The Epidermis (Outer Protective Division)
The epidermis is the outermost, avascular layer of the skin composed of stratified squamous epithelium. It consists of five distinct sub-layers (strata), listed from the outermost surface to the deepest:

The acid mantle, restated for skin services
Section 3.3 introduced the acid mantle at pH 4.5 to 5.5. In esthetic work it explains three practical rules:
- Alkaline cleansers strip it, leaving the skin tight and vulnerable; acid-balanced cleansers do not.
- Toners restore it after cleansing, which is why a toner follows a cleanse rather than preceding it.
- Any service that disrupts it — exfoliation, waxing, extraction — leaves the skin temporarily less protected, which is why sun protection advice follows those services and why active exfoliation and waxing are not stacked on the same area on the same day.
3. Skin Type versus Skin Condition

The most commonly confused pair is dry and dehydrated. Dry skin lacks oil — it is a type, driven by underactive sebaceous glands. Dehydrated skin lacks water — it is a condition, and an oily skin can be dehydrated at the same time. Treating dehydrated oily skin with heavy oils makes it worse; it needs water-binding humectants.
4. The Scope Boundary for Skin Services
19 NYCRR § 160.27 governs skin work as strictly as it governs everything else.
- § 160.27(a) — micropigmentation and tattooing are outside appearance enhancement licensure.
- § 160.27(b) — massage, including manual lymphatic drainage, is outside the licence; only light massage of the surface layers for beautification is permitted.
- § 160.27(c) — no diagnosis or treatment of disease, including diseases of the skin. Acne, rosacea, eczema, psoriasis and dermatitis are medical conditions. A cosmetologist may perform gentle cosmetic services around them where safe, and must never claim to treat them.
- § 160.27(e) — no dye of any kind on eyelash or eyebrow hair, except FDA-listed silver nitrate additives under 21 CFR § 73.2550.
- § 160.27(f) — services performed under the direct supervision of a physician or nurse, in their employ and on the premises of a medical facility, are treated separately.
Chemical peels beyond superficial cosmetic exfoliation, lasers, injectables, and any device or product intended to affect the structure or function of the skin fall outside cosmetology in New York. When in doubt, the question to ask is whether the service is beautification or treatment; only the first is licensed.
