1.1 The Site Safety Supervisor: Legal Appointment, DOSH Registration & Core Duties
Key Takeaways
Regulation 39(1) of the CDM Regulations 2024 requires the principal contractor of construction work to appoint a competent person who is a Site Safety Supervisor; failing to do so carries a fine of up to RM50,000, six months' imprisonment or both.
DOSH registers an SSS as a competent person, and under section 31D of OSHA 1994 each registration is valid for three years before renewal through MyKKP.
DOSH lists five SSS registration routes (A to E); route B is a Malaysian with at least two years as a site supervisor or foreman who attended the SSS course and passed the NIOSH SSS examination.
The NIOSH SSS course runs 10 days (80 hours), and the examination fee is RM350 (NIOSH course curriculum revision NAAK250918).
An SHO is a separate competent person: the SHO Order 1997 requires one for building or engineering construction projects whose total contract price exceeds RM20 million, and the SHO acts as secretary of the safety and health committee.
Why this topic opens the course
Part 1 of the NIOSH SSS course is the Introduction of Site Safety Supervisor. Every later topic, from scaffolding to confined spaces, assumes you know who appoints you, what law gives you your job, and what you are expected to do when you find a hazard. Examiners test this in Paper 1 multiple-choice questions, in the structured and essay questions, and again in the Paper 2 presentation, where 8 of the 100 marks are for "knowledge of the responsibilities and role of the SSS".
Important
Many older notes still say the SSS is appointed under "Regulation 25 of BOWEC 1986". The Factories and Machinery Act 1967 was repealed on 1 June 2024 by the Factories and Machinery (Repeal) Act 2022 (Act 835), and DOSH lists the BOWEC Regulations 1986 among its repealed regulations. The current legal basis is the Occupational Safety and Health (Construction Work) (Design and Management) Regulations 2024 (P.U.(A) 147/2024, usually called CDM 2024), which came into force on the same day.
The legal appointment: CDM 2024 regulation 39
Regulation 39(1) of CDM 2024 says, in its official Malay text, that the principal contractor of construction work (kontraktor prinsipal kerja pembinaan) shall appoint a competent person who is a site safety supervisor to help the principal contractor comply with the duties placed on it by the Regulations. Regulation 39(2) makes failure an offence, with a fine of up to RM50,000, imprisonment of up to six months, or both.
Three words in that sentence matter in exam answers:
| Term | Meaning under CDM 2024 | Why it matters |
|---|---|---|
| Principal contractor | The construction work contractor appointed in writing by the client under regulation 7(1)(b) when more than one contractor works, or is expected to work, on the project | The duty to appoint the SSS sits with this organisation, not with each subcontractor |
| Competent person | A person registered with the Director General of DOSH under section 31C of OSHA 1994 | An unregistered person cannot lawfully be "the SSS", however experienced |
| Assist | The SSS helps the principal contractor meet its CDM duties | Legal responsibility stays with the principal contractor; the SSS is its safety supervisor, not a substitute duty holder |
The SSS therefore supports the principal contractor's duties under regulation 15 (planning, managing and monitoring the construction phase, coordinating contractors, site induction, preventing unauthorised access, providing welfare facilities) and the general site requirements in Part IV (regulations 18 to 37), such as safe access, good order, structural stability, excavations, traffic routes and emergency arrangements.
What changed from the BOWEC era
Knowing the history helps you spot outdated exam distractors:
| Point | Repealed BOWEC 1986 (until 31 May 2024) | Current position (from 1 June 2024) |
|---|---|---|
| Legal basis | Regulation 25, made under the FMA 1967 | Regulation 39 of CDM 2024, made under section 66 of OSHA 1994 |
| Who appointed | The "main contractor" of a worksite | The "principal contractor" appointed by the client |
| Time commitment | Part-time, at least 15 hours a week on safety supervision | Not fixed by regulation 39; regulation 38 requires duty holders to give the people they appoint to assist them sufficient time and means |
| Contractor safety supervisors | Regulation 26: other contractors with more than 20 persons appointed a part-time contractor's safety supervisor | No equivalent CDM regulation; each contractor still has its own duties under regulation 17 |
| Penalty | General BOWEC penalty of RM2,000 | RM50,000 or six months or both |
DOSH's June 2024 guidance on managing the BOWEC repeal confirmed that SSS registrations issued on or before 31 May 2024 stay valid until their expiry date and are now managed under CDM 2024, with renewal online through MyKKP.
Becoming a registered SSS
Step 1: The NIOSH SSS course
The current NIOSH course curriculum (revision NAAK250918) sets out:
- Duration: 10 days, 80 hours, including a site visit, group assignment and presentation on Day 10
- Fees: course fee RM1,458 including 8% SST; examination fee RM350
- Entry requirements: Malaysian citizen with at least LCE, SRP, PMR or PT3 (or equivalent)
- Objectives: describe the OSH legislative requirements for construction sites, conduct risk management, elaborate OSH requirements for site management, and be a competent SSS
- Topics: Part 1 Introduction; Part 2 Legislation; Part 3 OSH Management Systems; Part 4 Occupational Safety (hazards and controls); Part 5 Occupational Health (hazards and controls); Part 6 Site Visit
NIOSH also runs a shorter SSS – Occupational Safety course (7 days, 47 hours, RM1,080) for people who have already passed the SHO examination. It covers only Parts 2 and 4.
