Mississippi State Board of Pharmacy: Structure and Authority

The Mississippi State Board of Pharmacy administers the Pharmacy Practice Act. Distinguish the Legislature, which enacts statutes, from the Board, which implements delegated authority through regulations, licensing, permitting, inspections, and adjudication. A Board rule cannot override a statute, and informal guidance should not be treated as a rule unless it has legal force.

Composition and appointment

Under Miss. Code Ann. § 73-21-75, the Board has seven appointed members. At least one appointment must be made from each congressional district, using the districts as they existed on July 1, 2001. The statutory posts include the historical district posts and statewide posts. The Governor appoints each member with the advice and consent of the Senate.

The nomination detail is testable: appointment is made from a list of five names submitted by the Mississippi Pharmacists Association through the process described in the statute, with input from the listed pharmacist organizations and other pharmacist associations or societies. “At least three nominees” is not the current statutory number.

A full Board term is five years. A person may serve no more than two full terms during any fifteen-year period. A vacancy is filled by gubernatorial appointment for the balance of the unexpired term through the statutory nomination process. The Act also supplies time frames for nominations and filling vacancies.

The Board elects a president and any other officers it considers necessary. It meets at least once each quarter and may hold additional meetings. A majority of the seven members constitutes a quorum, and Board action is by a majority. Missing two consecutive meetings for a reason other than illness can subject a member to removal, but removal includes the statutory opportunity to respond to charges.

Delegated powers

The Board issues and renews pharmacist licenses, intern/extern and technician registrations, controlled-substance registrations, and permits for pharmacies and other regulated facilities. It may inspect permitted premises, examine required records, investigate complaints, and take disciplinary action after the process authorized by law. It also adopts regulations needed to carry out the Act, sets standards within delegated bounds, and employs an executive director and staff.

Identify the source and limit of power. The Board may investigate and sanction violations of the Act or its valid rules, but it cannot create a criminal offense or expand a profession's scope beyond statutory authority merely through informal preference. Federal agencies retain separate jurisdiction: DEA registration does not replace a Mississippi controlled-substance registration, and an FDA requirement does not replace a Mississippi pharmacy permit.

Enforcement and due process

Inspection and investigation are not the same as final discipline. A complaint can lead to record review, interviews, or an administrative case. Except for lawful emergency action, the respondent receives notice and an opportunity for a hearing before final deprivation of a license or permit. A final Board order is subject to the appeal procedure in § 73-21-101.

The exam method is to ask: Who is acting, under what authority, and against whom? The Board regulates Mississippi licenses, registrations, and permits; the Legislature sets the statutory framework; courts review legal disputes; and federal agencies enforce federal law. That division prevents distractor errors in which one entity is assigned another's power.

Authority drill

Suppose an inspector identifies an unregistered technician, the Legislature has amended the technician statute, and an old pharmacy manual states a different ratio. The Board may inspect and bring an administrative case; the Legislature’s current statute controls over the manual; and the valid current Board rule supplies operational detail. The inspector does not personally issue a final revocation at the counter. This single scenario distinguishes statutory authority, agency investigation, evidence, and final Board adjudication. It also shows why candidates should verify effective dates in the current compilation rather than cite a superseded handout.
