5.5 Driver Education Requirements for Applicants Under 25

[!IMPORTANT] Why an instructor is examined on a phase-in schedule. The legislature's stated finding in 2025 c 299 s 1 is that "young adults under the age of 25 who obtain their initial driver's license after turning 18 years of age and are therefore not required to complete some form of driver training education are statistically more likely to be involved in or cause serious injury or fatal crashes than their peers who completed driver training education before the age of 18." Chapter 46.82 RCW schools are the delivery system for the fix, and DOL must report annually on whether the school system can absorb the demand.

The phase-in schedule

RCW 46.20.1191(1)(a): to obtain an initial driver's licence, the following persons must, in addition to other skills and examination requirements, satisfactorily complete a driver training education course as defined in RCW 28A.220.020 or as defined by the department and offered by a driver training school licensed under chapter 46.82 RCW:

RCW 46.20.1191(8) gives the department a safety valve: it "may, by rule, pause or delay the requirements ... if, upon an internal review, the department finds that there is an insufficient number of driver education and traffic safety education courses or instructors available for the pending age cohort."

RCW 46.20.1191(7) requires DOL to report, beginning by January 1, 2026 and annually until January 1, 2031, on implementation "including the readiness of the driver education school system to accommodate additional growth," to the transportation committees of the legislature.

Who may deliver which course

RCW 46.20.1191(1)(b) and (1)(d) create an important split:

• The school district or approved private school course must be part of an OSPI-authorised traffic safety education programme certified under chapter 28A.220 RCW, and eligibility to enroll in that course "is limited to students who are enrolled in a public school ..., enrolled in an approved private school ..., or receiving home-based instruction."
• The driver training school course must meet the standards established by DOL under chapter 46.82 RCW.

A 19-year-old who is not enrolled in school is therefore routed to a commercial driver training school. That is the demand shift the statute creates.

RCW 46.20.1191(1)(b) also carries the hardship allowance: a school district, approved private school or driver training school "may offer the behind-the-wheel instruction portion for up to four hours in a single day in cases of hardship, such as a student needing to travel a great distance to receive the behind-the-wheel instruction." This is a statutory exception to the one-hour-per-day behind-the-wheel cap in WAC 308-108-150(3) and should be documented as hardship when used.

RCW 46.20.1191(1)(c) encourages licensed schools to include "a self-paced online course, or components of a self-paced online course, in the classroom instruction portion ..., as authorized and certified by the department, to the extent feasible, and to focus teaching resources on the behind-the-wheel portion." Read this together with WAC 308-108-150(6), which prohibits self-paced instruction absent that authorisation: the legislature is encouraging a route the rule otherwise closes, and the gate is departmental certification.

The work-zone and first responder safety course

RCW 46.20.1191(3): "Beginning May 1, 2026, until January 1, 2031, an applicant for an initial driver's license under the age of 25 must pass an online course approved by the department on driver work zone and first responder safety."

• The department may waive the requirement if it finds the course is not available at the time of application.
• DOL "must contract with a provider ... to host an online course that satisfies the requirement ... to be made available at no cost to initial driver's license applicants under the age of 25."

The requirement is cross-referenced twice more: RCW 46.20.075(1)(d) makes it an intermediate licence prerequisite until January 1, 2031, and RCW 46.20.100(2)(a)(ii) makes it part of the traffic safety education requirement for applicants under 18 over the same window.

Practically, this is a free online module every young applicant needs, and the substantive content maps to section 6.4 of this guide - the emergency and work zone rules in RCW 46.61.212 and the doubled penalties that apply there.

The safe driving course trigger

RCW 46.20.1191(9) creates a post-licence remedial requirement:

RCW 46.20.1191(9)(c): "multiple traffic infractions issued during or as the result of a single traffic stop constitute one occasion" - the same counting rule as RCW 46.20.267.

Note the course types this creates work for. A condensed traffic safety education course is defined in RCW 46.82.280(4) as at least eight hours of classroom and three hours of behind-the-wheel following the approved curriculum as determined in rule.

Renewal-linked refresher, from 2031

RCW 46.20.1191(10): beginning January 1, 2031, every initial driver's licence for a person under 21 "expires on the latter of the licensee's 21st birthdate following issuance of the license or the licensee's second birthdate after the license issuance date," and the person "may not renew ... until satisfactorily completing a driver training education refresher course, as determined by the department in rule."

RCW 46.82.280(7) defines the refresher course as following the approved curriculum as determined in rule and including "but ... not limited to, a focus on driver risk management and hazard perception."

RCW 46.20.1191(11) defines "initial driver's license" for subsections (3), (9) and (10) as "a driver's license issued to a driver who has not previously been issued a driver's license in this state."

Exemptions and waivers

What this means for an instructor

• Adult students become a core market. An 18-to-21-year-old cohort with no prior driving education, sometimes with years of unlearned habits from unsupervised practice, will arrive at commercial schools. Adult-course design under WAC 308-108-020(1) becomes a professional skill, not an afterthought.
• Capacity is a policy variable. DOL reports annually on school-system readiness and may pause the phase-in. Instructor supply is part of that calculation, which is also why RCW 46.82.470 funds mentorship and pipeline programmes.
• Know the free course. Every young applicant must pass the work-zone module from May 2026. Tell them in session one; do not let them discover it at the counter.
• Track the dates. Four cohort dates, one course start date, two safe-driving-course dates and one refresher date. Keep a dated one-pager rather than trusting memory.

• The phase-in is by cohort year: under 19 in 2027, under 20 in 2028, under 21 in 2029, under 22 in 2030.
• The work-zone course applies to all initial applicants under 25 from 1 May 2026 to 1 January 2031, and is free.
• 180 days from notice to complete a safe driving course, or the licence is suspended.
• A single stop is one occasion, however many infractions are written.
• Reciprocal-jurisdiction licensees are exempt from the driver education requirement.
