Licence Categories & When Oregon Requires a Licence
Why this is on the exam: Passing Laws and Safety alone earns you nothing — ODA requires at least one category exam as well (the one current exception being the marine fouling organism category). Items in this area either name a job and ask for the category, or describe an activity and ask whether a licence is needed at all.
1. When Licensing IS Required
You need an Oregon pesticide licence when you are:
- Buying, applying or supervising the use of restricted-use pesticides, or advising others on RUPs;
- Applying pesticides to someone else's property — private or public land — outside the narrow exceptions in ORS 634.106;
- Applying pesticides as a public employee using machine-powered equipment and/or applying RUPs;
- Applying pesticides on school campuses;
- Applying certain pesticides — paraquat is the manual's example — that may only be applied by certified and licensed applicators;
- Applying any pesticide by aircraft, including fixed-wing, helicopter and unmanned aircraft systems;
- Applying unregistered pesticides for research under an Experimental Use Permit;
- Selling or distributing RUPs (a licence is required for each facility);
- Owning or operating a business, non-profit or organisation that advertises pesticide application services or whose employees must be licensed Commercial Pesticide Applicators.
2. When Licensing Is NOT Required
- Applying general-use pesticides to property owned by you or your employer. (A non-certified person applying RUPs must be supervised by a certified and licensed applicator and must have received handler training.)
- Public employees applying general-use pesticides with non-powered equipment — except on school properties.
- Advising others on general-use pesticides.
- Applying pesticides as part of landscape maintenance under very specific and limited conditions.

The two-part test. Almost every Oregon licensing item reduces to two questions: Is the product restricted-use? and Whose property is being treated? A grower applying a general-use herbicide to their own field needs nothing. The same grower applying an RUP to that field needs a Private licence. The same grower applying anything to the neighbour's field for hire needs a Commercial licence and an employing Operator.

Two licence-scope limits worth memorising. Agriculture – Soil Fumigation II is limited to Commercial and Public Pesticide Applicator licences. The Regulatory Weed exam is limited to the Public Pesticide Applicator licence. And within a Noncommercial Pesticide Applicator licence, the agriculture, forest and school IPM categories are available only to applicators employed by a private school.
4. The Oregon IPM in Schools Law (ORS 634.700–634.750)
Oregon requires public and private K-12 schools, community colleges and the other listed institutions to adopt and follow an integrated pest management plan, with a designated IPM plan coordinator. Applications on those campuses must be made by a licensed applicator holding the appropriate category — and the statute is why a Commercial or Public licence is needed even for general-use and 25(b) organic products on school property.
The law also governs notification and posting (ORS 634.740: written notice to staff and parents, warning signs), reentry (ORS 634.730, with a pest-emergency exception declared by the school), the low-impact pesticide concept (ORS 634.725), and a distinct four-year record retention period (ORS 634.750).
