1.1 Board, M.G.L. c. 142 & License Hierarchy

Who the Board is and what M.G.L. c. 142 does

The Board of State Examiners of Plumbers and Gas Fitters is the Examiners named in M.G.L. c. 142, § 1. It sits in the Division of Occupational Licensure (DOL). Mass.gov states the Board's job in operational terms: it conducts examinations and issues licenses for journeyman and master plumbers and gas fitters; registers apprentice plumbers and gas fitters; issues corporate and partnership certificates; holds public hearings on code changes; and accepts dual and elevated gases and plumbing and gas products.

Massachusetts General Laws Chapter 142 (M.G.L. c. 142), Supervision of Plumbing, is the statute. The Board's regulations at 248 CMR 3.00 through 11.00 supply the administrative and technical rules. 248 CMR 3.03(5) treats Chapter 142, together with those regulations, as occupying the whole field of plumber, gas-fitter, and undiluted liquefied petroleum gas installer licensing in Massachusetts. A city cannot invent a local gas-fitter-only rule that strips a journeyman plumber of the gas-fitting authority the statute already grants.

License hierarchy: who may do what

M.G.L. c. 142, § 3 forbids engaging in business as a master, working as a journeyman or apprentice, or advertising plumbing or gas fitting unless licensed. The PSI Candidate Information Bulletin (CIB) dated October 3, 2025 restates the journeyman plumber's scope as a person who does any work in plumbing and gas fitting subject to inspection. 248 CMR 3.02 supplies the apprentice definitions used on the job.

The exam trap is treating Massachusetts like a state that splits plumbing and gas into watertight licenses. M.G.L. c. 142, § 3 says a person licensed as a master plumber or a journeyman plumber may carry on the work of a gas fitter throughout the Commonwealth, notwithstanding any local ordinance, by-law, rule, or regulation to the contrary. The same section lets that plumber install house drainage and connect to common sewers without a separate local drain-layer license, while remaining subject to local permits and bonding.

Scenario. A Worcester two-family needs a water-heater replacement and a new gas valve. The employing master holds a plumbing business certificate. The journeyman plumber on the truck may install both the potable-water piping and the fuel-gas connections. A journeyman gas fitter on that same job may do the gas valve but may not cut into the potable water piping. An apprentice on the truck may help only while the supervising licensee is on site and present.

Business certificates versus a personal DBA

248 CMR 3.03(1) draws a bright line. Every corporation, limited liability company (LLC), partnership, limited partnership (LP), limited liability partnership (LLP), or professional corporation that has plumbing or gas-fitting employees must hold a Board business license — the certificate described in M.G.L. c. 142, § 3B. Individuals practicing under their own name or a DBA do not require a business license.

For a plumbing corporation, the applicant must be a master plumber who is a listed officer, and the Articles of Organization must support the plumbing or gas purpose. For a plumbing LLC, the applicant must be a master plumber who is a listed manager (a listed member counts if the LLC is member-managed), and plumbing must appear as a documented discipline on the Certificate of Organization. In a general partnership, LP, or LLP, all partners must be master plumbers (or master gas fitters for a gas-fitting partnership). Mass.gov lists the business certificate fee at $225. Out-of-state entities file the corresponding foreign certificate with the Secretary of the Commonwealth.

Two exceptions matter on the exam. A non-plumbing employer that uses licensed plumbers only on premises it owns or leases does not need a plumbing business certificate. A shop that does solely undiluted LP work does not need one if every worker holds the proper LP license (248 CMR 3.03(1)(b)).

The licensee of record must see that every worker is currently licensed and that the shop follows 248 CMR. If that master withdraws, the shop may continue for 60 days while a new master files, unless the Board denies the replacement. Discipline against the master of record is discipline against the business, and the reverse is also true. Apprentices are employees, not independent contractors. 248 CMR 3.03(2) treats Internal Revenue Service Form 1099 payments as evidence of contractor status, which is not creditable experience and can be charged as aiding unlicensed practice.

Advertising and display. Any sign, listing, or advertisement of a master or journeyman must contain the designation and license number (M.G.L. c. 142, § 3; 248 CMR 3.06(2)(e)). Apprentices may not solicit work by advertisement. Licenses are valid throughout the Commonwealth and are not assignable (M.G.L. c. 142, § 6). A master who wants to engage in business in a town must register name and business address with the inspector of buildings or the board of health; that local registration fee cannot exceed $20.

Renewal, continuing education, and inactive status

M.G.L. c. 142, § 6 issues licenses for two years, renewable on or before May 1. Mass.gov currently opens renewal on February 1 of every even-numbered year, with a May 1 filing deadline. Mail-in renewals are returned; use the eLIPSE (electronic Licensure and Permitting System for Everyone) portal. Journeyman plumber renewal is $52; master plumber $78; corporation or partnership $225; late renewals after May 1 add $57.

248 CMR 11.04 requires 12 clock hours of Board-approved continuing education for journeyman and master plumbers each two-year cycle, and six clock hours for journeyman and master gas fitters and undiluted LP installers. Apprentices do not complete this cycle. First-time licensees in the current cycle are exempt, except a journeyman who upgrades to master during that cycle still owes the hours. Inspectors, certain Board staff, instructors who taught the full requirement, active-duty military under M.G.L. c. 112, § 1B, and holders of an inactive license have separate exemptions. An inactive licensee may not practice, except plumbing and gas fitting in the licensee's owner-occupied single-family house under a valid permit.

Do not study IPC licensing tables, IPC contractor titles, or another state's split of plumbing versus gas. Massachusetts titles, hours, and gas authority come from M.G.L. c. 142 and 248 CMR 11.00, not from the IPC.
