1A municipal secretary of public works is offered a fully sponsored international trip by a private construction consortium that is currently competing in an ongoing public infrastructure bidding process. Under Brazilian administrative ethics and constitutional principles (Article 37 of the 1988 Federal Constitution), how must the public manager act?
A.Accept the trip provided that travel dates occur outside official municipal business hours and without using public funds.
B.Decline the invitation immediately, as accepting benefits from competing vendors compromises impartiality and violates the constitutional principles of morality and probity.
C.Accept the invitation on the condition that all competing bidding consortia are invited to sponsor similar technical site visits.
D.Accept the trip only if a junior technical engineer accompanies the secretary to document all industry interactions.
Explanation: Article 37 of the 1988 Federal Constitution establishes the fundamental administrative principles of Legalidade (Legality), Impessoalidade (Impersonality), Moralidade (Morality), Publicidade (Publicity), and Eficiência (Efficiency) - known by the acronym LIMPE. Accepting gifts, travel sponsorships, or hospitality from entities participating in public tenders severely compromises the manager's independence, creates an impermissible conflict of interest, and constitutes an act of administrative dishonesty punishable under Federal Law 8.429/1992 (Administrative Improbity Law).
2A federal autarchy is drafting the edital for a concurso público offering 12 permanent vacancies. Under the affirmative-action statute currently in force for federal competitive examinations, what reservation must the edital apply?
A.20% of the vacancies, reserved for pretos e pardos only, under the percentage originally set by Lei nº 12.990/2014.
B.30% of the vacancies, reserved for pretos e pardos, indígenas e quilombolas, applied whenever the competition offers 2 or more vacancies.
C.30% of the vacancies, reserved for pretos e pardos only, with indígenas e quilombolas covered by separate state legislation.
D.25% of the vacancies, reserved for pretos e pardos, indígenas e quilombolas, but applicable only to cargos efetivos and never to temporary hiring.
Explanation: Lei nº 15.142, de 3 de junho de 2025, expressly revoked Lei nº 12.990/2014 and raised the federal reservation from 20% to 30%, widening it beyond pretos e pardos to include indígenas e quilombolas. Article 1º applies it to concursos públicos for cargos efetivos e empregos públicos across the federal direct administration, autarquias, fundações públicas, empresas públicas and sociedades de economia mista controlled by the Union, and also to processos seletivos simplificados for temporary hiring under Lei nº 8.745/1993. Article 5º triggers the reservation whenever the certame offers 2 or more vacancies. Decreto nº 12.536/2025 divides the 30% into 25% for pretos e pardos, 3% for indígenas and 2% for quilombolas.
3A citizen submits a formal request under the Brazilian Access to Information Law (Lei de Acesso à Informação - Law 12.527/2011) asking for the itemized travel expenditures and daily allowances (diárias) of municipal council members. How must the public agency respond?
A.Deny the request because financial details of elected officials are classified as strictly confidential personal data.
B.Provide the complete expenditure records within statutory timeframes, as public expenditures are inherently subject to active and passive transparency.
C.Charge an administrative penalty fee to the citizen before processing the public expenditure inquiry.
D.Condition the release of information on the citizen proving a direct personal legal interest in the municipal budget.
Explanation: Law 12.527/2011 establishes publicity as the general rule and secrecy as the exceptional, narrowly defined exception in public administration. Information concerning the management of public funds, including salaries, travel allowances, and operational expenses of elected representatives, constitutes public information accessible to any citizen without needing to justify legal standing or motive.
4When incorporating Environmental, Social, and Governance (ESG) principles into sustainable public procurement, a state health department must align its purchases with which principle established in Article 5 of the New Public Bidding and Contracts Law (Law 14.133/2021)?
A.Exclusive preference for international suppliers that hold private voluntary certifications.
B.Promotion of national sustainable development as a core objective and guiding principle of the procurement process.
C.Complete elimination of cost-benefit calculations in favor of unconditional green acquisitions.
D.Restriction of bidding procedures to state-owned enterprises only.
Explanation: Article 5 and Article 11 of Federal Law 14.133/2021 explicitly identify the promotion of national sustainable development (incentivo ao desenvolvimento nacional sustentável) as a core principle and objective of public tenders. This authorizes public administrators to incorporate socio-environmental criteria, life-cycle costing, energy efficiency standards, and accessibility requirements into technical specifications.
5Municipal Health and Social Assistance Councils in Brazil operate as institutionalized mechanisms of participatory democracy and social control (controle social). What is the legally defined parity composition of Municipal Health Councils under Federal Law 8.142/1990?
A.100% appointed government officials and municipal executive staff.
B.50% healthcare users (civil society), 25% healthcare workers, and 25% government representatives and private healthcare providers.
C.50% private hospital executives, 30% municipal councilors, and 20% university researchers.
