The Arkansas Department of Health (ADH) Cosmetology and Body Art Rules, effective September 5, 2024, treat implement disinfection as a public-health control, not as a shop courtesy. In the Purpose section, ADH states that it regulates the conduct and sanitation of establishments, mobile salons, and schools of cosmetology so as to prevent the spreading of communicable diseases. That purpose is what the Arkansas State Law written exam is testing when it asks about wet jars, labeled dirty bins, and covered storage.

A licensed manicurist (the occupation Arkansas licenses; “nail technician” is the common search name) works under those establishment rules every day. The NIC Nail Technology theory exam also weights infection control as its own domain, and the school-administered practical watches whether used tools go into a labeled dirty receptacle. The EPA three-kill standard

ADH defines disinfectant as an Environmental Protection Agency (EPA)–registered product that is bactericidal (capable of destroying bacteria), virucidal (capable of destroying viruses), and fungicidal (capable of destroying fungi). Disinfect means destruction of bacterial, viral, and fungal pathogens (not spores) through the proper process and chemical disinfectants intended for use in the salon setting.

All three claims are required. A bottle labeled only “antibacterial,” or marketed as “hospital grade” without virucidal and fungicidal claims, does not meet the rule. Disinfectants must be used according to manufacturer labels to be safe and effective. Contact time listed on the manufacturer’s label must be adhered to at all times to destroy pathogens. Arkansas does not publish a substitute minute count in this section. If the label requires ten minutes of wet contact, lifting a pusher at two minutes is not disinfection under the rule.

Minimum equipment: the liquid disinfecting receptacle and soiled linens

Every school of cosmetology, postsecondary school of cosmetology, establishment, and mobile salon must have and maintain the following minimum equipment:

  1. A liquid disinfecting receptacle to hold instruments and supplies with an EPA-registered disinfecting solution that is bactericidal, virucidal, and fungicidal. The receptacle must be large enough that the instruments and supplies are completely submerged. The disinfectant solutions shall remain covered at all times and shall be changed daily or whenever visibly cloudy or dirty.
  2. All soiled linens must be in a separate vented receptacle from clean ones.

Those two sentences generate a cluster of exam traps. An uncovered “pickle jar” fails coverage even if the chemistry is correct. A jar changed every Monday fails the daily rule even if the liquid still looks clear. A solution that turns cloudy or dirty at 2 p.m. must be changed then, not at close. Implements standing half-out of the liquid are not fully submerged; hinged nippers need to be opened so solution reaches the joint.

Used towels belong in the soiled-linen path. After a towel has once been used, it shall be deposited in a receptacle and shall not again be used until properly cleaned. Towels and linens shall be washed on the hot cycle and dried until hot to the touch. Inspectors score laundry and the wet jar as related sanitation, not as optional housekeeping.

Clean, then disinfect — the order is the rule

Soil, oil, and nail-product film block disinfectant. For both electrical and non-electrical items, ADH requires cleaning first, then EPA-registered disinfection. A clipper coated in acrylic dust that is merely sprayed has not been disinfected under the rule. The same order applies to a metal pusher: debris off, then wet contact for the label’s time.

Used or soiled disinfectable instruments go into a properly labeled receptacle that contains only dirty items awaiting disinfection. Do not mix dirty implements with clean storage. Do not leave a used e-file bit on the table “for a second.” The dirty receptacle is a holding area, not a disinfectant.

Electrical versus non-electrical storage

Before use upon a client, all electrical instruments shall be cleaned and disinfected with an EPA-registered disinfecting solution (spray or wipe) that is bactericidal, virucidal, and fungicidal, used according to the manufacturer label. After disinfection, electrical instruments and equipment shall be placed on a hook or on a clean towel and covered by a clean towel.

Before use upon a client, all non-electrical instruments shall be cleaned and then disinfected with an EPA-registered bactericidal, virucidal, and fungicidal liquid. Disinfected items should be stored in a clean covered container.

That storage split is a favorite State Law distinction: electrical tools rest on a hook or under a covering towel; metal pushers, nippers, and similar non-electrical tools go into a clean covered container. Putting metal pushers on an open towel “to dry” borrows the electrical method for the wrong category. Putting a disinfected drill loose in an open drawer fails the cover-or-hook rule.

Electrical and non-electrical equipment shall be functioning in accordance with the manufacturer’s specifications. Equipment that is not operable shall be repaired or discarded. A drill that sparks, a heating unit that will not hold temperature, or clippers that no longer close are not “backup tools.” They stay out of service until repaired or thrown away.

Porous supplies Arkansas will not let you “wash and reuse”

All used porous supplies or instruments—such as files, pumice stones, and buffers—that cannot be disinfected shall be disposed of in a waste receptacle immediately after use. The next sentence is nail-specific and easy to miss: disinfectable files, pumice stones, and buffers are prohibited. Do not invent a “hospital-grade file soak.” If the item is a file, pumice stone, or buffer, it is not a multi-client wet-jar tool in an Arkansas establishment.

Sterilizing instruments: single-use sharps and what ultraviolet cannot do

All needles and lancets must be single-use and disposable. For proper disposal, the rules cite Ark. Code Ann. § 20-7-109 and Ark. Code Ann. §§ 20-32-101–112 (medical waste). Do not recap a lancet for the next callus. Do not drop needles into the EPA jar as if they were pushers.

Instruments that cannot be sterilized with an autoclave must be processed with an EPA-registered bactericidal, virucidal, and fungicidal disinfecting solution used per the label. Dry sterilizer or UV lights are not acceptable sterilization techniques. An ultraviolet cabinet may sit on a station as furniture; it does not satisfy ADH sterilization. If a question asks whether ultraviolet light or a dry sterilizer “sterilizes” implements under Arkansas rules, the answer is no.

Liquids, creams, powders, and pencils

All liquids, creams, and other cosmetic preparations shall be kept in properly labeled clean and covered containers. Powders may be kept in a clean shaker. When only a portion of a cosmetic preparation is to be used on a client, it shall be removed from the container in such a way as not to contaminate the remaining portion. In a nail station that means a clean spatula—not a used orangewood stick, not a gloved finger that already touched the client, and not pouring extra back into the jar. Double-dipping and returning unused product contaminate the bulk container.

Pencil cosmetics shall be sharpened before each use. The sharpener must be cleaned after each use.

How an inspector or exam item will sequence this

A typical Arkansas station story runs like this. Metal pushers come off the client into the labeled dirty receptacle. They are cleaned of debris. They soak fully submerged in covered EPA bactericidal/virucidal/fungicidal solution for the label’s contact time. They are stored in a clean covered container. An e-file handpiece is cleaned, then sprayed or wiped with the same three-claim EPA product, then hung or set on a clean towel and covered with a second clean towel. Files used on that client go in the trash, not the jar. Cuticle cream comes out with a clean spatula. If any of those steps is replaced by an ultraviolet box, an uncovered jar, a shared lotion mouth, or a dead drill left in rotation, the station fails the rule.
