The share passes through the deceased owner's estate by will or intestacy. It does not automatically pass to the other tenants in common.
Why can a later-recorded property-tax lien outrank an earlier mortgage?
Lien priority has statutory exceptions. Although earlier recording usually establishes priority, real estate tax liens commonly receive superior priority by law.
What kind of notice does proper recording give a later purchaser who never actually read the deed?
Constructive notice. Recording places the public on legal notice of the instrument; actual notice means the person truly knew of it.
A distressed seller accepts less than typical buyers would pay. Is the sale amount market price or necessarily market value?
It is market price—the amount actually paid. Market value is an opinion of the most probable price under normal, informed, arm's-length conditions, so the two can differ.
Which valuation principle limits a property's value to the cost of an equally desirable alternative?
Substitution. A rational buyer generally will not pay more for a property than the cost of acquiring a comparable substitute without undue delay.
How do functional obsolescence and external obsolescence differ?
Functional obsolescence comes from a deficiency or outdated feature within the property, such as a poor layout. External obsolescence comes from outside the property, such as nearby noise or adverse land use.
What direct-capitalization relationship connects value, net operating income, and capitalization rate?
Value = NOI ÷ capitalization rate. Rearranged, NOI = value × rate and rate = NOI ÷ value; the rate must be written as a decimal in the calculation.
A seller promises to pay only if a broker produces a stated result. Is acceptance a promise or performance?
Performance. That structure is unilateral: one party promises in exchange for the other party's completed act. A bilateral contract exchanges promises.
Which contract defect lets a protected party choose to affirm or avoid an otherwise valid agreement?
A voidable contract. It remains effective unless the protected party rescinds it; a void contract has no legal effect from the start, while an unenforceable agreement may be valid but lacks a judicial remedy.
A seller changes the closing date before signing a buyer's offer. What happens to the original offer?
The change creates a counteroffer, which rejects the original offer and proposes new terms. The buyer must accept the counteroffer for a contract to form.
What ownership interest does a buyer gain after a binding sale contract but before delivery of the deed?
Equitable title. The seller generally retains legal title as security until closing, subject to the contract and applicable law.
Why must an optionee give consideration for an option to purchase?
Consideration makes the owner's promise to keep the offer open enforceable for the option period. The optionee receives a right to buy but is not obligated to exercise it.
What is the agency effect of a principal ratifying an agent's previously unauthorized act?
Ratification adopts the act as though it had been authorized, provided the principal had the relevant facts and accepted the act in a legally effective manner.
Which agency duty usually survives termination and still limits later disclosure?
Confidentiality. An agent generally must continue protecting a former client's confidential information unless disclosure is authorized or required by law.
A seller personally finds the buyer. Which listing may avoid a commission, and which normally still earns one?
An exclusive-agency listing may let the seller avoid a commission for a buyer found without broker help. An exclusive-right-to-sell listing generally earns the agreed commission regardless of who finds the buyer.
Why does a net listing create an inherent conflict of interest?
The broker keeps the amount above the seller's required net, so the broker's compensation grows as the seller receives proportionally less. Many jurisdictions restrict or prohibit this arrangement.
For federal Fair Housing purposes, what does familial status protect?
Households with a person under 18 living with a parent, legal custodian, or designee, plus pregnant persons and people securing custody of a child. A qualifying housing-for-older-persons exemption may apply.
Competing brokers agree that none will charge below a set commission. Which antitrust violation does that suggest?
Price fixing. Competitors must independently establish commissions and other service terms; jointly setting a floor or standard price restrains competition.

The buyer. Allocate the closing date to the party specified, then count each party's days using the question's required 360- or 365-day method.
What is AREC's central public-protection role under Alabama license law?
AREC administers and enforces the state's real estate licensing law and rules, including licensing, investigations, hearings, and discipline. A majority of its nine members forms a quorum for Commission business.
Which age, education, and residency baselines apply to an Alabama salesperson applicant?

The exam has 120 scored items: 80 national/general and 40 Alabama state. It also contains 10–15 unidentified, unscored pretest items. Candidates receive 2.5 hours for the general portion and 1 hour for the state portion, for 3.5 hours total.
What score is required to pass the Alabama salesperson exam?
