1A requested notarial act would circumvent a statutory prohibition. What is the notary's duty under the Notarial Code?
A.Perform it after recording the client's acceptance of risk
B.Refuse the requested act
C.Perform it because both parties have independent legal advice
D.Prepare the instrument and leave all legality checks to the register authority
Explanation: Section 36 requires refusal where an act contravenes or circumvents the law or is contrary to good morals. Client consent or an increased fee does not remove that duty.
2What does vidimácia principally certify under Notarial Code § 57?
A.That every statement in the original is true
B.That the original creates an enforceable debt
C.That the original's author had contractual capacity
D.That the copy corresponds to the document presented
Explanation: Vidimácia concerns correspondence of the copy with the presented document. The Code expressly separates this from certification of the truth of the document's statements.
3A person brings a document signed yesterday and acknowledges the signature as their own before the notary. Can that acknowledgment support legalizácia?
A.Yes; acknowledgment of an existing signature is a statutory alternative to signing in the notary's presence
B.No; only a signature made on the day of certification can qualify
C.Yes; the notary thereby also guarantees the document's factual truth
D.No; acknowledgment is available only for commercial companies
Explanation: Section 58 permits certification after either signing in the relevant official's presence or acknowledging an existing signature as one's own. Identity must be established, and the certification does not attest to the truth of the document.
4A notary would personally benefit from a transaction recorded in the proposed notarial instrument. What consequence does § 37 address?
A.Disclosure of the benefit and both parties' consent preserve public-instrument status
B.The notary may act provided they do not sign as a party
C.The notary may not act, and an instrument made contrary to the provision lacks public-instrument status
D.The instrument remains public, although the conflict may affect only disciplinary liability
Explanation: Section 37 restricts notarial action where the notary or a close person is a participant or beneficiary. An instrument made contrary to that provision is not a public instrument.
5An unfamiliar participant presents an identity document, but the notary still has concrete doubts about identity. What does § 48 require when preparing a notarial deed?
A.Accept the document without further inquiry because it appears formally valid
B.Make further inquiries to establish actual identity
C.Record the doubt but execute the deed without resolving it
D.Treat the counterparty's informal assurance as sufficient despite the remaining doubt
Explanation: The Code requires further investigation where the initial identity procedure does not produce certainty. Proceeding without establishing actual identity can carry liability under the statutory conditions.
6A notary drafts a deed for a participant who cannot read or write. Which safeguard follows from § 49, apart from any other applicable special requirements?
A.One witness of the act present throughout the process
B.Two witnesses present only when the final deed is signed
C.Two witnesses who need not attend the reading if the participant gives written consent
D.Two witnesses of the act present for the declaration of will, reading and approval, with those circumstances recorded
Explanation: Section 49 requires two witnesses of the act at the specified stages and a record of those circumstances. Witness eligibility and any additional communication safeguards must also be checked.
7Money escrow documentation requires proof of a specified registration before payment to the seller. The seller asks for early release without that proof and without a lawful change to the agreed conditions. What should the notary do?
A.Follow the recorded escrow conditions rather than release on the seller's request alone
B.Release because the seller asserts that registration is certain to succeed
C.Release after the seller gives an indemnity for failure of registration
D.Treat the seller's unilateral request as an amendment of the agreed conditions
Explanation: Section 68 ties handling and release of escrow money to the depositor's instruction or agreement and the recorded release conditions. Satisfaction of the conditions and release are documented in the file.
8A retired notary is asked by a former employee to publish a client's file. No valid release or statutory disclosure exception applies. Does retirement end the relevant confidentiality obligation?
A.Yes, the duty ends with the notarial office
B.Yes, if the employee has also left
C.No; the duty survives the end of office and the end of employment
D.No, but only until the underlying client matter has ended
Explanation: Section 39 expressly continues confidentiality after the notarial office or employee relationship ends. Releases and statutory exceptions must be considered on their own terms.
9A deceased person leaves a spouse and two children, all inheriting intestate in the first group. What is each person's share of the estate?
A.Spouse one half; each child one quarter
B.One third each
C.Each child one half; spouse nothing
D.Spouse two thirds; each child one sixth
Explanation: Section 473 gives the spouse and children equal shares in the first intestate group. Three inheriting persons therefore each receive one third of the estate, after any separate marital-property settlement.
10Which form describes a holographic will under Slovak Civil Code § 476a?
A.A typed will personally signed by the testator before two witnesses
B.A handwritten will signed only by two witnesses
C.A will written and signed in the testator's own hand, also meeting the general validity requirements
D.A typed will whose testator's signature is officially certified
Explanation: A holographic will must be handwritten and signed by the testator. The general requirements, including the date of signing, remain relevant.

Frequently Asked Questions

Is this an official notarial exam simulation?

No. This English-language MCQ study adaptation helps study legal knowledge and judgment. The official assessment requires written instruments and oral performance, which need separate practice.

Who may sit the examination?

The 2026 notice requires registered trainee status, successful basic and advanced courses, and three years of legal practice including at least two years of notarial practice. Statutory degree and other conditions also apply. Do not confuse exam eligibility with the separate conditions for appointment to an office.

What language is verified?

Official subject materials are in Slovak, and the Notarial Code requires notarial instruments in the state language. No official English examination option was confirmed; check any oral-language arrangements with NK SR.

Are the practice percentages official?

No numerical blueprint weights were found. The bank samples the five groups in the December 2026 oral list, emphasizing succession and notarial work. It is a focused selection rather than exhaustive coverage.
