2.1 School Licensing, Insurance & the Established Place of Business

[!NOTE] Two credentials, two statutes. RCW 46.82.310 licenses the business. RCW 46.82.320 licenses the person. An instructor working at an unlicensed school is not lawfully instructing, and a licensed school employing an unlicensed instructor is exposed under RCW 46.82.350(9). Instructor candidates are examined on both because the licence they are seeking only functions inside a licensed school.


When the school licence must exist

RCW 46.82.310(1): "No person shall engage in the business of conducting a driver training school without a license issued by the director for that purpose." The statute then lists three activities that cannot occur until the licence is displayed:

  1. schedule, enroll, or engage any students in a course of instruction;
  2. issue a verification of enrollment to any student; or
  3. begin any classroom or behind-the-wheel instruction.

Item 2 has direct downstream consequences. A verification of enrollment is what lets a 15-year-old obtain an instruction permit under RCW 46.20.055(1)(b), so an unlicensed school that issues one is not merely committing a business-licensing violation - it is putting an unlawfully issued permit into circulation.

WAC 308-108-020(8) defines "engage in a course of instruction" broadly: "to enroll in, schedule, collect a fee for, or sign an application for an instruction permit in order to attend or take part in a driver training education course." Collecting a deposit counts.

The pre-licence inspection

RCW 46.82.310(2): before an application is approved, "the business practices, facilities, records, vehicles, and insurance of the proposed school must be inspected and reviewed by authorized representatives of the director." The same five-item inspection applies to a branch office or branch classroom application under RCW 46.82.310(3).

If approved, "the applicant shall be granted a license valid for a period of one year from the date of issuance."

Renewal, lateness and the void date

RCW 46.82.310(4) builds a two-stage lapse:

WAC 308-108-120(10) adds a knock-on effect: "Failure to renew a school license before it expires will put all related branch office or branch classroom licenses into an inactive status."

Under RCW 46.82.310(4) the director issues a licence certificate "subject to the department's inspection of the business," and that certificate "shall be conspicuously displayed in the place of business of the licensee."


Insurance: the one-million-dollar standard

This is the most frequently misstated number in Washington driver-training compliance. RCW 46.82.310(7) requires that evidence of liability insurance covering both the instruction vehicles and the building premises be filed with the director before a school licence is issued or renewed, and sets four standards plus a notification duty:

Three corrections worth making explicitly, because incorrect versions circulate widely:

  • There is no split-limit alternative. Washington does not offer a "100/300/50" option alongside the million-dollar figure. The statutory floor is a single number.
  • The coverage is not vehicle-only. RCW 46.82.310(7) opens by requiring evidence of liability coverage "for the instruction vehicles and the building premises."
  • The ten-working-day duty runs from the school to the director. The statute does not make DOL a certificate holder or require the insurer to notify the state; it makes the licensee responsible for notifying the department and proving continuing coverage.

WAC 308-108-110(2)(b) reinforces the documentation side: vehicle records maintained at the school's primary place of business must include "the original insurance policy or policies covering the vehicles" together with copies of current vehicle registrations and the annual vehicle safety inspection report.


The established place of business

RCW 46.82.360(6) requires a driver training school to have "an established place of business owned, rented, or leased by the school and regularly occupied and used exclusively for the business of giving driver instruction," located in a district zoned for business or commercial purposes, or zoned for conditional use permits for schools, trade schools or colleges.

RCW 46.82.360(6)(a) lists what an established place of business, branch office, classroom or advertised address may not consist of or include:

  • a house trailer;
  • a residence;
  • a tent;
  • a temporary stand or temporary address;
  • a bus;
  • a telephone answering service, if that service is the sole means of contacting the school;
  • a room or rooms in a hotel, rooming house or apartment house; or
  • premises occupied by a single or multiple-unit dwelling house.

RCW 46.82.360(6)(b) permits a school to lease classroom space inside a public or private school recognised and regulated by OSPI, "as approved by the director" - but expressly says that doing so "does not alleviate the driver training school from securing and maintaining an established place of business nor from using its own classroom on a regular basis."

WAC 308-108-100(1)(b) defines the occupancy standard: "Regularly occupied means that the public and the department can expect to make contact with the school owner or its staff or instructors at the main office during its business hours."


Ownership changes and transfers

RCW 46.82.360(5) requires written notice to the director "within ten business days after any change is made in the officers, directors, or location of the place of business." Ownership changes go further. Under RCW 46.82.310(6), except as otherwise permitted by rule, a change involving ownership "requires a new license application, including payment of all fees":

  • the relinquishing owner must notify the director in writing within ten business days;
  • the new owner must submit a transfer application and fee within ten business days;
  • on receipt, the director "shall permit continuance of the business for a period not to exceed sixty days from the date of transfer" pending approval; and
  • the transferred licence "shall remain subject to suspension, revocation, or denial in accordance with RCW 46.82.350 and 46.82.360."

WAC 308-108-120(6) completes the picture on records: "Upon the sale or other transfer of a school by its owner, the school and student records shall be transferred to the new owner and become the property and responsibility of the new owner." The transfer fee is $500.00 under WAC 308-108-025 - the same as an original application, not the $250.00 renewal rate.

Substantial interest holders

RCW 46.82.280(16) defines a "substantial interest holder" as a person with actual or potential influence over management or operation, and gives non-exclusive evidence of that status, including owning 10 percent or more of any class of stock in a privately or closely held corporate school (or five percent or more in a publicly traded one), furnishing 10 percent or more of the capital in a calendar year, or receiving salary, commission or royalties from the activity. RCW 46.82.350(5) makes it a disciplinary cause if the applicant or licensee "has failed to require all persons with financial interest in the driver training school to be signatories to the application."
