1.1 TSBPE Laws, Board Rules, & Scope of Practice

Core Principle: In the State of Texas, plumbing is regulated as a vital public health and safety profession. Under Texas Occupations Code (TOC) Chapter 1301 (The Plumbing License Law) and Title 22 Texas Administrative Code (22 TAC) Part 17 (TSBPE Board Rules), no individual may install, alter, repair, service, or renovate plumbing systems without holding a current license or registration issued by the Texas State Board of Plumbing Examiners (TSBPE).

Statutory Authority & Board Governance

The Texas State Board of Plumbing Examiners (TSBPE) is the sole state agency authorized to administer and enforce the Plumbing License Law. The primary mandate of the Board is to safeguard the health, welfare, and physical safety of the citizens of Texas through rigorous licensing, examination, continuing education, and regulatory enforcement.

Board Composition

Under Texas Occupations Code Section 1301.151, the Board consists of nine members appointed by the Governor with the advice and consent of the Texas Senate:

• One licensed Master Plumber with at least 10 years' practical experience
• One licensed Journeyman Plumber with at least five years' practical experience
• One licensed Plumbing Inspector with at least five years' practical experience
• One Responsible Master Plumber who has served as an RMP for at least five years and has at least 10 years' experience as a licensed journeyman or master plumber
• One licensed engineer practicing in the field of plumbing engineering
• Two building contractors with at least five years' contracting experience — one principally in home building and one principally in commercial building
• Two public members, who are ineligible if they or their spouse are licensed in, employed by, or hold a financial interest in the building construction industry (Section 1301.152)

Every board member must be a United States citizen, and appointments are made without regard to race, color, disability, sex, religion, age, or national origin.

License Classifications & Experience Requirements

The TSBPE establishes a progressive licensing career ladder. Each classification defines the minimum verified on-the-job training hours, classroom education prerequisites, and authorized operational scope.

Scopes of Practice: Critical Exam Distinctions

Understanding the exact boundaries of what each license class can and cannot legally perform is heavily tested on the Texas Journeyman examination.

1. Plumber's Apprentice

• An apprentice is never permitted to perform plumbing work alone.
• An apprentice must be under the direct, on-the-job supervision of a licensed Journeyman or Master Plumber at all times when working on any plumbing system (or a Tradesman-Plumber Limited if working on a one- or two-family dwelling).
• The supervising plumber must be present on the same jobsite and readily available for instruction and inspection.

2. Tradesman-Plumber Limited

• The Tradesman license is strictly restricted to one- and two-family residential dwellings.
• A Tradesman cannot work independently on:
  • Commercial buildings (offices, retail, restaurants)
  • Multi-family residential structures containing three or more dwelling units (apartments, condominiums, townhome buildings with ≥ 3 units)
  • Industrial, institutional, or educational facilities
• On commercial or ≥ 3-unit multi-family jobsites, a Tradesman has the legal status of an apprentice and must have direct on-the-job supervision from a licensed Journeyman or Master Plumber.

3. Journeyman Plumber

• Authorized to perform and supervise plumbing on any structure, regardless of occupancy classification (high-rise commercial, hospitals, industrial plants, residential complexes).
• Works under the general supervision of a designated Responsible Master Plumber (RMP).
• Authorized to provide direct on-the-job supervision to registered apprentices and tradesmen.
• Limitation: A Journeyman Plumber cannot contract directly with the public, advertise plumbing services, or pull municipal plumbing permits without a Master license and an active RMP designation.

4. Plumbing Inspector

• Represents the Authority Having Jurisdiction (AHJ).
• Enforces adopted plumbing codes (such as the International Plumbing Code [IPC] or Uniform Plumbing Code [UPC] as amended by local ordinance).
• Conflict of Interest Rule: An inspector is legally prohibited from having any financial, supervisory, or contracting connection with any plumbing business while actively inspecting.

Specialty Endorsements

A licensed Journeyman or Master Plumber may expand their scope of practice by earning specialty endorsements through additional coursework and specialized examinations administered by the TSBPE.

1. Medical Gas Piping Installation Endorsement (Med Gas)

• Prerequisite: Active Journeyman or Master Plumber license + completion of a 24-hour Board-approved training course covering NFPA 99 (Health Care Facilities Code).
• Scope: Installation, repair, and maintenance of medical gas and medical vacuum piping systems in hospitals, surgical centers, dental clinics, veterinary surgical suites, and healthcare facilities.
• Non-endorsed plumbers are strictly prohibited from brazing, assembling, or testing any medical gas delivery piping.

2. Water Supply Protection Specialist Endorsement (WSPS)

• Prerequisite: Active Journeyman or Master Plumber license + completion of a 24-hour Board-approved WSPS training course.
• Scope:
  • Testing, rebuilding, and inspecting backflow prevention assemblies.
  • Conducting Customer Service Inspections (CSIs) for public water systems under Texas Commission on Environmental Quality (TCEQ) regulations.
  • Designing, installing, and servicing commercial and residential rainwater harvesting systems and graywater/reclaimed water distribution systems.

3. Multipurpose Residential Fire Protection Sprinkler Specialist Endorsement (MRFPSS)

• Prerequisite: Active Journeyman or Master Plumber license + completion of a 24-hour Board-approved course based on NFPA 13D.
• Scope: Installing, altering, and repairing integrated multipurpose residential fire protection sprinkler piping systems in one- and two-family dwellings.
• Distinction: Plumbers with this endorsement install combined potable water/fire sprinkler loops in single-family homes; standalone commercial sprinkler systems remain under the jurisdiction of the State Fire Marshal.

License Renewal & Mandatory Continuing Education (CPE)

Maintaining an active plumbing license in Texas requires strict adherence to annual renewal deadlines and education requirements:

1. 12-Month Renewal Cycle: All plumbing licenses and registrations expire annually. Licensees must submit their renewal application and fee before the expiration date.
2. 6-Hour Annual CPE Requirement: Every licensed Tradesman, Journeyman, Master, and Inspector must complete a 6-hour Board-approved Continuing Professional Education (CPE) course every year prior to renewal.
3. CPE Curriculum: The Board publishes new course materials annually, covering code updates, legal updates, OSHA standards, water conservation technologies, and Texas administrative changes.
4. Expired License Penalties:
   • Expired ≤ 90 days: Renewal fee + 1.5× the standard renewal fee penalty.
   • Expired 91 days to 2 years: Renewal fee + 2× the standard renewal fee penalty.
   • Expired >2 years: The license cannot be renewed. The individual must re-apply, pay all initial fees, meet current prerequisites, and retake and pass the state examination.
