1A creditor starts a new enforcement proceeding under the current Exekučný poriadok. Which court has jurisdiction under § 49?
A.Okresný súd Banská Bystrica
B.The district court for the debtor's residence
C.The court that issued the original judgment
D.The regional court for the bailiff's office
Explanation: Section 49 assigns enforcement proceedings to Okresný súd Banská Bystrica. Deciding the underlying dispute and overseeing enforcement are different functions; older proceedings require separate transitional analysis.
2In an ordinary monetary enforcement with none of the exceptions in § 61k(4), a debtor relies on payment after the title arose. Which procedure preserves the initial statutory suspensive effect?
A.An appeal against the original judgment sent to SKE within 15 days
B.A reasoned návrh na zastavenie exekúcie filed with the bailiff within 15 days of service of the commencement notice
C.A creditor complaint within 30 days of the first deduction
D.A request to the judgment court after the auction
Explanation: Section 61k allows termination on specified grounds, including extinguishment of the claim after the title arose. The initial reasoned motion is filed with the bailiff within 15 days of service and has suspensive effect subject to statutory exceptions.
3Which document can qualify as a notarial enforcement title under § 45(2)(c), assuming the obligation is due and other statutory restrictions are met?
A.A notarial deed identifying the obligation, parties, legal basis, subject and time of performance, with the obligated person's consent to enforceability
B.A loan agreement entered in accounting records
C.An invoice with certification of the creditor's signature
D.A notarial record confirming only that a demand was posted
Explanation: The deed requires the statutory particulars and the obligated person's consent to enforceability. Signature authentication or proof of sending a demand does not supply those elements.
4A third party documents ownership of a machine inventoried in enforcement against someone else. What is the first statutory step under § 44?
A.Appeal against the judgment establishing the debtor's debt
B.Apply to the Cadastre to release the machine
C.File a termination motion as if the third party were the debtor
D.Assert and substantiate the right excluding enforcement before the bailiff
Explanation: A right excluding enforcement must first be asserted and substantiated before the bailiff. The objection suspends enforcement against the asset, and the subsequent creditor response and court procedure determine whether litigation is needed.
5One enforcement method is unlikely to recover the claim. Under §§ 64–65, which approach best addresses using another method concurrently?
A.Several methods may be used while their selection and the value of secured property remain proportionate to the obligation
B.Concurrency always requires debtor consent
C.The first method must be terminated before another begins
D.Each method may secure the entire claim without considering the combined effect
Explanation: Section 65 permits several methods in one proceeding. Section 64 also requires proportionate selection and a relationship between secured value and the obligation, so concurrency does not remove that constraint.
6Which claim is expressly preferential for wage deductions under § 71(2)?
A.An unsecured bank loan
B.A maintenance claim (pohľadávka výživného)
C.An ordinary telephone-service invoice
D.A contractual penalty on a retail purchase
Explanation: Maintenance is an expressly preferential claim. It can draw on the second third of the relevant wage remainder under statutory rules, while ordinary contractual debts do not gain that status merely by being overdue.
7For one ordinary non-preferential claim, the wage remainder after the protected basic amount is €240. It is entirely below the unrestricted-deduction threshold, and the claim exceeds €240. How much of the remainder is deductible?
A.€240
B.€160
C.€80
D.€120
Explanation: Section 71 permits one third of this remainder for an ordinary claim. The calculation is €240 ÷ 3 = €80; the assumptions exclude an unrestricted excess and preferential second-third deductions.
8A debtor has several bank accounts. Disregarding separate protections for wages and other designated funds, how does the basic €165 protection in § 104(1) apply?
A.€165 is protected in every account
B.The €165 protection applies to only one account
C.Protection requires creditor consent
D.A percentage of all balances is protected instead
Explanation: Section 104(1) limits this basic protection to one account when several exist. Other protections, including qualifying wage income under § 104(2), must be considered separately.
9For monetary enforcement governed by Decree No. 68/2017 Z. z., the remuneration base is €2,000 and the ordinary 20% rate applies. Excluding VAT, expenses and other components, what is the remuneration?
A.€400
B.€200
C.€2,400
D.€40
Explanation: Sections 6–7 use recovered performance as the base and set the ordinary rate at 20%. Therefore €2,000 × 0.20 = €400, before the excluded components.
10A €2,000 remuneration base qualifies under § 7(2) of Decree No. 68/2017 Z. z. because satisfaction occurred before expiry of the deadline for a termination motion having suspensive effect. What remuneration results, excluding VAT and expenses?
A.€400
B.€200
C.€100
D.€0
Explanation: Qualifying early satisfaction attracts the 10% rate. The result is €2,000 × 0.10 = €200; reducing remuneration does not eliminate every expense.

Frequently Asked Questions

Does this practice simulate the official bailiff examination?

No. This is an independent English-language MCQ study adaptation. The official examination comprises a 30-minute written test, up to 8 hours of practical tasks and enforcement file drafting, and an oral examination before a five-member commission.

Who is eligible to sit the Exekútorská skúška?

SKE's rules require Slovak citizenship, full legal capacity, the prescribed second-cycle legal education or recognized foreign equivalent, statutory good character, and five years of legal practice including three years of enforcement practice. The Code permits credit for specified other legal practice; the three years must not be described universally as trainee service only. Appointment also involves separate selection and statutory conditions.

What language is the official examination conducted in?

The checked public notice and regulations did not expressly confirm official delivery-language options. They are published in Slovak, which alone does not establish permitted assessment languages. This English-language MCQ study adaptation preserves Slovak terms without claiming an official English sitting or translation.

What is the passing score on the official examination?

Candidates must achieve at least 16 out of 20 points on the written test, at least 16 out of 20 points on the practical section (combined written minimum of 32/40), and pass the mandatory oral examination.

Do the practice topic counts represent an official blueprint?

No. SKE's rules identify enforcement and office rules, civil law and procedure, commercial, administrative, criminal, labour, constitutional and state law, legal theory, and private international law and procedure, but the checked sources publish no percentage weighting. The displayed counts are our editorial study allocation. Use the current SKE oral-topic list and practise full files and oral answers separately.
