About the Notario Estado de México Exam
Independent practice for the Estado de México notary exams by OpenExamPrep. In the Estado de México, a law graduate first obtains the constancia de aspirante a notario and then competes in an examen de oposición for a vacant notaría. Both exams are held in Spanish before three sinodales and combine a practical drafting test with an oral theoretical test; the constancia requires 70 points and the oposición 80. This bank is an English-language MCQ study adaptation, not an official translation or format simulation. It is built on the Ley del Notariado del Estado de México, its Reglamento, the state Código Civil and the federal company, tax and anti-money-laundering rules notaries apply, keeps the Spanish legal terms, and does not simulate the drafting or oral tests. Its topic split is our own study allocation, because no official weights are published.

Assessment
Practical test: drafting one notarial instrument, without advice but with legislation available, on a topic drawn from six sealed topics (three official, three from the Colegio) for the aspirante exam or ten (five and five) for the oposición, within a maximum of three hours (extendable by the jury in the oposición). Theoretical test: oral questions from each sinodal on law related to the notarial function, private for the aspirante exam and public for the oposición. Each juror's oral score (0 to 100) is averaged, the practical test is scored 0 to 100 on form, substance and tax calculation, and the two results are averaged.

What are the requirements for the constancia de aspirante a notario?
Article 11 requires Mexican citizenship by birth and an age above 28; five years of uninterrupted residence in the State; five years of professional practice; one year of uninterrupted practice in an Estado de México notaría; the Colegio's aspirante course or a recognized equivalent; health and honorable conduct; no pending prosecution or conviction for an intentional crime; and no prior suspension or removal as a notary in the State.
How are the exams structured and graded?
Each exam has a practical test (drafting one instrument on a topic drawn from six sealed topics for aspirantes or ten for the oposición, within up to three hours) and an oral theoretical test. The three jurors' oral scores are averaged, the practical test is scored on form, substance and tax calculation, and the two results are averaged. The minimum is 70 for the constancia de aspirante and 80 for the oposición (Reglamento, Articles 24 to 27).
What happens if a candidate fails or ties?
A candidate who fails may not sit another exam for one calendar year, and the jury's result cannot be challenged (Reglamento, Article 27). If no one passes, the exam is declared desierto (Article 28). In a tie for the highest grade in an oposición, the Governor appoints the candidate who served as interim or provisional notary, or else the one with greater professional seniority (Article 21).
