Thawing is the first prep step that puts frozen time/temperature control for safety (TCS) food back into the temperature danger zone. Frozen product is not sterile. It is paused. As ice turns to water, Listeria monocytogenes, Clostridium perfringens, Clostridium botulinum, Salmonella, and other organisms that survived freezing start growing again. FDA Food Code 3-501.13 therefore allows only four thawing methods. Everything else — the counter, the still sink, the warm bus tub — is an exam fail and an operational fail.
The Person in Charge (PIC) has to walk an inspector to the thawing station and name the method in use, the temperature limit, and the clock. "It is frozen, so it is safe" is not a method. Those four rows are the entire legal menu. If a cook invents a fifth method, stop the process.
Refrigeration at 41°F or Below
Refrigeration is the default because the food never leaves cold holding. Plan the calendar. A 10-pound turkey or a case of chicken breasts can take a day or more. Put the product on a sheet pan or in a hotel pan on the lowest shelf so juices cannot drip onto ready-to-eat food. Leave it wrapped or in the original package unless another rule — the reduced-oxygen packaged (ROP) fish rule below — requires the package to be opened. Check the food temperature, not just the cooler air. If the walk-in is struggling and the thawing chicken is at 45°F, that is not refrigeration thawing. That is danger-zone storage.
Running Potable Water at 70°F or Below
Water thawing is faster and easier to abuse. The Food Code conditions are stacked, not optional:
- The food is completely submerged.
- The water is potable.
- The water temperature is 70°F or below.
- The stream is strong enough to agitate and float off loose particles in an overflow.
- Ready-to-eat food that thaws this way must not rise above 41°F.
- Raw animal food that will be cooked must not have any portion above 41°F for more than 4 hours, and that clock includes the running-water time plus the time needed to prep it for cooking, or the time needed to get it back down to 41°F under refrigeration.
Standing water fails the velocity test. Warm water fails the 70°F test. A trickle that leaves the top of a roast in air fails the submersion test. A cook who starts the sink at 6 a.m. and walks away until lunch fails the 4-hour clock.
Use a clean and sanitized prep sink, not a hand sink and not a warewashing sink that still holds dirty dishes. Keep the product in its package when the package is intact and the ROP-fish rule does not apply, so the water does not become a marinade of surface bacteria. Do not let the overflow splash onto ready-to-eat food.
Cooking from Frozen
Some products are designed to cook from frozen: frozen hamburger patties, frozen vegetables for hot holding, commercially processed items with manufacturer cook-from-frozen directions. The cook step has to reach the legal internal temperature for that food. Chapter 12 owns those temperatures. This section only requires that there is no unsupervised thaw sitting on the side of the flat-top "until it softens."
Microwave, Then Immediate Cook
A microwave can thaw unevenly. Cold pockets stay frozen while edges enter the danger zone. That is why 3-501.13 ties microwave thawing to an immediate transfer into conventional cooking with no interruption. Thawing shrimp in the microwave at 9 a.m. for a 5 p.m. banquet is not microwave thawing. It is temperature abuse. If the microwave is used, the food goes onto the cook line next.
Methods That Are Never Acceptable
Never thaw TCS food at room temperature on the counter. The outer layers sit in the fastest-growth band (roughly 70°F–125°F) for hours while the center is still ice.
Never thaw TCS food in standing warm water. A bus tub of 90°F water is a growth tank. Still water in a prep sink is the same fail even if the water started cold: there is no overflow to wash off particles, and the water warms toward room temperature.
Never treat "it is still a little icy in the middle" as proof the outside stayed at 41°F. Measure the food.
Reduced-Oxygen Packaged Fish
Food Code 3-501.13 has a special rule for reduced-oxygen packaged fish that is labeled to be kept frozen until use. Remove the fish from the reduced-oxygen package before thawing under refrigeration. If you use running water, remove it before or immediately after that thaw. An unopened vacuum pouch of fish that warms in the walk-in is a Clostridium botulinum and Listeria monocytogenes problem: low oxygen plus thawing temperatures favor those organisms. Opening the package lets oxygen back in and is the required control. Do not "keep it cleaner" by leaving the vacuum seal on.
Slacking Is a Controlled Thaw, Not a Counter Thaw
Slacking is the Food Code term for moderating a very cold frozen food so it cooks more evenly — for example, raising block-frozen shrimp from about −10°F toward 25°F before frying. Slacking is still a thawing process. It belongs under refrigeration or another approved method. It is not permission to stage cases on a rack in the kitchen so they "take the frost off." If slacking lets the food climb into the danger zone without a cook step or a 4-hour running-water plan, it is illegal thawing with a fancier name.
Scenario: Chicken in a Prep Sink of Still Water
A line cook dumps frozen chicken breasts into a prep sink, fills the sink, and shuts the faucet off so the water will not overflow. Two hours later the PIC finds still, cloudy water and chicken that is soft on the outside. That is not an approved method. Still water does not meet the running-water velocity rule. The PIC stops the process, takes food temperatures, and reconstructs time. If any part of the chicken has been above 41°F long enough that the 4-hour cumulative clock — or unknown time — cannot be defended, discard. If the product is still at 41°F or the time is known and short, move it immediately to refrigeration at 41°F or below, or restart a true running-water thaw at 70°F or below with overflow, or cook it now as a cook-from-frozen or cook-immediately process. Train the cook: a filled, silent sink is standing water, not 3-501.13.
