Why Part 1926 Is on a Plumbing Exam

29 CFR Part 1926, "Safety and Health Regulations for Construction," applies to construction work - construction, alteration, and repair, including painting and decorating. Part 1910 covers general industry. When you are roughing in a building, replacing a water service, or repiping a boiler room, you are working under Part 1926. Because 1926 is an open-book reference on this exam, the Board expects you to navigate it, not recite it. Three general-duty provisions drive everything else:

A competent person is someone capable of identifying existing and predictable hazards in the surroundings or working conditions that are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. Exam Trap: Fall protection triggers are not the same number everywhere. General construction work triggers at 6 feet (1926.501(b)(1)), and 6 feet also governs holes (1926.501(b)(4)) and the edge of an excavation, well, pit, or shaft (1926.501(b)(7)). But on a scaffold the trigger is more than 10 feet (1926.451(g)(1)). Candidates who memorize "6 feet, always" miss the scaffold question; candidates who memorize "10 feet" miss every trench-edge question. Note also that there is no Sec. 1926.98 - it is reserved, so flipping to it burns open-book time.

Hazard Communication - 1926.59 and 1910.1200

1926.59 contains one substantive line: the hazard communication requirements applicable to construction work "are identical to those set forth at Sec. 1910.1200." The construction citation is 1926.59, but the text you actually read is the Hazard Communication Standard (HCS) at 1910.1200, aligned to the Globally Harmonized System (GHS).

The standard imposes four employer obligations: a written hazard communication program, labels on containers, an accessible Safety Data Sheet (SDS) for every hazardous chemical on site, and employee training before initial assignment and whenever a new hazard is introduced. For a plumber the covered chemicals are solvent cement and primer, soldering flux and paste, thread-sealing compound, propane and MAPP gas, sulfuric-acid and sodium-hydroxide drain openers, epoxies, and cleaning chemicals.

The six required label elements

Every shipped-container label under 1910.1200(f)(1) carries: product identifier, signal word ("Danger" or "Warning"), hazard statement(s), pictogram(s), precautionary statement(s), and the name, U.S. address, and U.S. telephone number of the chemical manufacturer, importer, or other responsible party.

A compressed gas, a combustible or flammable liquid, and an explosive are all physical hazards. An inert gas that is not under pressure is neither a physical nor a health hazard under the HCS - nitrogen at atmospheric pressure is a simple asphyxiant, a genuine confined-space killer, but it matches none of the classified hazard classes. That is the exact wording exam writers use to build the distractor set.

Silica (1926.1153) is the one a plumber meets daily: saw-cutting a slab to chase a drain line, cutting pavement for a water service, or chipping a foundation for a sleeve. Table 1 of the standard lists specified exposure control methods by task, and an employer who follows Table 1 exactly is relieved of exposure monitoring. For a handheld power saw, Table 1 requires a saw with an integrated water delivery system that continuously feeds water to the blade; used outdoors, no respirator is needed for four hours or less of task duration, but an APF-10 respirator is required beyond four hours, and indoors or in an enclosed area an APF-10 respirator is required regardless of duration. Walk-behind saws also require integrated water; outdoors no respirator is required, and indoors an APF-10 respirator is required past four hours.

Lead (1926.62) governs old work: torching or wiping lead bends, cutting lead-caulked bell-and-spigot hubs, and disturbing lead-based coatings. Manual scraping, sanding, and heat-gun work on lead-containing paint trigger interim protective measures until an exposure assessment is complete.

Asbestos (1926.1101) hides in pre-1980 pipe insulation, transite flue pipe, and boiler breeching. Removing thermal system insulation is Class I work. A repair or maintenance operation in which thermal system insulation is likely to be disturbed - the ordinary situation when you break into an insulated steam or hot-water line - is Class III work.
