5.1 The Instruction Permit: Eligibility, Waiver, Term & Fees

[!CAUTION] Get the subsections the right way round. Many summaries state that RCW 46.20.055(1)(a) is the enrolled-at-15 pathway and (1)(b) is the non-enrolled-at-15.5 pathway. The statute reads the other way: (1)(a) is "Is at least 15.5 years of age" and (1)(b) is "Is at least 15 years of age and ... is enrolled in a driver training education course." Because instructor examination items cite subsections, the order matters.

The opening conditions

RCW 46.20.055(1): "The department may issue a driver's instruction permit online or in person, with or without a photograph, to an applicant who has successfully passed all parts of the examination other than the driving test, provided the information required by RCW 46.20.091, paid an application fee of $25 prior to January 1, 2026, and $35 on or after January 1, 2026, and meets the following requirements:"

Pathway (b): the enrolled fifteen-year-old

RCW 46.20.055(1)(b)(ii) describes the qualifying course precisely. The applicant must be "enrolled in a driver training education course offered as part of a traffic safety education program authorized by the office of the superintendent of public instruction and certified under chapter 28A.220 RCW, or offered by a driver training school licensed and inspected by the department of licensing under chapter 46.82 RCW, that includes practice driving."

Three components must all be present: the right age, a proper application, and enrollment in a course of one of the two recognised types that includes practice driving. A classroom-only offering does not open the age-15 door.

This is why enrollment verification is a regulated act. RCW 46.82.310(1)(b) bars an unlicensed school from issuing "a verification of enrollment to any student," and WAC 308-108-020(8) defines engaging in a course of instruction to include "signing an application for an instruction permit."

The written-examination waiver

RCW 46.20.055(2): "The department may waive the written examination if, at the time of application, an applicant is enrolled in a driver training education course as defined in RCW 46.82.280 or 28A.220.020. The department may require proof of registration in such a course as it deems necessary."

Two points of accuracy:

• The waiver is discretionary ("may waive"), not automatic.
• The waiver is tied to enrollment, not to age. Nothing in subsection (2) limits it to the age-15 pathway, so an enrolled applicant may benefit from it.

Where the waiver is not applied, the applicant must pass the department's knowledge test. Washington's public driver licence knowledge test standard is 32 correct answers out of 40. That is the standard for licence applicants; it is not the instructor exam standard, which is 87 percent, and it is not a rule-stated standard for a school's own final examination.

Parental signature

RCW 46.20.100(1): "The application of a person under the age of 18 years for a driver's license or a motorcycle endorsement must be signed by a parent, guardian, employer, or responsible adult as defined in RCW 46.20.075."

Note the four categories. Washington deliberately includes an employer and a responsible adult, the latter defined in RCW 46.20.075(9)(b) as a person specifically authorised by the department who is over 21 and has a familial, kinship or caretaker relationship to the minor; or is an educational, medical, legal, social service or Washington-licensed mental health professional supporting the minor professionally; or is a government employee supporting the minor professionally. Instructors working with students in foster care, or living apart from parents, should know the statute does not require a parent.

The statute requires a signature. It does not require notarisation.

Term, renewal limits and fees

RCW 46.20.055(4) - "Term of instruction permit":

• "A driver's instruction permit is valid for one year from the date of issue."
• (a) "The department may issue one additional one-year permit."
• (b) "The department may issue a third driver's instruction permit if it finds after an investigation that the permittee is diligently seeking to improve driving proficiency."
• (c) "A person applying for an additional instruction permit must submit the application to the department and pay an application fee of $25 for each issuance."

This is a practical coaching point. A student who drifts through two permits without progressing is not simply inconvenienced; the third permit requires the department to investigate and make a finding. Instructors who see a student stalling should say so early, involve the guardian, and use the additional-practice direction required by WAC 308-108-170(4).

What the permit does not authorise

RCW 46.20.055(3) opens: "A person holding a driver's instruction permit may drive a motor vehicle, other than a motorcycle, upon the public highways if..." The three conditions in that subsection are the subject of section 5.2.

Note the motorcycle exclusion. A car instruction permit is not authority to operate a motorcycle; motorcycle instruction permits and endorsements are governed separately, and RCW 46.20.100(2)(c) requires a motorcycle safety education course meeting departmental standards for a motorcycle endorsement.

Instructor duties at the permit stage

1. Verify before you verify. Signing an enrollment verification for a 15-year-old asserts that the student is enrolled in a course that includes practice driving. Do not sign ahead of actual enrollment.
2. Explain the fee change. Families budgeting from older information will expect $25; the fee is $35 for permits issued on or after 1 January 2026, and $25 for each additional permit issuance under subsection (4)(c).
3. Explain the clock. One year, one automatic renewal, then an investigation. Map the student's course, 50 practice hours and test date against that window at the first lesson.
4. Check the permit at every drive. RCW 46.82.360(3) prohibits behind-the-wheel instruction without a current and valid permit or licence, and RCW 46.20.055(3)(a) requires immediate possession.

• (1)(a) is 15.5; (1)(b) is 15 with enrollment. Do not reverse them.
• The qualifying course must include practice driving.
• The written-exam waiver is discretionary and keyed to enrollment.
• One year, plus one more as of right, plus a third only after investigation.
• A parent, guardian, employer or responsible adult may sign; notarisation is not required.
• $35 for a permit issued on or after 1 January 2026; $25 for each additional permit.
