7.1 Community Pharmacy Permits, Pharmacist-in-Charge (PIC) Duties & Staffing

Key Takeaways

  • Mississippi community pharmacy permits renew biennially and expire December 31 of the registration period; pharmacist licenses remain on their separate annual cycle.
  • A community PIC is physically present at least 20 hours per week or 50% of the pharmacy’s operating hours, whichever is less.
  • A pharmacist may serve as PIC of only one community pharmacy or Institutional I pharmacy unless the Board grants a waiver.
  • A PIC change requires Board notice and a complete controlled-substance inventory at the change; the permit and PIC transition steps must be completed on time.
  • The pharmacy is physically secured when no pharmacist is present, and community staffing may not exceed three technicians per pharmacist.

Community Pharmacy Permits and PIC Duties

A community pharmacy needs a current Mississippi Board permit and a designated pharmacist-in-charge. The permit belongs to the permitted person and location; it is not freely transferred to a buyer, new address, or new PIC.

Permit cycle

Current Article VI uses a biennial community-pharmacy permit cycle ending December 31 of the registration period. Do not call the pharmacy permit annual merely because an individual pharmacist renews a license annually. A newly issued permit’s first renewal date depends on when in the registration period it was issued.

A new or relocated pharmacy is inspected and approved through the Board process before operation. Changes of name, location, ownership, closure, or permit holder invoke advance application or notice rules. Once issued, a permit cannot simply be amended, assigned, or transferred as though it were a business asset.

PIC eligibility and presence

A community pharmacy identifies a Mississippi pharmacist as PIC. The PIC is physically present at least 20 hours per week or 50% of the pharmacy’s operating hours, whichever is less. For a pharmacy open 30 hours, the requirement is 15; for one open 80 hours, it is 20. “Whichever is less” is the arithmetic trap.

A pharmacist may be PIC of only one community pharmacy or Institutional I pharmacy unless the Board grants a waiver. Corporate ownership or nearby locations do not erase that personal responsibility.

PIC transition

When a PIC relinquishes responsibility, the Board and permit process must be updated as Article VI requires. A complete inventory of controlled substances is taken at the time of the change, signed, retained, and sent to the Board under Article XXV. The incoming PIC should independently verify permits, registrations, controlled inventory, records, staffing, security, expired drugs, policies, and unresolved losses rather than accept an undocumented handoff.

If the outgoing PIC fails to notify, the rule can place notification responsibility on the incoming PIC. A store cannot continue indefinitely under the former PIC’s name while management searches for a replacement.

Security and staffing

When no pharmacist is present and other business continues on the premises, the pharmacy is physically secured from those activities by a barrier capable of detecting entry. Pharmacy dispensing and release do not continue through technicians alone. The on-duty pharmacist is responsible for effective control against theft and diversion.

Mississippi allows no more than three pharmacy technicians per pharmacist. Registered interns are a separate personnel category, and purely clerical employees are excluded when they perform only clerical work. The PIC ensures registration, background status, training, scope, and supervision.

Operational accountability

The PIC develops and enforces policies for prescription intake, DUR, counseling, final verification, controlled-substance records, PMP, procurement, recalls, temperature, compounding where offered, errors, security, access, closing, and disaster continuity. Being PIC does not make the pharmacist the only person liable for every violation: each pharmacist remains accountable for that pharmacist’s own professional acts, while owners and permit holders retain their duties.

Records must be retrievable at the permitted location as required. The PIC should monitor renewals for the permit, DEA registration, facility and individual controlled-substance registrations, pharmacist licenses, technician registrations, and any special permits.

Exam method

Separate the cycles and actors. Pharmacy permit: biennial. Pharmacist license: annual. PIC presence: 20 hours or 50%, whichever less. PIC sites: one absent waiver. Technician ratio: 3:1. PIC change: inventory and Board transition. No pharmacist: secure and cease dispensing operations.

Presence and transition examples

A pharmacy open 36 hours requires 18 PIC hours because half the schedule is less than 20. A pharmacy open 100 hours requires 20, not 50. Vacation coverage by another pharmacist keeps the pharmacy operating but does not silently transfer PIC responsibility or waive the presence formula over the applicable period.

During a PIC change, count controlled stock at the actual transition, reconcile perpetual or system balances, copy the inventory to the Board as required, and document keys, alarm access, unresolved recalls, records, and credentials. If the outgoing PIC refuses to cooperate, the incoming PIC still addresses the Board-notification duty instead of accepting an unsafe undocumented handoff.

The PIC’s oversight includes ensuring that policy matches current law. A corporate manual stating annual permit renewal or a 2:1 technician ratio should be corrected, staff retrained, and schedules audited instead of followed because headquarters approved it.
