1.6 Salon, School & Booth Licensure, Scope of Practice and Grounds for Discipline

A Virginia cosmetology licence authorises you. It does not authorise the business. Confusing the two is the most common compliance failure among newly licensed stylists who go independent, and the Virginia state-law items on the exam test the distinction directly.


Salon and shop licensure — § 54.1-704.1 and 18VAC41-20-120

Any firm wishing to operate a barbershop, cosmetology salon, nail salon, or waxing salon — including any mobile shop or salon — must obtain a shop or salon licence. The qualifications mirror the individual ones:

  1. The applicant and all members of the responsible management must be in good standing as a licensed shop or salon in Virginia and every other jurisdiction, with copies of any disciplinary action supplied at application.
  2. Disclose a physical address; a post office box may be a secondary address only. A mobile shop or salon must give the physical address where it is permanently garaged.
  3. Sign a statement certifying the applicant has read and understands the Virginia laws and 18VAC41-20.
  4. Disclose all felony convictions within 10 years for the firm and all members of its responsible management, per § 54.1-204.
  5. Disclose the firm's responsible management.

Facility fees under 18VAC41-20-140 are $220 application, $220 renewal, $440 reinstatement.

The rules that void a salon licence

When the licence is voided, the firm must notify the Board, apply for a new licence within 30 days of the entity change, and destroy the old licence. Salon licences are not transferable; buying the salon next door does not buy its licence.

Booth renters. Virginia's Board for Barbers and Cosmetology issues no "independent contractor" or "booth renter" licence — that category does not exist in 18VAC41-20-140's fee schedule or anywhere in the chapter. The controlling question is whether a firm is operating a salon. A stylist who rents a chair and practises inside a salon licensed to someone else works under that firm's licence and its responsible management. A stylist who forms their own business entity and operates a salon must hold a salon licence in that firm's name, and 18VAC41-20-260 C requires every licensee to operate under the name in which the licence was issued.


School licensure — 18VAC41-20-130, -200 through -250

Schools are licensed separately ($250 application, $250 renewal, $500 reinstatement, plus $120 to add a programme). A school submits a curriculum package with a syllabus, detailed content outline, course texts, five sample lesson plans, evaluation methods, days and hours of instruction, programme length, a sample final transcript, an hour-and-performance breakdown, and a sample test of at least 25 questions with an answer key.

Letting a school licence lapse escalates far faster than an individual licence:

One protective rule: no student is disqualified from testing because the school was unlicensed for part of their attendance, if the school's licence is reinstated.

Transfer credit (18VAC41-20-210 H): a licensed school may assess a transfer student's competence and award credit toward hours and performances, based on a transcript review, documentation from the prior school, and a competency examination administered by the school. Credit must not exceed the verified hours on the transcript or the hours in the board-approved curriculum for that topic. Failing to comply with this rule is an explicit ground for discipline under 18VAC41-20-280 (2).

Scope of practice

18VAC41-20-260 B places the duty on responsible management to ensure that no employee, licensee, student, or apprentice performs any service beyond the scope of practice for the applicable licence. Subsection D gives the concrete case: unless also licensed as a cosmetologist, a barber or master barber must hold a separate nail technician or wax technician licence to perform nail care or waxing.

The 17 grounds for discipline — 18VAC41-20-280

The Board may refuse to issue, renew, or reinstate; impose a monetary penalty; place on probation; suspend; or revoke, if it finds the licensee, certificate holder, temporary licence holder, or applicant:

  1. Is incompetent or negligent in practice, or unable through a mental or physical condition to practise or operate a facility skilfully and safely;
  2. Is convicted of fraud or deceit in practice or teaching, fails to teach the board-approved curriculum, or violates the transfer-credit rule in 18VAC41-20-210 H;
  3. Obtained or renewed a licence by false or fraudulent representation;
  4. Violates, induces others to violate, or cooperates in violating the chapter, Chapter 7 of Title 54.1, or any local health and sanitation ordinance;
  5. Offers anything of value to a federal, state, or local employee to influence their duties;
  6. Fails to respond to the Board or its agents, or gives false, misleading, or incomplete information;
  7. Fails or refuses to allow inspection during reasonable hours;
  8. Fails to produce a requested document, book, or record;
  9. Fails to notify the Board of a change of name or address in writing within 30 days, for every licence held;
  10. Makes a misrepresentation or publishes false, deceptive, or misleading advertising;
  11. Fails to notify the Board in writing within 30 days of final or disciplinary action taken against any licence in any jurisdiction;
  12. Has been convicted or found guilty of any felony, subject to § 54.1-204 review;
  13. Fails to inform the Board in writing within 30 days of pleading guilty or nolo contendere to, or being convicted of, such an offence;
  14. As responsible management of a salon, allows an unlicensed person to practise unless duly enrolled as a registered apprentice;
  15. As responsible management of a school, allows a person without an instructor certificate or student instructor temporary licence to instruct;
  16. Fails to take sufficient measures to prevent transmission of communicable or infectious diseases or to comply with sanitary requirements; or
  17. Fails to comply with examination conduct procedures established by the Board and the testing service.

Grounds 9, 11, and 13 share the same trigger — written notice to the Board within 30 days — and they catch honest practitioners far more often than the dramatic grounds do. Ground 14 is the reason a salon owner cannot shrug off an employee's expired licence: the owner is disciplined for it.
