1.4 WPS: Covered Establishments, Notification & Training
Key Takeaways
- The WPS covers agricultural workers, who perform hand labour in treated areas, and pesticide handlers, who mix, load, apply, or clean equipment and PPE.
- Workers and handlers must be trained before beginning work and retrained annually using EPA-approved materials from a qualified trainer.
- The central location must display the pesticide safety information, the application information and the safety data sheet for products applied.
- Application information and SDSs stay posted through the REI and for 30 days after it expires, and are retained for two years after REI expiration.
- WPS duties apply to both general-use and restricted-use pesticides applied on a covered agricultural establishment.
WPS: Covered Establishments, Notification & Training
Why this matters: The Worker Protection Standard is the federal rule that reaches furthest into day-to-day agricultural work, and ODA enforces parts of it in Oregon. Start with who is covered, how workers and handlers differ, and what has to be posted at the central location before anyone sets foot in a treated field.
1. Worker Protection Standard (WPS, 40 CFR Part 170)
The Worker Protection Standard (WPS) is a federal regulation issued by the EPA under FIFRA to reduce the risk of pesticide poisonings and injuries among agricultural workers and pesticide handlers in farms, forests, nurseries, and greenhouses.

Core Agricultural Employer Duties under WPS
Agricultural employers carry strict legal responsibilities under 40 CFR Part 170. Compliance is enforced rigorously by the Oregon Department of Agriculture (ODA) and Oregon OSHA.
┌────────────────────────────────────────────────────────────────────────┐
│ THE 3 PILLARS OF WPS COMPLIANCE │
│ │
│ 1. INFORMATION: │
│ • Central Notification Site with safety poster, SDS, and logs │
│ • Oral and posted application notifications │
│ • EPA-approved annual safety training for workers and handlers │
│ │
│ 2. PROTECTION: │
│ • Exclusion of unauthorized persons during applications (AEZ) │
│ • Enforcement of Restricted-Entry Intervals (REI) │
│ • Mandatory employer-provided PPE that is clean and inspected │
│ • Medical evaluation and fit-testing for tight-fitting respirators │
│ │
│ 3. MITIGATION: │
│ • Decontamination supplies within 1/4 mile of all work areas │
│ • Dedicated continuous-flow emergency eyewash stations │
│ • Prompt emergency transportation to an medical facility │
└────────────────────────────────────────────────────────────────────────┘
2. Statutory Foundations & Covered Agricultural Establishments
The Worker Protection Standard applies to any commercial establishment involved in the direct production of agricultural plants (crops, fruit, vegetables, grain, timber, cut flowers, nursery ornamentals, turfgrass seed):
┌────────────────────────────────────────────────────────────────────────┐
│ COVERED AGRICULTURAL ESTABLISHMENTS │
│ │
│ 1. FARMS: Open-field crop production (row crops, berries, orchards, │
│ grain, hay, vineyards, pasture, hops, seed production). │
│ │
│ 2. FORESTS: Commercial timber plantations, silviculture tracts, │
│ forest tree nurseries, Christmas tree plantations. │
│ │
│ 3. NURSERIES: Wholesale and retail ornamental plant production, │
│ container yards, field-grown shade trees, sod farms. │
│ │
│ 4. ENCLOSED SPACE PRODUCTION: Greenhouses, glasshouses, shadehouses, │
│ poly-tunnels, hoop houses, indoor mushroom production facilities. │
└────────────────────────────────────────────────────────────────────────┘
Covered Employers
- Agricultural Employers: Farm owners, agricultural business operators, timber company managers, nursery owners, or agricultural labor contractors who employ workers or handlers on agricultural establishments.
- Commercial Pesticide Handler Employers: Independent commercial applicators, aerial custom applicators, or ag-chemical custom spray companies hired by agricultural growers to apply pesticides or service application equipment.
3. Dual Occupational Classifications & Minimum Age Standards
WPS establishes two distinct occupational groups with differing legal protections, training requirements, and operational duties.
┌────────────────────────────────────────────────────────────────────────┐
│ WPS OCCUPATIONAL CLASSIFICATIONS │
│ │
│ 1. AGRICULTURAL WORKER: │
│ • Any individual employed for compensation who performs hand-labor │
│ tasks in fields, forests, nurseries, or enclosed spaces treated │
│ with pesticides or under an active Restricted-Entry Interval. │
│ • Tasks: Harvesting, picking, hand-weeding, pruning, thinning, │
│ transplanting, suckering, hand-tying, operating irrigation lines.│
│ │
│ 2. PESTICIDE HANDLER: │
│ • Any individual employed for compensation who directly interacts │
│ with pesticides, application equipment, or un-rinsed containers. │
│ • Tasks: Mixing, loading, transferring, applying, flagging for │
│ aircraft, cleaning/repairing spray rigs, clearing clogged tips, │
│ cleaning contaminated PPE, handling un-rinsed empty containers, │
│ or entering treated areas during application or before REI ends. │
└────────────────────────────────────────────────────────────────────────┘
Mandatory Minimum Age Requirements
Under WPS regulations:
- Pesticide Handlers: Must be at least 18 years of age. No person under age 18 may mix, load, apply, flag, or handle open pesticide containers under any commercial circumstances.
