Restricted use pesticide (RUP): who may buy and apply one?
A product EPA classifies as restricted because it can cause harm to people or the environment even when used as directed. Only a certified applicator, or a noncertified applicator working under that person's direct supervision, may purchase or use it. The restricted use statement appears in a box at the top of the front panel and names the reason for the classification.
Private applicator vs. commercial applicator
A private applicator uses or supervises the use of RUPs to produce an agricultural commodity on land owned or rented by the applicator or the applicator's employer, or on another person's land when only trading personal services. Any other certified applicator - including anyone applying for hire - is a commercial applicator. Categories, exams, recordkeeping, and fees differ between the two.
How long does applicator certification last under federal rules?
Certification expires five years after issuance unless the applicator is recertified (40 CFR 171.107), and a certifying authority may set a shorter period. Recertification is either by passing an approved written examination again or by completing continuing education approved by the certifying authority, completed before the current certification expires.
Minimum age rules for private applicators and the people they supervise
A certified private applicator must be at least 18 (40 CFR 171.105(g)). A noncertified applicator using an RUP under direct supervision must also be 18, with one exception: a 16-year-old may work under a private applicator who is an immediate family member, provided the product is not a fumigant, sodium cyanide, or sodium fluoroacetate and the application is not aerial.
Two ways a state may establish private applicator competency
By a written examination meeting the standards in 40 CFR 171.103(a)(2), or by a certifying-authority-approved training program with no exam (40 CFR 171.105(h)). That is why exam length, time limit, cut score, and fees differ from state to state, and why some states certify private applicators through training alone.
Why is it said that "the label is the law"?
FIFRA makes it unlawful to use a registered pesticide in a manner inconsistent with its labeling, so the rate, site, PPE, restricted-entry interval, and preharvest interval are all legally enforceable. Mandatory wording ("Do not...", "Wear...") carries legal force; advisory wording ("should", "we recommend") is guidance. Read the label before you buy, before you mix, and again before you apply.
Label vs. labeling
The label is the printed material on or attached to the container. Labeling is broader: the label plus everything the registrant or its agent supplies with the product - supplemental labels, Section 24(c) special local need labels, booklets, and any manual the label references. All of it is legally binding, and 24(c) or emergency-exemption directions must be in your possession at the time of use.
EPA Registration Number vs. EPA Establishment Number
The registration number (for example 352-729) identifies the specific product EPA approved, and it is the number you enter in Bulletins Live! Two to look up endangered species use limits. The establishment number identifies the facility that produced or repackaged the product; it is used to trace a batch, not to identify the product.
Signal words and what they tell you about toxicity
DANGER with POISON and the skull and crossbones means Toxicity Category I by oral, dermal, or inhalation toxicity. DANGER alone means Category I on eye or skin irritation only. WARNING means Category II, and CAUTION means Category III (optional for Category IV). The signal word always reflects the product as sold, never the diluted spray solution.
Five things you may legally do that the label does not state
Apply at a rate lower than labeled; treat a pest not named on the label when the crop or site is listed and the label does not prohibit it; use an application method the label does not prohibit; tank-mix with another pesticide or a fertilizer unless prohibited; and wear more safety equipment than required. You may never exceed the labeled rate or treat a site that is not on the label.
REI, PHI, and the other waiting periods on a label
The restricted-entry interval controls how soon a person may enter the treated area. The preharvest interval controls how many days must pass between the last application and harvest, and it is what keeps residues under the legal tolerance. Labels may also set grazing, feeding, replant (plant-back), and irrigation intervals. Harvesting early is a residue violation even if the crop looks fine.
What the Worker Protection Standard covers
40 CFR Part 170 protects agricultural workers and pesticide handlers on farms, forests, nurseries, and greenhouses whenever a product bears the AGRICULTURAL USE REQUIREMENTS box. Workers perform hand labor in treated areas; handlers mix, load, apply, or clean application equipment. Owners of the establishment and their immediate family are exempt from some, but not all, provisions.
How does EPA set the minimum restricted-entry interval?
