Read the statute and regulation together

Scope is a legal question about the actual service, not merely the product name or advertised benefit. Virginia Code 54.1-700 defines esthetics as listed cosmetic services without laser technology and excludes the healing arts. It defines a master esthetician as a licensed esthetician additionally authorized for specified advanced services, including lymphatic drainage, chemical exfoliation with specified limitations on controlled substances, and microdermabrasion of the epidermis.

Section 250 of the esthetics regulations lists permitted exfoliating agents for licensed master estheticians. It should not be quoted as a comprehensive rule declaring that every possible device or hand procedure is legal whenever it stays above a certain skin line. The statute, regulation, device's intended function, and any medical-authority provisions must all be considered.

Authorized exfoliating agents

The current section lists Jessner's and modified Jessner's solutions; TCA at concentrations less than 20%; nonprescriptive alpha- and beta-hydroxy acids; nonprescriptive commercially available products used according to manufacturer instructions; vitamin-based peels; enzymes; and herbal exfoliators. The less-than sign matters. A product labeled 20% TCA does not satisfy the TCA concentration provision; neither does 25%.

A 19% product meets that concentration condition, but this alone does not prove that it is suitable for a particular client or any layering sequence. pH, vehicle, amount, coats, timing, preparation, other procedures, and barrier condition can change exposure. Do not interpret the legal threshold as proof that 19% can never injure dermis or that 20% always reaches precisely the same layer.

Mechanical and lymphatic additions

Microdermabrasion of the epidermis is within the statutory master addition. Intentionally performing surgical dermabrasion or producing tissue injury is not made acceptable by renaming it advanced exfoliation. Unexpected bleeding requires stopping and an appropriate response, rather than continuing toward a desired resurfacing endpoint. However, a droplet of blood alone does not establish the exact histological depth of every injury.

Lymphatic drainage is also a master addition. Cosmetic use must be distinguished from independently diagnosing or managing medical edema. A medical lymphedema patient may need specialist treatment and coordination. Device-assisted methods need the same attention to intended use, training, and medical boundaries as manual methods.

Laser hair removal has a separate statute

Code 54.1-2973.1 specifies that laser hair removal is provided by a properly trained doctor of medicine or osteopathic medicine, physician assistant, advanced practice registered nurse, or a properly trained person under the direction and supervision described there. The listed medical professionals may delegate under the cited statutory provision. It is inaccurate to reduce the rule to physician-only direction or to imply that the master license itself licenses laser operation.

The hair-removal statute also cannot be generalized to every laser resurfacing, IPL, RF, or ultrasound application. Some devices are intended to change tissue structure or treat disease. Establish the actual legal authority for the service with the appropriate regulator and responsible licensed professional. A medical spa sign does not provide that authority.

Needling, injections, and cutting

The NIC theory outline includes awareness of microneedling and regenerative therapies. FDA explains that microneedling intended to change tissue structure or function may be a medical procedure. RF microneedling is described by FDA as medical and has serious reported risks. Do not independently provide medical needling, injections, PRP preparation, or surgical tissue removal on the basis of a master-esthetics credential.

At the same time, avoid inventing quotations from section 250 claiming that it expressly lists every blade number, every dermal roller, or every device prohibition. The current text does not contain those comprehensive lists. A short blunt cosmetic roller, a medical needling pen, and a surgical cutting instrument have different intended actions; each needs an accurate authority assessment rather than a blanket rule derived from a marketing term.

Apply the boundary to a request

A client requests a 25% TCA peel followed by injected filler. The TCA request fails the explicit less-than-20% provision, and filler injection does not become esthetics because it improves appearance. Decline those services under the standalone master license and refer appropriately. Do not automatically substitute a 15% peel: first assess suitability and the product's instructions.

A note saying cleared for a facial establishes neither permission to use a medical laser nor authority to prescribe an antiviral. Medical advice may inform client selection, while the law determines professional scope and the manufacturer determines compatible operation. Keep those three questions separate in scenarios, records, and examination answers.
