Withholding Taxes, EOPT Compliance, and Special Tax Laws

Much of Philippine tax collection happens through withholding at source, and the Ease of Paying Taxes (EOPT) Act reshaped compliance from 2024. Taxation also covers special laws that CPAs apply in practice, such as the senior citizen and PWD discounts and the BMBE Act, and the reconciliation of accounting income with taxable income. This section brings those topics together.


1. The Withholding Tax System

Common expanded withholding rates (RR No. 2-98, as amended):

  • Professional fees paid to individuals: 5% if gross income for the year does not exceed PHP 3,000,000 and the payee submits a sworn declaration; otherwise 10%.
  • Professional fees paid to juridical persons: 10% if gross income does not exceed PHP 720,000; otherwise 15%.
  • Rentals of real and personal property: 5%. Payments to contractors: 2%.
  • Purchases by top withholding agents: 1% on goods and 2% on services from regular suppliers.

Key forms: BIR Form 2307 certifies creditable tax withheld and 2306 certifies final tax withheld; 2316 is the employee's certificate of compensation and tax withheld; 1601-C (monthly, compensation), 0619-E and 1601-EQ (expanded), and 1601-FQ (final) are remittance returns; annual information returns are the 1604-C, 1604-E, and 1604-F.

Liability of the withholding agent: A withholding agent who fails to withhold or remit is personally liable for the tax not withheld, plus penalties, and the expense on which tax was not withheld may be disallowed as a deduction.


2. The Ease of Paying Taxes (EOPT) Act (RA 11976)

The EOPT Act took effect on January 22, 2024. Its main changes are:

3. Senior Citizens and Persons with Disabilities

Under RA 9994 (Expanded Senior Citizens Act) and RA 10754 (for PWDs), qualified buyers get a 20% discount and a VAT exemption on specified goods and services for their exclusive use, such as medicines, medical and dental services, professional fees of physicians, transportation fares, hotels and restaurants, recreation, and funeral services.

Computation: remove the VAT first, then apply the 20% discount to the VAT-exclusive price. For a medicine with a VAT-inclusive price of PHP 1,120: VAT-exclusive price PHP 1,000; discount PHP 200; the senior citizen pays PHP 800.

Tax treatment for the seller: The establishment claims the discount as a deduction from gross income (not a tax credit), provided it keeps the required records, and it does not charge output VAT on the exempt sale.


4. Barangay Micro Business Enterprises (RA 9178)

A BMBE is a business enterprise with total assets of not more than PHP 3,000,000, excluding the land on which its office, plant, and equipment are located. Once registered (with the DTI through Negosyo Centers), it is exempt from income tax on income arising from its operations. It remains subject to VAT or percentage tax and must still register with the BIR, keep books, and file returns.


5. Reconciling Accounting Income and Taxable Income

Accounting profit under PFRS rarely equals taxable income. Permanent differences never reverse (for example, income subject to final tax, exempt dividends, and non-deductible expenses), while temporary differences reverse over time (for example, provisions that are deductible only when written off or paid) and give rise to deferred taxes under PAS 12.

A domestic corporation reports accounting income of PHP 2,000,000, which includes bank interest income of PHP 80,000 (subject to 20% final tax), dividends of PHP 150,000 from a domestic corporation, entertainment expenses of PHP 40,000 above the ceiling, a PHP 60,000 provision for expected credit losses with no accounts written off, and interest expense of PHP 100,000.