From the acute toxicity category of the active ingredient (40 CFR 156.208): 48 hours for Category I - extended to 72 hours for cholinesterase-inhibiting organophosphates applied outdoors where average annual rainfall is under 25 inches - then 24 hours for Category II and 12 hours for Category III or IV. A product-specific REI printed on the label always governs, and a tank mix takes the longest REI in the mix.
Application exclusion zone (AEZ)
The AEZ travels with the equipment during the application: 100 feet in all directions for aerial, air-blast, fumigant, smoke, mist, or fog applications and for sprays with droplets smaller than medium; 25 feet for medium-or-larger droplets sprayed from more than 12 inches above the ground. Only appropriately trained and equipped handlers involved in the application may be inside it.
WPS decontamination supplies: worker vs. handler
Workers get at least 1 gallon of water each, soap, and single-use towels. Handlers get at least 3 gallons each plus one clean change of clothing. Supplies sit together outside any treated or REI area and within 1/4 mile. A handler mixing or loading a product that requires protective eyewear also needs eye-flush water at the site: 6 gallons, or a system delivering 0.4 gallons per minute for 15 minutes.
Is there still a federal RUP recordkeeping rule for private applicators?
No. USDA removed 7 CFR Part 110 effective July 11, 2025, ending the federal 14-day recording and 2-year retention requirement for certified private applicators. State and tribal recordkeeping laws still apply and most mirror the old federal data elements, so keep records to your state's rule. Expect older manuals - and some state exams - to still teach the rescinded federal standard.
What the WPS requires you to record and display for each application
The safety data sheet plus the product name, EPA registration number, and active ingredient; the crop or site treated with the location and description of the treated area; the dates and times the application started and ended; and the REI. Post it within 24 hours of the end of the application, keep it displayed until 30 days after the REI expires, and retain it for 2 years after the REI ends.
LD50 and LC50 - and which direction means more toxic
LD50 is the single dose, in milligrams of pesticide per kilogram of body weight, that kills half of a test population; LC50 is the concentration in air or water that does the same. A LOWER number means a MORE toxic product. An oral LD50 of 50 mg/kg or less puts a product in Toxicity Category I; above 5,000 mg/kg is Category IV.
Routes of exposure, ranked by risk to applicators
Dermal exposure causes the most applicator poisonings because skin contact happens on every mixing and loading job; then inhalation, oral, and ocular. Absorption is not uniform across the body - the groin absorbs roughly eleven times more than the forearm, and the scalp, forehead, and ear canal absorb several times more, which is why splashes above the shoulders are so dangerous.
Acute toxicity vs. chronic toxicity
Acute toxicity is harm from a single or short-term exposure; it is what LD50 values, toxicity categories, and signal words measure. Chronic toxicity is harm from repeated low-level exposure over months or years - cancer, reproductive, or neurological effects. No signal word warns you about chronic risk, which is why routine PPE matters even on a CAUTION product.
Why leather, canvas, and cloth gloves and boots are never allowed
They absorb pesticide and hold it against the skin, turning one splash into hours of exposure, and they cannot be decontaminated. Use a chemical-resistant material named on the label - barrier laminate, butyl, nitrile, neoprene, natural rubber, PVC, or Viton. Keep glove cuffs outside your sleeves so runoff sheds away, but tuck sleeves into gloves when working overhead.
Cholinesterase-inhibitor poisoning: signs and first response
Organophosphates and carbamates cause headache, nausea, sweating, excess salivation, blurred vision, pinpoint pupils, muscle twitching, and in severe cases convulsions. Move the person from exposure, remove contaminated clothing, wash the skin, and get medical help with the label in hand. Atropine is the standard antidote; 2-PAM is used for organophosphates but not for carbamates. Poison Control: 1-800-222-1222.
Pesticide storage requirements that show up on the exam
Store products in their original labeled containers in a locked, dry, well-ventilated, posted room that is separate from food, feed, seed, and PPE, with an impervious floor and no floor drain. Keep herbicides apart from insecticides and fungicides to prevent cross-contamination, maintain a current inventory, and give the local fire department the inventory and the location.
