Any motor vehicle operator or motorcyclist between 16½ and 18 is a Junior Operator. The license carries restriction code I. The Junior Operator Law exists to give new drivers supervised experience while keeping them away from the biggest teen crash risks: peer passengers, late-night driving and phones.

The Passenger Restriction

For the first six months after you receive a JOL, you may not drive while anyone under 18 is in the vehicle unless:

  • The passenger is you or an immediate family member, or
  • You are accompanied by a person who is at least 21, has at least one year of driving experience, holds a valid license from Massachusetts or another state, and sits beside you.

The restriction ends when you finish the six-month period or turn 18, whichever comes first.

Suspensions Pause the Clock; They Do Not Reset It

The six-month clock stops running during a suspension. When your license is reinstated, you serve the remainder of the restriction that was left when the suspension began, unless you have already turned 18. The statute uses the word "tolled", meaning paused.

The Night Restriction

Secondary enforcement does not make driving legal in those windows. It is still illegal to drive without a parent present. It only limits when police can enforce that part of the restriction.

Drivers under 18 may not use any mobile electronic device for any reason while driving, including hands-free calls, voice commands and texting. The only exception is reporting an emergency. Adults may use devices in hands-free mode (Section 3.3), but Junior Operators may not. A first conviction brings a 60-day suspension, a $100 fine, a new permit exam, the retraining course and a new road test.

Other JOL Rules

  • No driving any vehicle that requires a commercial driver's license (CDL).
  • A one-year suspension applies if you are under 18 when you commit certain driving offenses involving alcohol or drugs, in addition to court penalties. The period is 180 days for drivers aged 18 to 21.
  • Speeding suspends a JOL for 90 days on a first offense and one year after that.
  • Drag racing suspends a JOL for one year on a first offense and three years after that.