Step 2: The examination
The examination is run by the Lembaga Penilaian Kompetensi Keselamatan dan Kesihatan Pekerjaan (LPKKKP) through NIOSH. Paper 1 is written; Paper 2 is a site assessment plus an online presentation. Chapter 11 covers the format in detail.
Step 3: DOSH registration routes
DOSH's SSS page (updated 16 March 2026) lists who may register:
| Route | Qualification and experience | Course and examination |
|---|---|---|
| A | At least a diploma in engineering, architecture or a construction-related field | Attended the SSS course at a DOSH-registered training provider and passed the SSS examination |
| B | At least two years as a construction site supervisor or site foreman | Attended the SSS course and passed the SSS examination |
| C | At least ten years as a construction site supervisor or site foreman | Passed the SSS examination |
| D | Passed the NIOSH SHO examination but cannot yet register as SHO because of less than three years' experience | Plus 12 months' construction experience, or Parts 2 and 4 of the SSS course, or the CIDB site supervisor course |
| E | At least a Diploma in OSH (or equivalent approved by DOSH) | Plus six months' construction experience, or Parts 2 and 4 of the SSS course |
Step 4: Registration, validity and fees
Registration follows OSHA 1994 Part VIIA:
- Section 31C: the application goes to the Director General with the prescribed fee and documents.
- Section 31D: each registration is valid for three years from the approval date.
- Section 31E: renewal is applied for before expiry; DOSH may refuse renewal for non-compliance, breach of conditions or false information.
- Section 31F: DOSH may cancel a registration for non-compliance, breach of conditions, fraud or misrepresentation, or if the person is no longer fit to act. It must first give the person a chance to make written representations.
- Fees (P.U.(A) 146/2024): an individual pays a RM50 processing fee and a RM200 registration or renewal fee.
On site the registration document is often nicknamed the "Yellow Book". The SHO equivalent is called the "Green Book". These are industry nicknames, not legal terms.
What an SSS actually does
CDM 2024 does not list SSS tasks one by one. The duties come from the principal contractor's obligations that the SSS is appointed to support. In practice an SSS:
- Inspects the site daily. This includes edge protection, floor openings, scaffolds, excavations, lifting areas, electrical boards, housekeeping and welfare facilities, compared against the construction phase plan and Part IV of CDM 2024.
- Stops and corrects. The SSS stops unsafe acts and makes safe any unsafe conditions, then records the defect and its close-out.
- Coordinates contractors. The SSS checks that subcontractors follow their method statements, permits and the site rules (regulations 15 and 17).
- Runs or monitors communication. This covers site inductions, toolbox meetings and the consultation arrangements required by regulation 16.
- Supports incident response. The SSS secures the scene, helps the employer meet NADOPOD 2004 notification duties and supports the investigation.
- Keeps records. These include inspection records, excavation inspection reports under regulation 26, permit copies and training attendance.
Older material quoted the BOWEC duty list: inspect and rectify unsafe places, correct unsafe practices, check subcontractors' work, and liaise with contractors' safety supervisors. It is still a useful summary of the job, provided you cite it as historical.
SSS compared with SHO
| Dimension | Site Safety Supervisor (SSS) | Safety and Health Officer (SHO) |
|---|---|---|
| Legal basis | CDM 2024 regulation 39 | OSHA 1994 section 29, SHO Order 1997 and SHO Regulations 1997 |
| Who appoints | Principal contractor of construction work | Occupier of a place of work listed in the SHO Order |
| Construction trigger | Every principal contractor of construction work | Building operations or works of engineering construction with a total contract price above RM20 million |
| Committee role | Usually a member | Secretary of the safety and health committee (SHC Regulations 1996 reg. 6(2)) |
| Reporting | Daily inspection and supervision records | Monthly report to the employer, submitted before the 10th of the month (SHO Regulations 1997 reg. 19) |
On large projects both roles coexist. The SHO manages the system, and the SSS keeps the work face compliant.
Scenario: who must appoint?
A client appoints Syarikat A as principal contractor for a six-storey hostel, with eight subcontractors on site. Syarikat B, the piling subcontractor, asks whether it must appoint its own SSS. Under CDM 2024 the duty to appoint the SSS is on Syarikat A. Syarikat B still has its own regulation 17 duties: plan and supervise its work safely, provide induction and information to its workers, and follow the principal contractor's directions and the construction phase plan. It may also appoint safety assistants under regulation 38 if its risks justify it.
Under which current legal provision must a principal contractor of construction work in Malaysia appoint a Site Safety Supervisor?
Regulation 25 of the Factories and Machinery (Building Operations and Works of Engineering Construction) (Safety) Regulations 1986
Regulation 39 of the OSH (Construction Work) (Design and Management) Regulations 2024
Section 29 of OSHA 1994 and the Occupational Safety and Health (Safety and Health Officer) Order 1997
Section 33 of the CIDB Act 1994 (Act 520)
A person registered with DOSH as an SSS on 1 February 2026 asks how long the registration lasts before renewal. What does OSHA 1994 provide?
One year, renewable by re-sitting Paper 1
Two years from the date of the first examination
Three years from the date specified in the approval
Five years, provided continuing education points are earned
Which statement correctly contrasts the SSS and the SHO on a Malaysian construction project?
The SSS is appointed only on projects above RM20 million, while every project needs an SHO.
The SSS serves as the statutory secretary of the safety and health committee, while the SHO supervises daily site inspections.
The SSS and SHO are the same competent person category under section 29 of OSHA 1994.
The SHO Order 1997 requires an SHO above RM20 million, while CDM 2024 requires every principal contractor to appoint an SSS.
