time (or any time after), you're entitled to a one-time exam review showing which questions you missed, which must be scheduled within 14 days of that failure and completed before your next attempt.
What is the pass rate for the Arizona real estate exam?
ADRE and Pearson VUE do not publish an official aggregate first-time pass rate for the salesperson exam. Third-party real estate schools cite estimates roughly in the 55-75% range for first-time takers, but these figures vary by source and reporting period and should not be treated as an official statistic.
Do I need a Fingerprint Clearance Card before I can take the exam?
Yes. Arizona requires a Level 1 Non-IVP Fingerprint Clearance Card from the Department of Public Safety before ADRE will process your license application. Most candidates start this process before scheduling their exam, since background issues can delay licensure even after passing.
