1Which principle means that public authorities may do only what the law expressly empowers them to do, unlike private persons, who may do anything the law does not prohibit?
A.Principio de autonomía de la voluntad
B.Principio de reserva de ley
C.Principio de buena fe administrativa
D.Principio de legalidad
Explanation: The principle of legality, grounded in Articles 14 and 16 of the Constitution, requires every act of authority to rest on an express legal power and to be founded and motivated. Authorities have only the competences the law grants them, whereas private persons may do whatever the law does not forbid.
2After the constitutional reform published on 20 December 2024 that eliminated several autonomous bodies, which of the following remains an autonomous constitutional body?
A.Comisión Federal de Competencia Económica (COFECE)
B.Servicio de Administración Tributaria (SAT)
C.Instituto Nacional Electoral (INE)
D.Secretaría Anticorrupción y Buen Gobierno
Explanation: Article 41, section V, Apartado A of the Constitution defines the INE as an autonomous public body with its own legal personality and assets. The December 2024 reform eliminated bodies such as COFECE and the IFT and gave their competition and telecommunications functions to the Federal Executive (Article 28). Bodies like Banco de México and the CNDH also keep their autonomy.
3Under Article 3 of the Ley Federal de Procedimiento Administrativo, which of the following is an element and requirement of an administrative act?
A.It must be issued by a competent organ, in writing with the authority's signature, and be founded and motivated
B.It must be published in the Diario Oficial de la Federación before it can take effect against anyone it concerns
C.It must be confirmed by a court before it becomes enforceable against the individual
D.It may be issued by any public servant, as long as its content benefits the individual
Explanation: Article 3 of the LFPA lists the elements and requirements of the administrative act. They include issuance by a competent organ, a lawful and determined object, a public-interest purpose, written form with the issuer's autograph signature (unless the law allows otherwise), and being founded and motivated. It must also follow the LFPA procedure, identify the issuing organ and state the place, date and available remedies.
4Which conduct is a falta administrativa grave under the Ley General de Responsabilidades Administrativas?
A.Filing the annual declaration of assets and interests late, after the statutory deadline
B.Demanding or accepting, because of one's functions, a benefit outside one's remuneration (cohecho)
C.Failing to observe the dependency's code of ethics in dealings with the public and colleagues
D.Failing to properly safeguard the documents and information under one's responsibility
Explanation: Article 51 of the LGRA classifies the conduct in Chapter II of Title Three as grave faltas, starting with cohecho in Article 52: demanding, accepting, obtaining or trying to obtain any benefit not included in one's remuneration. Other grave faltas include peculado, desvío de recursos públicos, abuse of functions and enriquecimiento oculto.
5Which authority resolves administrative-liability proceedings for faltas graves committed by servants of the federal public administration under the LGRA?
A.The órgano interno de control, which resolves both grave and non-grave faltas
B.The Suprema Corte de Justicia de la Nación
C.The Tribunal Federal de Justicia Administrativa
D.The servant's direct supervisor
Explanation: Under Article 10 of the LGRA, the Secretarías and órganos internos de control investigate, substantiate and classify faltas, and they resolve the non-grave ones. For grave faltas, the substantiating authority sends the file to the Tribunal Federal de Justicia Administrativa, which resolves and imposes the sanctions. Servants of the federal judiciary follow their own disciplinary regime.
6What is the difference between juicio político (Article 110 of the Constitution) and declaración de procedencia (Article 111)?
A.Juicio político removes immunity so ordinary courts can try the official, while declaración de procedencia imposes removal and disqualification
B.Juicio político leads to removal and disqualification; declaración de procedencia decides whether criminal proceedings may go ahead
C.Both are decided exclusively by the Senate, sitting as a jury after hearing the accused
D.Declaración de procedencia is decided by the Suprema Corte de Justicia de la Nación, sitting in Pleno
Explanation: Under Article 110, the Chamber of Deputies accuses the official before the Senate, which sits as a jury of judgment; the only sanctions are removal from office and disqualification. Under Article 111, the Chamber of Deputies declares by an absolute majority of the members present whether there are grounds to proceed criminally against officials with immunity. It does not decide guilt, which remains for the ordinary criminal courts.
7Which principles govern the obligation to contribute to public expenses under Article 31, fraction IV of the Constitution?
A.Universality, interdependence, indivisibility and progressivity
B.Proportionality, equity, legality and allocation to public expenditure
C.Annuality, specialty and unity of the budget
D.Efficiency, effectiveness, economy, transparency and honesty
Explanation: Article 31-IV requires Mexicans to contribute to public expenses of the Federation, the states, Mexico City and the municipalities where they reside, in a proportional and equitable manner as the laws provide. The Supreme Court derives from it the principles of tax proportionality, equity, legality and allocation of revenue to public expenditure.
8A taxpayer does not pay a tax debt that has become enforceable. Through which procedure does the tax authority collect it by coercive means under the Código Fiscal de la Federación?
A.The recurso de revocación
B.The juicio contencioso administrativo before the TFJA
C.The visita domiciliaria
D.The procedimiento administrativo de ejecución
Explanation: Under Articles 145 and following of the CFF, the tax authority enforces unpaid, enforceable tax debts through the procedimiento administrativo de ejecución (PAE). It includes a demand for payment, attachment of assets and, if necessary, an auction (remate). This is the authority's power of economic coercion.
9Within what period must an individual file a juicio contencioso administrativo federal (demanda de nulidad) against a resolution under Article 13, fraction I of the Ley Federal de Procedimiento Contencioso Administrativo?
A.Fifteen business days after notification of the resolution takes effect
B.Thirty business days after notification of the resolution takes effect
C.Forty-five business days after notification of the resolution takes effect
D.Five years after the resolution was issued, whatever the date of notification
Explanation: Article 13-I of the LFPCA sets a period of thirty days, counted as business days under Article 74, after notification of the challenged resolution takes effect. The same period applies from the entry into force of a self-executing general administrative act. The five-year term applies only when the authority sues to annul a resolution favorable to an individual (juicio de lesividad, Article 13-III).
10Under Article 134 of the Constitution and Article 35 of the Ley de Adquisiciones, Arrendamientos y Servicios del Sector Público published on 16 April 2025, how are federal acquisitions awarded as a general rule?
A.By adjudicación directa, which the new law made the general rule for all agencies
B.By invitación a cuando menos tres personas, chosen by the agency
C.By licitación pública, through a public call for freely submitted proposals
D.By diálogo competitivo, which any agency may now use at its own discretion
Explanation: Article 134 of the Constitution requires public acquisitions to be awarded, as a general rule, through public tenders that secure the best conditions for the State. Article 35 of the 2025 LAASSP repeats that rule: acquisitions are awarded through licitaciones públicas with a public call. Direct awards, invitations and the new procedures are exceptions that must be justified.

