Theft, Significant Loss, and Controlled-Substance Disposal

Loss reporting and disposal use different legal pathways. A shortage can be a theft, a significant unexplained loss, ordinary breakage, an administration waste, or unwanted stock. Classify the event before selecting a form.

Federal theft or significant loss

Under 21 CFR § 1301.76(b), a registrant that discovers theft or significant loss must provide initial written notice to its DEA Field Division within one business day. The registrant then completes DEA Form 106 electronically within 45 calendar days after discovery. The initial notice is not the completed Form 106, and the current 45-day completion deadline should not be replaced with the old shorthand “Form 106 within one business day.”

Whether an unexplained loss is significant depends on factors such as the quantity in relation to the business, drug involved, pattern, local diversion risk, and whether identifiable individuals are responsible. A confirmed theft is reported regardless of quantity. Preserve video, access, purchasing, dispensing, and inventory evidence, and notify law enforcement when appropriate.

Mississippi sequence

Board Article XXV adds three steps for a loss or suspected loss:

  1. report directly to the Mississippi Board of Pharmacy immediately upon discovery;
  2. complete a dated and pharmacist-signed inventory of all remaining controlled substances within 48 hours; and
  3. submit a written report to the Board within 15 days, including the required inventory.

The state rule does not make a copy of Form 106 a substitute for every required state detail unless the Board accepts it as the report. Nor should the guide add an automatic MBN-notification statement when Article XXV itself specifies the Board. Local police or MBN involvement may be prudent or required by another authority for a theft, but keep the cited Board rule accurate.

Breakage and spillage

A witnessed breakage or spillage that can be fully documented is generally not a theft or significant loss for Form 106. Record the drug, amount, circumstances, witnesses, and disposition so the audit trail balances. If circumstances suggest diversion or the amount becomes significant, use the reporting rules. Do not file a false theft report merely to document routine wastage.

Reverse distribution and destruction

Under Mississippi Article XXVI, a registrant may send expired, excess, or unwanted controlled substances to a reverse distributor holding both DEA and Mississippi Board registrations. Maintain disposal records for two years. DEA transfer and inventory requirements still apply; shipping stock away without an authorized recipient and records is not lawful destruction.

An institution may destroy the remainder of a prepackaged single dose or unit of use after part was administered when Article XXVI conditions are met. The record includes the drug; amount administered and destroyed; date and time; patient and room; person administering; signature of the pharmacist or nurse destroying; and signature of a second witness. A broken or contaminated unused unit generally returns to pharmacy control where possible, with documentation if return is impossible.

DEA Form 41 is associated with registrant destruction under applicable DEA procedures, not routine patient take-back receipts or every shipment to a reverse distributor. Ultimate users may use authorized collectors or take-back events; pharmacy stock remains registrant inventory and follows registrant disposal rules.

Exam method

Build two clocks. Federal: one business day initial written notice; 45 days Form 106. Mississippi: immediate Board report; 48-hour remaining-stock inventory; 15-day written report. Then decide whether the event is reportable loss, documented breakage, institutional waste, reverse distribution, or another authorized destruction.

Event classification exercise

Three crushed tablets witnessed during stocking are documented with drug, quantity, circumstances, witnesses, and authorized disposal; absent diversion or significance, they are not automatically Form 106 theft. Ten missing bottles with a broken door require the full theft response. An unexplained recurring shortage may become significant even if each daily difference is small because pattern is one DEA factor.

For unwanted pharmacy stock, use a registered reverse distributor and keep the two-year disposal trail. Do not place registrant inventory in a public take-back receptacle intended for ultimate users. For an administered institutional dose, use the patient-specific waste record and second witness rather than an inventory-only adjustment.

When the scope is initially uncertain, give timely notice based on known facts and continue the investigation; do not delay the one-business-day federal notice while waiting for the exact final quantity. The later Form 106 supplies the completed determination.