How to triple rinse an empty container
Fill the empty container about one-fifth full of water, close it, shake or roll it so water reaches every interior surface, then drain into the spray tank for 30 seconds. Repeat three times, or pressure-rinse for at least 30 seconds. The rinsate becomes make-up water in the tank; then puncture the container so it cannot be reused and recycle it if a container program is available.
The three C's of spill response
Control the source - stop the leak, upright the container, put on PPE. Contain the spill - dike it with soil, absorbent clay, or sawdust, and never hose it down or let it reach a drain or ditch. Clean up - absorb, sweep into a labeled container, and dispose as directed. Never leave a spill unattended; for a transportation emergency call CHEMTREC at 1-800-424-9300.
What integrated pest management actually means
IPM holds pests below an unacceptable level by combining tactics - cultural, mechanical or physical, biological, genetic, regulatory, and chemical - guided by correct identification and ongoing monitoring. The goal is management, not eradication. Pesticides are one tool, used when scouting shows the pest population justifies the cost and risk.
Economic injury level vs. economic (action) threshold
The economic injury level is the pest density at which crop damage equals the cost of controlling it. The economic or action threshold is deliberately set BELOW the injury level - it is the density at which you must act so the population never reaches the point of economic loss. Treating below threshold wastes money and accelerates resistance.
Why correct pest identification comes before product selection
The tactic, the timing, and the legality all depend on the species and its life stage: a grass herbicide will not control a sedge, and a stomach poison fails against a sucking insect. Confirm that both the pest and the site appear in the labeling, and target the vulnerable stage - small larvae, seedling weeds, or actively translocating perennials in fall.
Non-chemical tactics an IPM program uses first
Cultural: crop rotation, resistant varieties, planting and harvest timing, sanitation, irrigation and fertility management. Mechanical or physical: cultivation, mowing, traps, barriers, screens, temperature control. Biological: conserving or releasing predators, parasitoids, and pathogens. These lower pest pressure, slow resistance, and are why an IPM field needs fewer sprays.
How pesticide resistance develops - and how to slow it
A few naturally resistant individuals survive each application and pass the trait to their offspring, so repeated use of one mode of action selects a resistant population. Rotate modes of action using the IRAC, FRAC, or HRAC group number on the label, apply the full labeled rate at the correct timing, and keep non-chemical tactics in the program. Cross-resistance means resistance to one product can extend to others in the same group.
What a useful scouting program records
Sample a representative pattern of the field on a set schedule and record the pest species, life stage, count per plant or per sweep, crop stage, and weather, then compare the count against the action threshold. Pheromone and sticky traps time treatments - they do not control the pest. Good records also tell you whether the last application actually worked.
Formulation abbreviations you must recognize on a label
EC emulsifiable concentrate; WP wettable powder; WDG or DF water-dispersible granule (dry flowable); SC or F suspension concentrate (flowable); SP soluble powder; SL soluble liquid; G granule; D dust; B bait; ULV ultra-low volume; RTU ready to use. The suffix tells you how the product must be mixed, agitated, and handled - it is not part of the product's chemistry.
Emulsifiable concentrate: advantages and hazards
ECs mix easily, need little agitation, leave little visible residue, and do not plug screens or wear nozzles. The trade-off is risk: the petroleum solvents increase dermal absorption, so applicator exposure is higher, and ECs are more likely to cause phytotoxicity, to soften rubber hoses and painted surfaces, and to soak into porous materials.
Wettable powder: advantages and hazards
WPs are inexpensive, far less likely to be absorbed through skin than an EC, and less phytotoxic. The trade-offs are a serious inhalation hazard from the dry dust while measuring and mixing, abrasion of pumps and nozzles, screen plugging, and rapid settling - so a WP needs constant agitation from the moment it goes in the tank.
Granules and baits: when the formulation is the safety feature
Both are ready to use, so there is no mixing exposure and almost no drift. Granules carry the active ingredient into soil and usually need soil moisture to release it; baits combine a small amount of active ingredient with a food attractant. Both must be kept from non-target animals, and spilled granules on pavement must be swept up before they wash into a storm drain.
