1What establishes a person's status as a Slovak patentový zástupca under Act 344/2004?
A.Ownership of any patent
B.Employment by an engineering company
C.Entry in the statutory list of patent attorneys
D.Completion of a trademark application without assistance
Explanation: The Act defines a patent attorney by entry in the statutory list. Owning IP or performing technical work does not by itself establish that professional status.
2Which service falls within the Patent Attorney Act's description of industrial-property professional activity?
A.Preparing industrial-property filings and advising on industrial-property rights
B.Representing clients in every criminal matter solely by virtue of patent-attorney registration
C.Providing unrestricted legal representation in all civil disputes solely by virtue of patent-attorney registration
D.Authenticating instruments as public notarial deeds solely by virtue of patent-attorney registration
Explanation: The statutory activity includes representation in industrial-property proceedings, professional advice and preparation of relevant documents. It does not transfer the adjudicative powers of courts, the Office or notaries to the representative.
3A client instructs a patent attorney to make a filing the attorney knows would violate applicable law. How does § 17 treat that instruction?
A.Client payment makes the instruction binding
B.Only a written instruction may override the law
C.The attorney must obey and disclose the problem only after filing
D.The attorney must advise the client of the conflict and is not bound by the unlawful instruction
Explanation: The attorney is independent and follows client instructions within the limits of law. Section 17 requires advising the client where instructions conflict with legal or professional rules and removes their binding force.
4A proposed client's interests conflict with the patent attorney's own financial interests. Which statutory response is required under § 19?
A.Accept if the conflicting personal interest is disclosed in the engagement letter
B.Accept automatically if no court case has started
C.Refuse the services because of the conflicting personal interests
D.Accept because professional-conflict rules concern only conflicts between two clients
Explanation: Section 19 requires refusal where the attorney's interests or those of close persons conflict with the proposed client's interests. The protection is not confined to litigation.
5A patent attorney maintains professional liability insurance for registration but plans to cancel it while continuing practice. What does the Act require?
A.Proof of insurance at registration is sufficient even if cover is then cancelled
B.Insurance throughout the exercise of the professional activity
C.Insurance is required only for contentious proceedings and not for application drafting
D.A client disclaimer generally replaces the statutory insurance obligation
Explanation: The Act requires proof of the relevant insurance at registration and on the Chamber's prescribed request. The cover must continue throughout professional practice.
6A patent attorney and client litigate a fee dispute. May the attorney rely on the § 18 exception to publish the client's whole invention file online?
A.No; the dispute exception is limited to what is necessary for proceedings before the court or other authority
B.Yes, any dispute releases every confidential fact to the public
C.Yes, once the client fails to pay an invoice
D.No, because § 18 contains no exception for attorney-client disputes at all
Explanation: Section 18 permits departure from confidentiality to the extent necessary for the specified attorney-client proceedings. It is not a general authorization for public disclosure of the entire file.
7What is the ordinary maximum term of a Slovak patent, assuming the required maintenance payments and no earlier loss of rights?
A.Ten years from grant
B.Twenty years from first commercial sale
C.Twenty-five years from publication
D.Twenty years from filing
Explanation: Patent Act § 29 measures the ordinary twenty-year term from filing. Maintenance requirements and any distinct supplementary-protection regime must be considered separately.
8Which group states the central positive patentability requirements in the Slovak Patent Act?
A.Novelty, individual character and use as a commercial sign
B.Novelty, inventive step and industrial applicability
C.Original expression, authorship and fixation in a work
D.Distinctiveness, genuine use and absence of conflicting earlier marks
Explanation: The Act requires novelty, inventive step and industrial applicability, alongside compliance with exclusions and the other legal requirements. Commercial promise does not replace these tests.
9Which part of a Slovak patent determines the scope of protection, with the description and drawings used for interpretation?
A.The description independently of the claims
B.The drawings independently of the claims
C.The patent claims
D.The abstract independently of the claims
Explanation: Section 13 identifies the claims as determining the scope of protection. The description and drawings assist their interpretation rather than replacing them with marketing language.
10Before any filing or priority date, an inventor publicly posts an enabling description of the claimed invention. No statutory disclosure exception applies. What risk should the adviser identify?
A.The disclosure can become prior art against novelty
B.Every inventor disclosure receives an unconditional twelve-month patent grace period
C.Only disclosures made by someone other than the inventor can destroy novelty
D.Online disclosures outside Slovakia cannot form part of the prior art
Explanation: Novelty assessment includes relevant information made available to the public before the applicable date. An applicant's own disclosure is not automatically exempt simply because the applicant made it.

Frequently Asked Questions

What education and practice are required?

The published rules require first-degree university education and either three years as a patent-attorney assistant or four years of other qualifying industrial-property practice. Check the required supporting documents and registration conditions with the Office.

Is there an official 100-question test?

No verified item count was found. The rules assign 100-point scales to separately assessed written parts; these are points, not a published question count.

Are 2026 dates and English delivery confirmed?

No 2026 sitting date or permitted delivery-language list was confirmed. The provider's current page still advertises its 2025 sitting and links the examination rules. This English-language MCQ adaptation makes no claim that an official English sitting exists.

Does the practice distribution reproduce official scoring?

No. The official written test and work separately assess patent/design law and rights in signs. This focused bank samples both and supporting professional, copyright and treaty knowledge; its topic counts are editorial practice counts, not official weights.

Does national registration automatically authorize EPO representation?

No. EPO professional representation has its own EPC eligibility and list-entry requirements. National registration alone does not establish those conditions.
