2.3 Instructional Vehicles: Equipment, Signage & Inspection

[!NOTE] Where the vehicle rules live. Dual controls, mirrors and signage are in RCW 46.82.360(2) - a business-practice statute whose breach is a disciplinary cause. Emergency equipment, inspection and record-keeping are in WAC 308-108-110. Post-collision reporting is in WAC 308-108-140(1)(b). WAC 308-108-080 is the instructor application rule and has nothing to do with vehicles.


Statutory equipment: RCW 46.82.360(2)

"Any automobile used by a driver training school or an instructor for instruction purposes must be equipped with:"

(a) Dual controls for foot brake and clutch, or foot brake only in a vehicle equipped with an automatic transmission.

The clutch half of that phrase is frequently dropped. In a manual-transmission training car Washington requires a dual clutch as well as a dual brake; the foot-brake-only allowance applies specifically to automatics. Nothing in the statute requires a dual accelerator, and nothing prohibits one either - a claim that dual accelerators are "strictly prohibited" is not supported by the text.

(b) An instructor's rear view mirror.

Singular. The statute requires one instructor's rear view mirror, not a matched pair of auxiliary mirrors. The practical purpose is that the primary interior mirror is aimed at the driver's eye position and is useless from the right seat.

(c) A sign in legible, printed English letters displayed on the back or top, or both, of the vehicle. The sign specification is dimensional and exact:

Two frequent misstatements: the required lettering height is two and one-half inches, not two; and the required placement is the back or top, or both - the statute does not require a front-facing sign. A school may of course add one, but a front sign does not satisfy the rule on its own.


Emergency equipment: WAC 308-108-110(1)

All vehicles used for student instruction by a commercial driver training school shall:

(a) carry a minimum twenty-piece approved first aid kit, a fire extinguisher safely secured in the vehicle and fully charged, and an emergency strobe light, reflective triangle, or two eighteen-inch traffic cones;

(b) maintain an annual vehicle inspection form meeting minimum equipment and safety criteria established by the department, conducted by or for the school owner; and

(c) be used exclusively for driver training purposes at all times when student instruction is being given.

Three precision points:

  • The first aid kit has a stated minimum piece count - twenty pieces - and no other specification.
  • The extinguisher requirement is "safely secured in the vehicle and fully charged." The rule sets no rating such as 10-B:C. An extinguisher rolling loose in the boot fails the "safely secured" test; a mounted but discharged unit fails the "fully charged" test.
  • The warning-device requirement is a choice of three, and one of the options is two eighteen-inch traffic cones. A requirement for "three FMVSS 125 reflective triangles" does not appear anywhere in Washington's rule.

Vehicle records

WAC 308-108-110(2) requires records of all traffic safety education vehicles to be maintained at the school's primary place of business and to include the original insurance policy or policies covering the vehicles plus copies of the current vehicle registrations and the annual vehicle safety inspection report.

RCW 46.82.360(8)(b) and (c) add the retention period, and it differs from the student-record period: student and instructor records are kept three years following completion of instruction, but vehicle records shall be maintained for five years following their issuance.


The annual inspection and post-collision return to service

WAC 308-108-140(1)(d) states the frequency duty from the owner's side: "Not less than annually, have completed and have on file at the main school location a vehicle inspection report as required under WAC 308-108-110(1)(b) for all traffic safety education vehicles in use by the school."

The inspection is "conducted by or for the school owner" on a form meeting DOL's minimum equipment and safety criteria. There is no rule requiring an ASE-certified master technician or a state inspector; the owner is accountable for having a compliant report on file.

WAC 308-108-140(1)(b) creates a fast reporting clock and a hard gate after a crash:

Report to the department within 24 hours following any traffic safety education vehicle involved in a traffic collision for which an accident report must be or has been made under RCW 46.52.030. Prior to the return to service of any traffic safety education vehicle that has been involved in a collision, the school owner must forward a vehicle inspection report to the department.

So a crashed training car does not return to instruction on the strength of a body-shop invoice. A fresh inspection report must reach DOL first.

WAC 308-108-140(1)(e) completes the fleet-tracking picture: report to the department within 10 days any new vehicles used by the school for instructional purposes or any vehicles taken out of service.


Pre-drive vehicle responsibility for the instructor

The Traffic Safety Education Instructor Standards standard 2.2 (Vehicle Knowledge) makes the vehicle an instructor competency, not just an owner compliance item. It expects the instructor to:

  • understand and apply vehicle safety technologies, including their definitions and uses;
  • inspect the vehicle for safety before behind-the-wheel lessons and recognise annual inspection requirements;
  • identify potential safety concerns related to the instructional vehicle and conduct vehicle safety checks regularly;
  • have a foundational knowledge of vehicle mechanics and maintenance; and
  • model responsible, safe driving behaviours during behind-the-wheel lessons.

A workable daily pre-drive check that maps onto both the standards and the rules: confirm the sign is displayed and legible; test the dual brake (and dual clutch in a manual) for full travel and brake-lamp activation; set and confirm the instructor's rear view mirror; verify the first aid kit, secured and charged extinguisher, and the chosen warning device are present; check tyres, lights, wipers and fluid levels; and confirm the current inspection report and registration are on file at the main office.
