1Under Article 1 of the Ley del Notariado del Estado de Coahuila, who grants the fíat that delegates the notarial function?
A.The Governor, by executive decree alone
B.The Tribunal Superior de Justicia
C.The Congreso del Estado
D.The Colegio de Notarios, after the selection exam, by a resolution of its assembly
Explanation: Article 1 makes the notariado in Coahuila a public-order function in charge of the Executive, entrusted by delegation to law professionals by virtue of the fíat the Congreso del Estado grants. Article 100 has the Executive send the file, with its opinion, to the Congreso, which issues the decree granting the fíat.
2How long does a Coahuila notary's appointment last under Article 3?
A.For life (vitalicia), removable only as the law provides
B.Twenty-three years, renewable once
C.Six years
D.Until age seventy, after which the Consejo reviews fitness every year
Explanation: Article 3 declares the notary's function vitalicia: those who exercise it legally may be removed only in the cases and with the formalities the laws, especially this one, set.
3A Coahuila notary's first cousin (fourth-degree collateral relative) is the buyer in a sale. Under Article 4, fraction II, must the notary refuse?
A.Yes, all collateral relatives up to the fourth degree are covered
B.Yes, unless a second notary co-signs
C.No, the notary must act to avoid denying the service
D.No: Coahuila's bar reaches collateral relatives only up to the second degree
Explanation: Article 4-II obliges the notary to refuse when the parties include the spouse, blood or affinity relatives in the direct line without limit, or collateral relatives up to the second degree inclusive. A first cousin (fourth degree) is outside Coahuila's rule, unlike states such as Nuevo León or Chihuahua that reach the fourth degree.
4A company whose attorney-in-fact is the notary's wife asks a Coahuila notary to formalize a purchase. What does Article 4, fraction III, provide?
A.The notary may act, since the wife is not a party
B.It must refuse: the act concerns someone the wife represents
C.The notary may act if the company's board approves
D.The notary must refuse only if the price exceeds 365 times the minimum wage
Explanation: Article 4-III obliges the notary to refuse if the act concerns the notary, their spouse, the covered relatives, or persons for whom any of them is attorney-in-fact or legal representative in that act. Article 19 makes an instrument authorized in breach of Article 4 null.
5A Coahuila notary previously acted as lawyer in the lawsuit from which a settlement arises. May they now formalize the settlement under Article 4?
A.Yes, since they know the case best
B.Yes, if the other side consents
C.No, they must refuse (fraction IV)
D.Yes, if they stopped representing the client at least a year earlier and the court approved it
Explanation: Article 4-IV obliges the notary to refuse when they acted as lawyer for the parties in the judicial matter from which the document or act arises.
6Which is a ground on which a Coahuila notary may refuse to act under Article 5?
A.Being busy with another notarial act
B.Disliking the client's profession
C.The client being from another district
D.The act being worth less than 100 times the UMA, if the notary's fees would not cover the costs
Explanation: Article 5 lets the notary refuse when busy with another notarial act, ill, on holidays or outside office hours, when expenses and fees are not advanced (except the will of a gravely ill person), when acting endangers their life, health or interests, or in contested matters where they would be an objectionable witness.
7A Coahuila notary is elected state deputy. Under Article 6 (reformed 29 December 2017), is the post incompatible?
A.Yes, every public post is incompatible
B.No: elected posts are allowed, except President, Governor or Municipal President
C.Yes, unless the Congreso authorizes it
D.No, but only if the notary closes the protocolo and gives up fees during the term
Explanation: Article 6 makes the function incompatible with posts in the three branches, federal and state bodies, autonomous bodies, municipalities and dependent private employment. It excepts teaching, charitable and elected posts, unless the elected post is President of the Republic, Governor or Municipal President.
8A Saltillo notary formalizes a mortgage on land in their own district, but the borrower is in Monterrey. What does Article 7 allow?
A.Signing the escritura only in the notaría
B.Having a Nuevo León notary collect the signature
C.Personally collecting the signature outside the district, recording that fact
D.Sending the escritura by courier for signature, with a video call as proof of identity
Explanation: Article 7 has the notary reside and act only within their district, although acts may refer to any place. For acts creating, modifying or extinguishing real rights over property in their own district, the notary may personally, under strict responsibility, collect the parties' signatures outside the district, recording this in the instrument.
9Under Article 9, fraction III, may a Coahuila notary practice as a lawyer?
A.Never
B.Only in criminal matters
C.Yes, in any matter
D.Yes, in matters in which they did not intervene as notary
Explanation: Article 9-III lets the notary act as arbitrator, secretary or actuario in arbitration, hold judicial mandates and practice as a lawyer in matters in which they did not intervene as notary.
10What must a Coahuila notary give users before providing a service under Article 9, fraction XV?
A.A detailed budget of taxes, fees and charges, and the estimated completion time
B.A copy of the Colegio's statutes
C.A written waiver of liability
D.A certificate that the notary's guarantee deposit is current, stamped by the Tesorería
Explanation: Article 9-XV (reformed 11 July 2014) obliges notaries to give users a detailed budget of the taxes, fees and charges the act will cause under federal, state and municipal tax laws and the current Arancel, and to report the estimated time to complete the procedure.

About the Notario Coahuila Exam

Independent practice for Coahuila's notary exams by OpenExamPrep. Under the Ley del Notariado del Estado de Coahuila (current text, last reformed on 29 December 2017), law graduates with three years of practice and a year in a notaría take the aspirante exam before a four-member jury; when a notaría falls vacant or is created, the Executive selects patented aspirantes for a selection exam, and the Congreso grants the winner a lifelong fíat by decree. This bank is an English-language MCQ study adaptation, not an official translation or format simulation. It is built on the state statute and on federal company and tax rules, keeps the Spanish legal terms, and does not simulate the drafting exercises or the oral questioning. Its topic split is our own study allocation, because no official weights are published.

Notario Coahuila: Suggested Study Strategy

1Keep the two exams apart: 15 topics, five hours and a majority vote for aspirantes; 10 topics, six hours and 1–10 grades for the selection exam.

4Review the 2017 reforms: the four-member jury, notarial voluntary divorce, organ-donation actas and the Notario Adjunto regime.

Frequently Asked Questions

How do I become an aspirante a notario in Coahuila?

Meet Article 76 (Mexican by birth, registered law title, three years of practice as a lawyer, a year in a notaría, good conduct and other conditions), prove the personal requirements with seven witnesses before a civil judge, and apply to the Executive. The exam is in the State capital: you draft an instrument on one of 15 sealed topics in five hours and answer the jurors' questions; the jury decides by majority.

How is a notaría awarded?

When a notaría is vacant or created, the Executive reviews the list of patented aspirantes and calls those selected to a selection exam with 15 business days' notice. The highest 1–10 marks in the practical and theoretical exercises win; the Executive then sends the file to the Congreso, which grants the fíat by decree, and the Executive assigns the district and number.

What is a Notario Adjunto?

When a notario de número takes a licence for an incompatible post, illness or postgraduate studies, they may propose a Notario Adjunto, who must pass a theory-practice exam and then acts in the titular's protocolo, with the titular jointly liable. An adjunto with at least three years in the post may seek the titularity if the titular dies or resigns (Articles 118 B–119).

Is the exam available in English, and what does this bank cover?

No. The exams are held in Spanish. This bank is an independent English-language MCQ study adaptation that keeps the Spanish legal terms. It reviews the rules behind the drafting exercises and the jury's questions, but it is not an official translation and does not simulate them.