D.Equal one-third distribution among legislative politicians, judiciary representatives, and police officials.
Explanation: Federal Law 8.142/1990 and National Health Council (CNS) Resolution 453/2012 mandate parity in health councils: 50% representation from healthcare users (civil society organizations, community associations, syndicates), 25% from healthcare professionals/workers, and 25% from public managers and healthcare service providers. This parity ensures that civil society maintains a decisive voice in inspecting and deliberating healthcare policy.
6The Brazilian Inclusion Law (Estatuto da Pessoa com Deficiência - Federal Law 13.146/2015) mandates that all public agency websites and citizen digital service portals must guarantee:
A.Paid premium access tiers for advanced citizen search functionality.
B.Mandatory accessibility conforming to established international web standards (such as e-MAG and WCAG) to enable autonomy for persons with disabilities.
C.Exemption from digital accessibility requirements for state autarchies and municipal agencies with fewer than 50 employees.
D.Replacement of all written administrative texts with audio files only.
Explanation: Article 63 of Federal Law 13.146/2015 establishes that websites maintained by public agencies and entities of the direct and indirect public administration must be fully accessible to persons with disabilities, adhering to the e-MAG (Electronic Government Accessibility Model) and international WCAG guidelines. Failure to implement digital accessibility infringes upon the fundamental right to information and equal citizenship.
7Brazil's Corporate Anti-Corruption Law (Lei Anticorrupção - Federal Law 12.846/2013) introduces what standard of liability for legal entities (companies) that commit corrupt acts against the public administration?
A.Subjective liability, requiring the public prosecutor to prove malicious criminal intent of individual board members.
B.Strict civil and administrative liability (responsabilidade objetiva), holding the enterprise liable regardless of proof of guilt or subjective intent.
C.Complete immunity from administrative sanctions if the company possesses a certified ISO 9001 quality manual.
D.Liability limited strictly to reimbursing 10% of the illicit profits obtained.
Explanation: Law 12.846/2013 establishes strict administrative and civil liability (responsabilidade objetiva) for legal entities engaging in harmful acts against domestic or foreign public administration. The public authority need only demonstrate the occurrence of the corrupt act and the causal connection to the enterprise's benefit, without having to prove willful intent (dolo) or negligence (culpa) of corporate executives.
8Under Federal Law 13.608/2018 and Brazilian administrative ombudsman norms, a public employee who reports illicit practices, fraud, or diversion of public funds to control bodies (Ouvidoria, Controladoria-Geral) is entitled to:
A.Protection against retaliatory workplace measures, preservation of confidentiality regarding personal identity, and whistleblower safeguards.
B.An automatic statutory reward of 20% of any public funds later recovered, payable as soon as the report is filed.
C.Automatic precautionary removal of the reported official from their post while the investigation runs.
D.Untraceable anonymity so absolute that no control body may ever contact the reporter for clarification.
Explanation: Federal Law 13.608/2018, reinforced by Federal Decrees on public ombudsman units (Ouvidorias), guarantees anonymity or strict identity preservation for whistleblowers (denunciantes) reporting crimes against public administration or administrative improbity. It strictly shields employees from retaliatory administrative disciplinary proceedings, arbitrary demotions, or harassment.
9When processing citizen personal data in digital government platforms under the General Data Protection Law (LGPD - Federal Law 13.709/2018), public administration entities are legally authorized to process data without explicit user consent primarily to:
A.Monetize and sell citizen demographic databases to commercial marketing firms.
B.Execute public policies, fulfill legal and statutory obligations, and deliver public services within their institutional mandate.
C.Share biometric records with unverified private political campaign managers.
D.Create secret profiling databases for non-public commercial ventures.
Explanation: Article 7, item III, and Article 23 of the LGPD (Law 13.709/2018) permit public administration bodies to process personal data without separate citizen consent when necessary for the regular execution of public policies provided for in laws and regulations or grounded in contracts, covenants, and administrative agreements, provided the purpose is public and legitimate.
10According to the Code of Professional Ethics for Civil Servants of the Federal Executive Branch (Decree 1.171/1994), what is the sole disciplinary sanction that can be directly applied by a Sectoral Ethics Commission (Comissão de Ética)?
A.Immediate dismissal with loss of pension rights (Demissão a bem do serviço público).
B.Censure (Censura ética), accompanied by recommendations for administrative correction.
C.Criminal imprisonment of up to six months in a federal penitentiary.
D.Financial fine deducted directly from the public servant's monthly payroll.
Explanation: Under Decree 1.171/1994 (Chapter II, Section II), the only sanction within the direct competency of a Public Ethics Commission is Ethical Censure (Censura). If the commission discovers evidence of administrative offenses under Law 8.112/1990 or criminal acts, it forwards the dossier to the disciplinary authority (Corregedoria) or Public Prosecutor's Office (Ministério Público).