- Early-Entry Workers: Any agricultural worker authorized to enter a treated area under a Restricted-Entry Interval (REI) to perform permitted early-entry tasks must be at least 18 years of age.
- Family Farm Exemption: The minimum age and certain administrative requirements are exempt strictly for immediate family members (spouses, parents, children, siblings) on wholly family-owned agricultural establishments. However, non-family hired employees are fully protected.
EPA-Approved Annual Safety Training
- Frequency: Training must be provided annually (every 12 months). The historical 5-year grace period was abolished under modernized WPS rules.
- Timing: Agricultural workers must receive EPA-approved worker training before entering any treated area where a pesticide has been applied or an REI has expired within the last 30 days. Handlers must be trained before performing any handling activity.
- Qualifications: Trainers must be certified applicators (Private or Commercial), state-designated WPS trainers, or individuals who completed an EPA-approved Train-the-Trainer course.
- Language & Materials: Training must be presented in a language understood by the employees, using EPA-approved training materials, manuals, or videos.
- Recordkeeping: Training verification logs (employee signature, date, trainer name, EPA approval number) must be retained by the employer for two (2) years.
4. Central Notification Site Architecture & Recordkeeping
Every agricultural employer must establish and maintain an unobstructed, easily accessible Central Notification Site located in an area where workers and handlers naturally congregate (e.g., main office, break room, primary assembly pad, central packing shed).
┌────────────────────────────────────────────────────────────────────────┐
│ THE 3 MANDATORY CENTRAL NOTIFICATION SITE ELEMENTS │
│ │
│ [ELEMENT 1] ──► OFFICIAL EPA WPS SAFETY POSTER │
│ Must display all 10 EPA safety concepts; must have │
│ current establishment name, address, and nearest │
│ emergency medical facility name/address/phone filled. │
│ │
│ [ELEMENT 2] ──► SAFETY DATA SHEETS (SDS) │
│ Complete 16-section SDS for EVERY pesticide product │
│ applied on the establishment within the past 30 days. │
│ │
│ [ELEMENT 3] ──► PESTICIDE APPLICATION INFORMATION LOG │
│ Detailed application log posted before spraying begins│
│ and kept posted continuously for 30 days post-REI. │
└────────────────────────────────────────────────────────────────────────┘
Required Fields on the Pesticide Application Information Log
The application log posted at the Central Notification Site must contain the following six specific legal data points:
- Location and Description of the Treated Area: Specific field name, block number, GPS coordinates, or visual map designating the treated boundary.
- Product Trade Name: The commercial brand name as printed on the EPA label.
- EPA Registration Number: The complete federal registration number (e.g.,
EPA Reg. No. 12345-678). - Active Ingredient(s): The generic chemical common name(s) of all active ingredients in the product.
- Application Timing: Exact date, application start time, and application completion/stop time.
- Restricted-Entry Interval (REI): Total duration of the REI (hours/days) and the exact expiration timestamp (e.g., "Expires August 17 at 10:00 AM").

│ begins (or immediately at the start of application if workers are │
│ not on site). │
│ │
│ 2. ACTIVE 30-DAY POST-REI POSTING: │
│ Application info and SDS must remain continuously posted at the │
│ Central Notification Site for at least THIRTY (30) DAYS following │
│ the expiration of the Restricted-Entry Interval. │
│ │
│ 3. ARCHIVAL RETENTION: │
│ After removal from the central board, the agricultural employer │
│ must archive all application logs and SDS in office records for: │
│ • TWO (2) YEARS federally under EPA WPS (40 CFR 170.311); │
│ • THREE (3) YEARS in Oregon under OAR 603-057 and Oregon OSHA! │
│ │
│ 4. IMMEDIATE ACCESS RIGHTS: │
│ Current employees, former employees treated, treating medical │
│ physicians, and designated worker representatives have the legal │
│ right to inspect and receive immediate copies upon request. │
└────────────────────────────────────────────────────────────────────────┘
An agricultural employer in Marion County completes an application of a fungicide with a 48-hour Restricted-Entry Interval (REI) on August 10 at 6:00 PM. Under WPS and Oregon law, how long must the application log and SDS remain posted at the Central Notification Site, and how long must the records be archived in office files?
