The January 2025 California Board for Professional Engineers, Land Surveyors, and Geologists (BPELSG) Professional Land Surveyor (PLS) test plan places Direct personnel for office and field tasks (activity I.4) and Coordinate projects with third parties (activity I.5) in Domain I, Business Practices and Project Management. Independent OpenExamPrep teaching in this section is about who may make California land surveying decisions, who may only carry them out, and how you work with agencies, consultants, and contractors without handing your license to someone else.

Why personnel direction is a licensing problem

Business and Professions Code (BPC) section 8703 defines responsible charge of work as the independent control and direction, by the use of initiative, skill, and independent judgment, of the observations, measurements, and descriptions involved in land surveying work. The same section says the phrase does not refer to financial liability. BPC 8704 says a person practices land surveying when the person professes to be a land surveyor or is in responsible charge of land surveying work. BPC 8705 defines a subordinate as any person directly supervised by a licensed land surveyor or registered civil engineer who assists in the practice of land surveying without assuming responsible charge of work. BPC 8730(b)(2) exempts a subordinate from licensure only insofar as that person acts as a subordinate.

Title 16, California Code of Regulations (CCR) section 404.2 is the Board Rule that turns those statutes into an operational test. Responsible charge is the extent of control a licensed land surveyor, or a civil engineer legally authorized to practice land surveying, must keep while exercising independent control and direction of land surveying work and of the land surveying decisions that only that licensee may make. The licensee either makes those decisions or reviews and approves them, and, when using criteria or technical recommendations supplied by others, determines whether those recommendations apply before incorporating them.

16 CCR 404.2(a)(2) lists example land surveying decisions: selecting the methods, procedures, and tolerances of field work; determining calculation and adjustment methods; determining and specifying the information to be shown on maps or documents, including format; decisions related to preparing maps, plats, reports, descriptions, and other land surveying documents; and reviewing the sufficiency and accuracy of the work product. 16 CCR 404.2(a)(3) requires the licensee to be physically present or to review and approve those decisions through communication devices prior to their implementation. A night shift, an uncrewed aerial vehicle (UAV) flight that already happened, or a contractor who already built to unauthorized stakes is not a later rubber stamp.

16 CCR 404.2(e) is the trap list. Responsible charge is not financial liability; not mere management control in a hierarchy unless each person in that hierarchy actually exercises independent land surveying judgment; and not administrative functions such as accounting, labor relations, personnel performance standards, marketing of services, or goal setting. A crew chief who assigns trucks, a department manager who signs timesheets, and a partner who owns the firm can all fail the 404.2 test if they never made or approved the surveying decisions.

16 CCR 404.2(b) adds a practical check: the person who signs must be able to answer questions from another fully competent licensee in enough detail to leave little doubt about technical knowledge of the work. Example topics include measurement criteria, methods, analysis, retracement of government surveys, deed interpretation, conflicts between construction drawings and actual conditions, control datum and epoch, proportion methods, and evidence of written and unwritten property rights.

Crew chief, unlicensed technician, and Land Surveyor-in-Training

A crew chief is a job title, not a BPELSG license class. An experienced chief may run instrument setup, traffic control, and daily notes. That person remains a BPC 8705 subordinate unless the person is also the licensee who makes the 404.2 decisions. If the chief changes the control network, accepts a found pipe as a corner, or decides that a classified point cloud will become the map, the chief has assumed responsible charge.

An unlicensed technician may occupy points, fly a UAV under a Federal Aviation Administration (FAA) remote-pilot certificate, run a scanner, and draft. The technician may not offer land surveying, may not stamp, and may not be the person who selected methods and reviewed sufficiency. BPC 8761 requires maps, plats, reports, descriptions, and other land surveying documents to be prepared by or under the responsible charge of a licensed land surveyor or authorized civil engineer, and final documents must bear signature, seal or stamp, and date.

A Land Surveyor-in-Training (LSIT) is still a subordinate for responsible-charge purposes. LSIT certification is not a substitute for the PLS who must be able to answer the 404.2(b) questions.