About the ENADE Gestão Pública Exam

ENADE Tecnologia em Gestão Pública is the mandatory curricular assessment of Brazil's Sistema Nacional de Avaliação da Educação Superior (SINAES), run by the Instituto Nacional de Estudos e Pesquisas Educacionais Anísio Teixeira (INEP) under the Ministério da Educação (MEC). It is taken by final-year students (concluintes) of the Curso Superior de Tecnologia (CST) em Gestão Pública. Gestão Pública is assessed on the triennial SINAES rotation as a Year I (Ano I) evaluation area under Portaria Normativa MEC nº 840/2018; the most recent sitting was the Enade 2025 edition, applied nationwide on 23 November 2025. The official paper runs 4 hours and contains 46 items: 15 multiple-choice Formação Geral questions and 30 multiple-choice plus 1 discursive Componente Específico question. Under Portaria Inep nº 354/2025 the specific component is built from the Catálogo Nacional dos Cursos Superiores de Tecnologia and covers 20 objetos de conhecimento, including teorias da administração pública; Estado, governo e administração pública; políticas públicas; planejamento estratégico e governamental; legislação aplicada ao setor público; compras públicas, licitações e contratos administrativos; finanças e orçamento público; contabilidade aplicada ao setor público; matemática e estatística aplicadas à gestão pública; gestão de recursos humanos no setor público; logística e patrimônio público; tecnologias da informação; and transparência e controle social. There is no individual pass mark: student performance feeds the course-level Conceito Enade (1 to 5) and the derived CPC and IGC quality indicators. The practice questions on this page are an English-language multiple-choice study adaptation of that official Portuguese-language assessment, not an official translation or a simulation of its discursive component.

