The reference elevation

The rule is not "below grade" and not "in the basement." It is a specific surveyed elevation:

IPC 714.1: Where plumbing fixtures are installed on a floor with a finished floor elevation below the elevation of the manhole cover of the next upstream manhole in the public sewer, such fixtures shall be protected by a backwater valve installed in the building drain, or horizontal branch serving such fixtures.

The manhole cover elevation is the level at which a surcharged public sewer will relieve itself onto the street. Anything below that level can be flooded by the sewer; anything above it cannot, because the street relieves first.

The prohibition is as important as the requirement

The same sentence continues:

Building subdrains and pumped systems

Where fixtures sit so low that gravity discharge is impossible, a backwater valve is not the answer — a sump is. IPC 712.1:

Building subdrains that cannot be discharged to the sewer by gravity flow shall be discharged into a tightly covered and vented sump from which the liquid shall be lifted and discharged into the building gravity drainage system by automatic pumping equipment or other approved method. In other than existing structures, the sump shall not receive drainage from any piping within the building capable of being discharged by gravity to the building sewer.
