2.3 Two-Year Renewal and Reinstatement

Key Takeaways

  • A nail technician license expires two years from the last day of the month in which it was issued (18VAC41-20-160).
  • On-time nail technician renewal is $120; after a 30-day grace period, reinstatement is $240, which includes the $120 renewal fee and a $120 reinstatement fee (18VAC41-20-140).
  • After two years following the expiration date, reinstatement is no longer possible; a former licensee applies as a new applicant, and a person previously licensed in Virginia for at least three years must pass the required examination (18VAC41-20-180).
  • The date DPOR or its agent receives the fee, not the postmark, controls whether renewal or reinstatement still applies, and failure to receive a renewal notice does not excuse the obligation to renew (18VAC41-20-170 and 18VAC41-20-180 D).
  • 18VAC41-20 does not publish a continuing-education hour requirement for nail technician renewal.

2.3 Two-Year Renewal and Reinstatement

Quick Answer: The license expires two years from the last day of the month it was issued. Renew for $120 before that date (or within 30 days). After 30 days, reinstate for $240. After two years expired, reinstatement is gone: apply as a new applicant, and if you were licensed in Virginia at least three years, you must also pass the exam. No continuing-education hours are published in 18VAC41-20 for nail technician renewal.

18VAC41-20-10 distinguishes renewal (continuing effectiveness for another period) from reinstatement (restoring effectiveness after the expiration date has passed). The exam will punish anyone who treats those words as synonyms or who thinks “I never got the card” is a defense.

When the license actually dies

18VAC41-20-160 is one sentence: a license or certificate issued under this chapter expires two years from the last day of the month in which it was issued. The Board does not use the anniversary of the issue day.

Worked example A. Issued March 12, 2026 → last day of the issue month is March 31 → expiration is March 31, 2028, not March 12, 2028 and not March 12, 2027.

Worked example B. Issued June 1, 2025 → expires June 30, 2027. The 30-day window after expiration runs through July 30, 2027. A fee DPOR receives on July 31, 2027 is already in reinstatement territory.

DPOR will send a renewal notice outlining procedures (18VAC41-20-170), but failure to receive this notice does not relieve the licensee of the obligation to renew. DPOR’s FAQ repeats the same rule and adds the operational fix: send the renewal fee, payable to the Treasurer of Virginia, with the license number on the check, and use an address-change form if the file is stale. You cannot continue to practice in Virginia after the license has expired.

Fees, grace, and the $240 math

18VAC41-20-140 sets individual nail technician amounts. All listed fees are nonrefundable and will not be prorated.

EventAmountWhen it applies
Application (including license by endorsement)$120With the application
Nail technician renewal$120With the renewal card prior to the expiration date
Individual reinstatement$240$120 renewal + $120 reinstatement, with the reinstatement application
Instructor certificate renewal (not the nail license itself)$45Separate credential
Facility (salon) application or renewal$220Firm license, Section 2.4
Facility reinstatement$440$220 + $220

18VAC41-20-180 A. When an individual fails to renew within 30 days following the expiration date, the person who intends to remain licensed must pay the reinstatement fee. DPOR’s FAQ is explicit that staff cannot waive that fee, even if the payment is “one day late” after a history of on-time renewals, because the regulations already built in a 30-day grace. After that grace, $240 is the published individual amount.

Technology fee. DPOR’s Board notice states that effective July 1, 2026, certain fees include a separate Technology Fee of $7.25 per year, pursuant to 2026 House Bill 30, remaining in place through June 30, 2030, solely to upgrade or replace DPOR’s software system. Treat it as a published add-on on certain fees for that window. Do not rewrite the 18VAC41-20-140 table as if every line had already been restated; read the current DPOR fee notice when you pay.

The two-year drop-off and the three-year exam rule

18VAC41-20-180 B. When an individual fails to renew within two years following the expiration date, reinstatement is no longer possible. To resume practice:

  1. The former licensee must apply as a new applicant and meet all current entry requirements.
  2. An individual previously licensed in Virginia for a minimum of three years must submit a new application and pass the required examination.

That second sentence is a trap for experienced technicians who assume seniority waives NIC. After a two-year lapse, Virginia does the opposite for people with at least three years of prior Virginia licensure: the regulation names the exam as part of the return ticket.

Worked example C. License expired April 30, 2026. Reinstatement remains possible through April 30, 2028 (two years following expiration), subject to the $240 fee and a current reinstatement filing. On May 1, 2028, reinstatement is gone. If that technician had been licensed in Virginia for five years before the lapse, 180 B 2 requires a new application and the examination.

Receipt date, new expiration, and “continuously licensed”

18VAC41-20-180 D. The date a renewal fee is received by DPOR or its agent is used to decide whether reinstatement applies. DPOR’s FAQ uses the same rule for applications and renewals: receipt in the agency, not the postmark, controls. A check mailed on the last day of the grace period that arrives after the window has closed is a reinstatement problem, not a debate with the postal service.

18VAC41-20-180 E. When a license is reinstated, the holder is assigned an expiration date two years from the date of the last day of the month of reinstatement. Reinstatement does not glue the old card back on the old cycle.

Worked example D. Original expiration January 31, 2026. The technician reinstates when DPOR receives the $240 filing on August 15, 2026. New expiration: August 31, 2028 (two years from the last day of the reinstatement month).

18VAC41-20-180 F. A person who reinstates is regarded as having been continuously licensed without interruption and therefore remains subject to the Board for activities performed prior to reinstatement. You cannot wash out a sanitation case by letting the card lapse and then paying $240.

18VAC41-20-180 G. A person who fails to reinstate is regarded as unlicensed from the expiration date forward. The Board still keeps authority to discipline for violations that occurred while the person was licensed. Practicing during the gap is unlicensed practice, which 18VAC41-20-280 can reach on the salon’s responsible management as well as on the individual.

Continuing education is not a published nail technician renewal requirement

Read 18VAC41-20 Parts III and IV as they are written. The renewal and reinstatement sections set dates, fees, receipt, and re-examination after a long lapse. They do not state a clock-hour continuing-education requirement for nail technician renewal. For this exam, say what the chapter says: CE hours are not published as a requirement for renewing a Virginia nail technician license. Do not import another state’s 8-hour or 16-hour CE rule, and do not confuse instructor certificates, school duties, or NIC practical retakes with a CE mandate that 18VAC41-20 does not print.

Active-duty relief under § 54.1-117 (license held not expired during qualifying service outside the United States plus 60 days, capped at five years, including an accompanying spouse) can pause an expiration. That statute is a military overlay, not a general “I was busy” excuse, and it does not create CE hours either.

Sequence to memorize

  1. Issue month → expiration = last day of that month, two years later.
  2. Through expiration → $120 renewal (plus any currently published technology add-on on certain fees).
  3. Days 1–30 after expiration → still described as the window before reinstatement is required; DPOR treats this as grace, and you still may not practice on an expired card.
  4. After 30 days, until two years after expiration$240 reinstatement; new two-year term from the last day of the reinstatement month.
  5. After two years expiredno reinstatement; new application; if previously licensed in Virginia ≥3 years, new application + exam.
  6. No published CE hours for nail technician renewal in 18VAC41-20.
  7. Receipt date rules; missing notice does not excuse.