ENADE Gestão Pública Study Tips from Top Performers

1Work from the official outline. Portaria Inep nº 354/2025 lists the 20 objetos de conhecimento, the concluinte profile and the two assessed competencies — analysis and diagnosis for public management, and planning and execution of public policy. Map your revision to that list rather than to a generic administration syllabus.
2Master the administrative-law core: the LIMPE principles in Article 37 of the CF/88, the Nova Lei de Licitações (Lei 14.133/2021) with its five bidding modalities and six judgment criteria, the Lei de Acesso à Informação (Lei 12.527/2011), and the Lei de Improbidade Administrativa as reformed by Lei 14.230/2021.
3Practise the budget cycle end to end: how the PPA, LDO and LOA connect, the three stages of expenditure (empenho, liquidação, pagamento), restos a pagar, the additional-credit categories, and the LRF limits on personnel spending and debt.
4Do the arithmetic. Matemática e estatística aplicadas à gestão pública is an official objeto de conhecimento, so be ready to compute personnel-spending ratios against Receita Corrente Líquida, constitutional health and education floors, per-capita indicators, and simple ABC/Pareto inventory splits.
5Study the policy cycle with named frameworks: Kingdon's multiple streams, Lowi's policy typology, Lipsky's street-level bureaucrats, Pressman and Wildavsky on implementation, and the efficiency / efficacy / effectiveness distinction used in Brazilian monitoring and evaluation practice.
6Review current legislation rather than older summaries. Federal rules in this area change often — for example the civil-service quota regime was replaced by Lei 15.142/2025 — so confirm figures against the Planalto text before memorising them.

Frequently Asked Questions

What is the official format of the ENADE Gestão Pública exam?

Under Portaria Inep nº 354, de 28 de maio de 2025, the exam for cursos superiores de tecnologia has two components answered in one 4-hour session. Formação Geral has 15 questions, all multiple-choice. The Componente Específico for Tecnologia em Gestão Pública has 30 multiple-choice questions plus 1 discursive (written-response) question. That is 46 items in total, of which 45 are multiple-choice.

Is ENADE a pass/fail exam, and what is the Conceito Enade?

ENADE has no individual pass mark and no minimum score a student must reach. INEP standardises student performance and reports a course-level Conceito Enade on a 1-to-5 scale, weighting Formação Geral at 25% and the Componente Específico at 75%. That score feeds the MEC quality indicators for the course (CPC) and the institution (IGC). What is compulsory for the individual student is attendance and completion of the Questionário do Estudante, not a particular result.

Who has to sit ENADE Gestão Pública?

Participation is compulsory for selected concluintes of Cursos Superiores de Tecnologia em Gestão Pública — students expected to finish the course during the year of the exam, or who have already completed 75% or more of the minimum curriculum workload. Under art. 5º of Lei nº 10.861/2004 ENADE is a mandatory curricular component, so a student who is enrolled and fails to attend without an accepted justification stays irregular in the Sistema Enade and cannot graduate or receive the diploma until the situation is regularised.

How often is Gestão Pública assessed, and when was the last exam?

SINAES runs a three-year rotation of evaluation areas. Tecnologia em Gestão Pública belongs to the Year I (Ano I) group under Portaria Normativa MEC nº 840/2018, and was assessed in the Enade 2025 edition, applied on 23 November 2025. It was not among the areas assessed in Enade 2026 — Portaria MEC nº 276/2026 restricted that edition to Cine Brasil areas 5, 6 and 7 (natural sciences, computing and engineering) plus the licenciaturas and Enamed. Always confirm the current cycle in the INEP edital before relying on a date.

Is there any fee to sit ENADE?

No. ENADE is free for students. Registration is handled by the course coordinator or Procurador Institucional at the higher-education institution through the Sistema Enade, and the exam is funded by the federal government through MEC.

Can a Tecnólogo em Gestão Pública register with the CRA?

Graduates of MEC-recognised technology courses in administration-related fields, including Gestão Pública, can obtain professional registration with a Conselho Regional de Administração under the CFA/CRA system. That registration authorises practice in the specific technology field named on the diploma. It does not confer the title of Administrador and does not give access to positions or public-service competitions reserved for holders of the bacharelado em Administração. Check the current CFA normative resolutions and your regional CRA for the requirements that apply to your diploma.

Are these practice questions the same as the real ENADE exam?

No. The official exam is written and answered in Portuguese and includes a discursive item. This bank is an English-language multiple-choice study adaptation built from the official INEP content outline in Portaria Inep nº 354/2025 — it is not an official translation, not a released INEP exam, and it does not simulate the discursive component. Official names, statutes and Portuguese technical terms are kept in the original so you can recognise them on the real paper.