How much product goes into one tank?
Acres per tank = tank size divided by gallons per acre; product per tank = acres per tank times the labeled rate. Example: a 300-gallon tank applying 20 GPA covers 15 acres, so at 1.5 pints per acre you add 22.5 pints (about 2.8 gallons) of product and fill to 300 gallons with water. Add product to a partly filled tank with agitation running.
Converting a rate in pounds of active ingredient into pounds of product
Product needed = pounds of active ingredient wanted divided by the pounds of active ingredient per unit of product. For 2 lb ai per acre from an 80% WP (0.8 lb ai per lb): 2 / 0.8 = 2.5 lb of product per acre. With a 4 lb ai per gallon EC at a 1 lb ai per acre rate: 1 / 4 = 0.25 gallon, which is 1 quart per acre.
Mixing a percent solution in a small sprayer
Fluid ounces of product = gallons of spray x 128 x the percent written as a decimal. For a 3% spray in a 4-gallon backpack: 4 x 128 x 0.03 = 15.4 fluid ounces of product, then fill to 4 gallons. Remember 1 gallon = 128 fluid ounces = 8 pints = 4 quarts, and check the label's compatibility and jar-test guidance before combining products.
The broadcast sprayer output formula
GPA = (5,940 x GPM) / (MPH x W), where GPM is the output of one nozzle, MPH is ground speed, and W is nozzle spacing in inches. The constant 5,940 comes from 43,560 sq ft per acre x 12 inches per foot / 88 ft per minute per mph. Doubling ground speed halves the gallons per acre.
The 1/128-acre calibration shortcut
An acre is 43,560 sq ft, so 1/128 acre is 340.3 sq ft - and because a gallon holds 128 fluid ounces, ounces caught equal gallons per acre. With 20-inch nozzle spacing the course is 340.3 / (20/12) = 204 feet. Drive it at working speed, time it, catch one nozzle's output for that many seconds, and read the ounces as GPA.
Checking ground speed without a speedometer
MPH = (distance in feet / seconds) x 0.682. Example: 200 feet in 30 seconds is 6.67 feet per second, and 6.67 x 0.682 = 4.5 MPH. Run the course in the field, loaded, in the gear and throttle setting you will actually spray with - a different gear, a full tank, or soft ground changes the applied rate.
When does a nozzle need to be replaced?
Catch every nozzle for the same timed interval and compare: replace any nozzle whose output is more than about 10% above or below the average of the set, or off the manufacturer's rated flow for that pressure. Worn orifices over-apply and distort the pattern. Nozzle type, orifice size, and pressure - not the pump - set droplet size and output.
Adjusting a broadcast rate for band application
Product per acre of field = broadcast rate x (band width / row spacing). A 15-inch band on 30-inch rows at a 2-pint broadcast rate uses 2 x (15/30) = 1 pint per acre of field, while the treated strip still receives the full labeled 2 pints per treated acre. Banding cuts total product roughly in half without exceeding the labeled rate.
Particle drift vs. vapor drift
Particle drift is spray droplets carried off target during the application; control it with coarser droplets, lower boom height, lower pressure, drift-reduction nozzles, and buffer distances. Vapor drift happens after the application when a volatile product evaporates and moves; control it by choosing low-volatility formulations, incorporating the product, and avoiding high temperatures.
Temperature inversion: how to spot one and why it matters
In an inversion, cool air is trapped near the ground beneath warmer air, so fine droplets stay suspended as a concentrated cloud and move far off target. Clues are nearly calm air (under about 3 mph), clear skies, dew or ground fog, and smoke that flattens and drifts sideways instead of rising. Inversions are common at dusk, overnight, and early morning - do not spray in one.
Which pesticides are most likely to reach groundwater?
Those that are highly water soluble, weakly adsorbed to soil particles and organic matter, and persistent (long half-life). Site risk rises with coarse sandy soils, low organic matter, a shallow water table, karst or fractured bedrock, and heavy rain or irrigation soon after application. Repeated mixing and loading near a wellhead is the most preventable contamination source of all.