Directing office and field tasks means assigning work and stating which decisions are reserved. Field reservations typically cover who occupies control, who searches monuments, who talks to the contractor about a conflict, and who may move a stake. Office reservations cover who reduces GNSS, who drafts, who writes the narrative, and who speaks to the county surveyor. Write those reservations into the kickoff, not after a file has left the office. BPC 8760 allows a licensed land surveyor or registered civil engineer to administer oaths to assistants for faithful performance when the importance of the survey makes it desirable. That is a personnel-direction tool, not a transfer of responsible charge.

BPC 8726(a)(2) includes determining the configuration or contour of the earth's surface, or the position of fixed objects, by applying mathematics or photogrammetry. BPC 8726(a)(13) includes creating, preparing, or modifying electronic or computerized data in that work. BPC 8726(a)(14) includes rendering a statement regarding the accuracy of maps or measured survey data. A UAV topographic map is not an aviation hobby product; it is land surveying when those functions are performed.

Worked example: UAV topographic survey

A city hires your firm for a 38-acre topographic survey of a storm-basin site. The proposal calls for a UAV surface, one-foot contours, hardscape, and invert shots on visible drainage structures, in the city's specified horizontal and vertical datums. The field supervisor holds an FAA Part 107 remote-pilot certificate. The PLS is in another county that week.

A lawful plan keeps the licensed PLS in responsible charge:

  1. Before anyone flies, the PLS selects methods, procedures, and tolerances: flying height, overlap, sensor, GNSS processing, and the ground-control and check-shot scheme. In this teaching scenario the PLS specifies nine targeted ground-control points, fifteen independent check shots that will not be used in the adjustment, and a contour interval and spot-elevation density that match the city's mapping standard.
  2. The PLS determines calculation and adjustment methods (photo-control adjustment, geoid model, any grid-to-ground handling) and what the delivered drawing will show versus what stays in a classified point cloud.
  3. The PLS reviews sufficiency and accuracy: check-shot residuals against the stated tolerance, voids under canopy, water surface, and whether breaklines were extracted by a rule the PLS approved.
  4. 16 CCR 404.2(a)(3) allows the PLS to review and approve those decisions by phone, video, or other communication devices, but the approval must occur before the decisions are implemented. Approving the flight plan on Monday and the extraction rules before mapping starts is control. Signing a finished drawing on Friday after the city already used the file is not.
  5. BPC 8761 still requires the PLS name and license number on the documents, and a signature and seal on the final topographic map or report.

Unlawful shortcuts include treating the Part 107 pilot as the surveyor of record because the pilot flew, treating UAV processing as ordinary CAD production, or listing the PLS on an Organization Record while that person never saw the control or the checks. FAA authority to fly is not California authority to practice land surveying. The January 2025 test plan lists UAV under equipment capabilities (knowledge I) and aerial-mapping preparation (knowledge K). This chapter stays at the management layer: who decides, who checks, who stamps. Flight-line geometry and sensor operation belong in Field Operations chapters.

Coordinating third parties without giving away the license

Activity I.5 is coordinate with agencies, consultants, and contractors. BPC 8726(a)(11) states that coordinating the work of professional, technical, or special consultants in connection with authorized land surveying activities is itself the practice of land surveying. Coordination is communication and sequencing. It is not a vote that overrides 404.2.

Public agencies themselves need a designated person in responsible charge. BPC 8725.1 states legislative intent that private-sector licensure requirements also apply to the state and to cities, counties, and districts, so at least one person authorized to practice land surveying shall be designated in responsible charge of professional land surveying work in any such department or agency. BPC 8726(c) requires governmental review, approval, or examination of 8726 documents to be done by, or under the direct supervision of, a person authorized to practice land surveying. When you coordinate with a city survey counter, ask who that designee is. A permit technician is not the substitute.

Knowledge J on the test plan is interpretation of elements in construction plans and specifications pertaining to staking. At this chapter's personnel layer you assign who reads the typical section, who computes the catch, and who stops work when the plan set and existing monumentation disagree. 16 CCR 404.2(b) uses conflicts between construction drawings and actual conditions as an example question the person in responsible charge must be able to answer. A superintendent's request for red-tops is not authority to ignore the plan datum, the basis of bearings, or a missing benchmark.
