About the Notario Sonora Exam

Independent practice for Sonora's notary exams by OpenExamPrep. Sonora replaced its 1996 statute with Ley 175 (Boletín Oficial, 6 February 2024). Candidates first pass an aspirante exam and then compete in an oposición for each vacant or new notaría. Both exams pair up to five hours of drafting with questioning by a five-member jury, and 80 points pass. This bank is an English-language MCQ study adaptation, not an official translation or format simulation. It is built on the 2024 statute, the state notarial arancel and federal company law, and it keeps the Spanish legal terms. Its topic split is our own study allocation, because no official weights are published.

Assessment

Aspirante exam (Articles 109–116): the applicant files with the Director General, the Consejo gives an opinion within ten business days (silence counts as favorable), and the Dirección sets the date. The applicant drafts an instrument on a topic drawn from ten sealed topics proposed by the jurors, with legislation and reference works, for up to five hours; each juror may then ask about the case or notarial practice. Each juror grades separately from 10 to 100; the average must reach 80. Oposición (Articles 117–123): when a notaría is vacant or created, the Dirección General publishes a call once in the Boletín Oficial; aspirantes apply within ten business days and get at least five business days' notice. The jury holds ten sealed topics from a bank suited to the demarcación; after up to five hours of drafting, jurors question candidates on law applied by notaries. The highest passing grade wins; if nobody reaches 80, the contest is void and a new call is issued. Failing or withdrawing bars a new exam for one year. Patentes issue within thirty business days.

Notario Sonora: Suggested Study Strategy

1Study the 2024 law, not the 1996 one: 400-folio books issued by the Dirección General, a 60-business-day 'no pasó' period, and a five-member jury chaired by the Director General.
2Memorize the deadlines: protesta and start within 30 business days each, will notices within 5 business days, power notices within 5 business days, and 20 years' custody of books.
3Know the exam mechanics: ten sealed topics, up to five hours, individual 10–100 grades averaged to 80, and a one-year wait after failing.
4Practise the arancel: the highest of price, commercial or fiscal value; half fees for preparatory contracts; 50% for additional acts; fees always in pesos.

Frequently Asked Questions

Which Sonora notary law applies now?

Ley 175, the Ley del Notariado para el Estado de Sonora published in the Boletín Oficial on 6 February 2024, in force 60 natural days later. It abrogated the 1996 Ley 163, so older study materials describe rules that no longer apply, such as its folio, exam and sanction provisions.

Who can sit the aspirante exam?

Mexicans by birth aged 25 when applying, with a registered law degree, residence in Sonora and good conduct, who are not listed as defaulting maintenance debtors and meet the other Article 104 requirements. Officials appointed by the Governor must wait a period similar to their time in office before seeking a patente (Article 105).

How are the exams graded, and what happens after failing?

Each of the five jurors grades separately on a 10–100 scale, and the average must reach 80. In the oposición, the highest passing grade wins; if nobody passes, the contest is void and a new call is issued. Failing, withdrawing or not appearing without cause bars a new exam for one year (Articles 114, 116, 120 and 121).

Is the exam available in English, and what does this bank cover?

No. Both exams are held in Spanish. This bank is an independent English-language MCQ study adaptation, not an official translation or format simulation. It keeps the Spanish legal terms and reviews the statute and fee rules behind the drafting and questioning.