Back-siphoning: the rule for filling a spray tank
Never put the fill hose inside the tank or below the liquid surface. Keep an air gap between the hose end and the tank opening, or use a working anti-backflow check valve, and never leave a filling tank unattended - a pressure drop can siphon pesticide back into the well or water source. Mix and load away from wells, ditches, and surface water.
Endangered species: Bulletins Live! Two
When a label directs you to the Endangered Species Protection Bulletins, the geographically specific use limitations in Bulletins Live! Two are label requirements for your application area, product, and month. Look up the bulletin by EPA registration number no more than six months before you apply and keep a copy - EPA adds limitations as Endangered Species Act consultations are completed.
Protecting pollinators during an application
Do not treat a blooming crop or blooming weeds while bees are foraging; shift to late evening or night, and mow blooming weeds before you spray. Dusts and microencapsulated products are among the worst for bees because the particles are carried back to the hive. Check the bee-hazard icon and pollinator protection box on the label, avoid drift onto adjacent bloom, and notify nearby beekeepers.
Frequently Asked Questions
Who actually administers the pesticide applicator exam?
States, territories, and tribes certify applicators; EPA does not give the test. EPA sets minimum competency standards in 40 CFR Part 171, approves each certifying authority's certification plan, and oversees the programs. You must be certified in every state, territory, and area of Indian country where you apply restricted use pesticides, so the exam you sit is written by your state lead agency (usually the Department of Agriculture, working with the state Pesticide Safety Education Program).
How many questions are on the private applicator core exam and what score do I need?
There is no national number. Each state lead agency writes its own core exam, so length, time limit, cut score, and fee vary; state core exams commonly run about 50-100 questions with a 70% passing score. Some states do not use an exam at all: 40 CFR 171.105(h) lets a certifying authority establish private applicator competency through an approved training program instead of a written test. Confirm the format with your state agency before you study.
What topics does the private applicator core exam cover?
40 CFR 171.105(a) lists eleven competency areas every private applicator must demonstrate: label and labeling comprehension, safety, environment, pests, pesticides and formulations, equipment, application methods, laws and regulations, responsibilities when supervising noncertified applicators, stewardship, and agricultural pest control. Extra categories apply on top of the core for soil fumigation, non-soil fumigation, aerial application, and sodium cyanide or sodium fluoroacetate predator control.
How often do I have to recertify?
Under 40 CFR 171.107 every private and commercial certification expires five years after issuance unless the applicator is recertified, and a state may set a shorter cycle. You recertify either by passing an approved examination again or by completing continuing education approved by your certifying authority. Recertify before your current certification expires - otherwise your authority to buy or apply restricted use pesticides lapses.
What happens if I fail the exam?
EPA publishes no national waiting period for retakes. Retake rules, waiting periods, retest fees, and any limit on attempts are set by the state lead agency that administers your exam, and they differ widely - some states let you retest the same week, others require additional training after repeated failures. Check your state's rule before rebooking, and use your score report to target the competency areas you missed.
Do I still have to keep federal records of restricted use pesticide applications?
No. USDA removed 7 CFR Part 110 effective July 11, 2025, ending the federal requirement that certified private applicators record restricted use pesticide applications within 14 days and keep them two years. State and tribal recordkeeping laws still apply and most mirror the old federal data elements, and the Worker Protection Standard still requires covered application and hazard information to be displayed and retained for two years after the restricted-entry interval expires. Older study manuals and some state exams still teach the rescinded federal rule.
How should I use these flashcards to prepare for the core exam?
Work the topic filters in the order your state manual uses: start with Label and Labeling and Laws and Regulations, which carry the most exam weight, then move to safety, IPM, and the calculation cards. Say the answer out loud before flipping, and rework the Equipment and Calibration and Mixing and Dilution Math cards with your own tank size and nozzle spacing until the formulas are automatic - calculation items are where most candidates lose points. Finish with practice questions so you can apply the terms rather than just recognize them.