EGEL Plus Derecho: Suggested Study Strategy

1Study by subarea: the guide assigns 22 items to rights and obligations, 21 to public-law litigation and 19 to private-law litigation, so these deserve the most time.
2Review the Ley de Amparo as reformed in 2025, including interés legítimo, improcedencia, suspension and the recursos de revisión and queja.
3Master the CNPP's alternative solutions and early termination: acuerdos reparatorios, suspensión condicional del proceso and procedimiento abreviado.
4Learn the registry principles (prioridad, tracto sucesivo, rogación, especialidad, fe pública registral) and the difference between escrituras and actas.
5Know recent legal changes, such as the 2024 judicial reform, the elimination of several autonomous bodies and the 2026 reduction of the working week, but note that the guide says items may still reflect the pre-reform rule for up to one year after a change.

Frequently Asked Questions

What is the EGEL Plus Derecho (EGEL Plus DERE)?

It is Ceneval's Examen General para el Egreso de la Licenciatura for law graduates. It assesses the disciplinary knowledge and skills considered essential at the end of a law degree, organized in three areas (función pública, litigio, and justicia alternativa y fe pública), plus transversal Spanish reading and writing skills.

How many questions are on the exam and how long does it take?

The exam has 200 items, mostly three-option multiple choice, including about 15% unscored pilot items. It is given in two sessions of four and a half hours each on the same day, nine hours in total, and no reference materials are allowed.

How is the EGEL Plus DERE scored?

Each area and section is reported on the Índice Ceneval from 700 to 1300: 1000-1149 is Satisfactorio and 1150-1300 is Sobresaliente. The global result depends mainly on the disciplinary section, and a Satisfactorio or Sobresaliente global result earns a digital Testimonio de desempeño. Each university decides how the result counts toward graduation.

Who can take the exam?

Graduates of a Licenciatura en Derecho or related program who have completed 100% of their credits, whether or not they hold the degree, and final-semester students when their institution requests it.

Why is this practice bank in English with four answer options?

OpenExamPrep publishes an English-language MCQ study adaptation to help candidates review the legal content of the disciplinary areas; Spanish legal terms and names are kept. The official Ceneval exam is in Spanish with three-option items, so this bank is not an official translation, a format simulation, or practice for the Spanish reading and writing section.
