About the Notario Yucatán Exam

Independent practice for Yucatán's notary exams by OpenExamPrep. Under the Ley del Notariado del Estado de Yucatán, as reformed through 31 December 2025, candidates with two years of notarial practice and the Colegio's ethics course pass an aspirante exam, a written questionnaire and a drafting test, and then compete in an oposición when a notaría falls vacant. Each stage needs 80 points. This bank is an English-language MCQ study adaptation, not an official translation or format simulation. It is built on the state statute, including notarial successions, and federal company law, and it keeps the Spanish legal terms. Its topic split is our own study allocation, because no official weights are published.

Assessment

Aspirante exam (Articles 15–36): the applicant requests the exam from the Executive with a recent psychometric exam; the Consejería Jurídica sets the date within 90 natural days and gives 15 business days' notice of the sínodo, one of whose members the applicant may recuse. The theoretical test is a written questionnaire on the statute, the ethics course, notarial practice and the temario published each January; its result is given the same day. The next day, candidates who passed draft a notarial case drawn at random from the temario, using only codes and laws. Each test allows up to five hours; each sinodal grades 0–100, 80 passes each test, and the final grade averages both. Oposición (Articles 39–43): when a notaría falls vacant, the Executive publishes a call; the exam is held 45–60 natural days later. All candidates sit a public theoretical test; those averaging 80 take a practical test within ten business days on one case chosen by the most senior aspirante. The highest passing final grade wins; ties go to the older application.

Notario Yucatán: Suggested Study Strategy

1Study the published temario and the exam mechanics: a four-member sínodo, one recusal without cause, five hours per test, 80 points per test, and the practical test the day after the theory result.
2Know the post-2022 structure: the Consejería Jurídica oversees notaries, the Colegio Notarial de Yucatán is the professional body, and the Dirección del Archivo Notarial belongs to the Consejería.
3Memorize the deadlines: 30 natural days before 'No pasó', 45 natural days to sign a suplencia convenio, 45 days per semester of absence without licence, 3 business days for power-revocation notices and 90 business days to present testimonios.
4Practise the conditions for notarial successions: adult heirs, no controversy, a public open will or heirs previously recognized by a judge, and an Archivo Notarial report on wills.

Frequently Asked Questions

Who can sit the Yucatán aspirante exam?

Mexican citizens whose law title and cédula were issued at least five years earlier, with five years' residence in the State before starting practice, two uninterrupted years of practice in a Yucatán notaría, and the Colegio Notarial's ethics and notarial practice course, among the other Article 16 requirements. The request needs a psychometric exam from the Servicios de Salud de Yucatán no older than 30 days (Article 15).

What is the theoretical test like?

It is a written questionnaire the Consejería Jurídica provides on exam day, covering the Ley del Notariado, the ethics course, notarial practice and the temario the Consejería publishes each January in the Diario Oficial. Candidates have up to five hours; each sinodal grades it from 0 to 100, and 80 is needed to go on to the practical test (Articles 26–29).

How is a vacant notaría filled?

The Executive publishes a call; the oposición is held 45–60 natural days later. All qualified aspirantes sit the theoretical test together, and those averaging 80 take a common practical case. The highest passing final grade wins, with ties going to the older application. A vacancy in Mérida is first offered to notaries residing in other municipalities (Articles 39–43).

Is the exam available in English, and what does this bank cover?

No. Both exams are held in Spanish. This bank is an independent English-language MCQ study adaptation, not an official translation or format simulation. It keeps the Spanish legal terms and reviews the statute behind the written questionnaire and the drafting test.
