5.5 Day Trading and the Intraday Margin Transition
Key Takeaways
The new intraday framework became effective June 4, 2026.
Firms can phase in the framework through October 20, 2027.
A flat closing position does not eliminate intraday margin exposure.
Day Trading and the 2026 Intraday Margin Transition
A day trade generally opens and closes a position in the same security on the same day in a margin account. Intraday trading creates exposure even when the closing position is zero. Operations must identify the firm’s implemented margin framework and applicable effective dates.
FINRA Notice 26-10 adopted a new intraday-margin framework effective June 4, 2026, with firms permitted to phase in implementation through October 20, 2027. The new framework replaces the former pattern-day-trader provisions. As of October 2026, it is incorrect to describe the change as merely proposed, or to assume every firm has already migrated.
Under the former framework during permitted transition, the pattern-day-trader test generally concerns four or more day trades in five business days, subject to the rule’s 6% condition and other provisions. A designated pattern day trader generally needs $25,000 minimum equity, with buying-power and call restrictions. These are transitional legacy controls, not a new universal $25,000 condition after migration.
The new framework instead measures intraday margin level and intraday margin deficits for covered accounts after transactions that reduce the available margin level. It supplements regular maintenance requirements rather than replacing them. The ordinary $2,000 margin-equity rule and security-specific requirements remain relevant. A customer who can day trade with less than $25,000 does not have unlimited buying power.
Real-time monitoring and preventive blocks are permitted approaches, but the rule does not universally require a broker to recalculate every account in real time. A firm may use a compliant single end-of-day deficit calculation. Preserve sufficient transaction sequence, prices, deposits, withdrawals and positions to support the method. Where order cannot be demonstrated, the applicable rule requires conservative ordering assumptions.
A deficit must be satisfied as promptly as possible. Notice 26-10 describes a 90-calendar-day restriction when a customer makes a practice of failing to satisfy deficits promptly and a deficit remains unsatisfied at the end of the fifth business day, subject to its conditions and exceptions. Do not replace those conditions with an automatic freeze for any tiny intraday deficit. Do not confuse this with cash-account freeriding or an initial Regulation T call.
Consider a customer whose account begins and ends a day flat but carries a large financed equity position midday. The closing position alone does not measure the intraday risk. The firm must apply its implemented framework, identify any applicable deficit/call, communicate the requirement and preserve the calculation. Deleting the midday position from a report because it was later sold would hide the exposure.
For a simple maintenance illustration, a $40,000 ordinary long-equity position at a 25% maintenance assumption needs $10,000 equity. An account with $8,000 equity is $2,000 below that assumption. Actual intraday calculations can incorporate other positions and the rule’s permitted timing treatments; this illustration is not a complete intraday methodology.
When solving an exam scenario, first identify whether it states a legacy PDT rule, the new intraday framework or a firm house requirement. Then distinguish initial buying power, maintenance equity, intraday exposure and payment deadlines. A policy more conservative than the regulatory minimum can still bind the customer under the agreement. Escalate a disputed margin instruction rather than allow an unauthorized override to make the account appear compliant.

Buying-power and Exception Review
Legacy day-trading buying power is not interchangeable with ordinary Regulation T buying power or the new intraday-margin level. A customer’s displayed available-to-trade amount may also reflect house restrictions, unsettled credits or nonmarginable securities. Confirm the calculation source before approving an order.
After migration, preserve the implemented methodology and the transaction data needed to reproduce a deficit. If an as/of correction changes the intraday sequence, evaluate whether the applicable prior deficit must be recomputed. Do not allocate a correction to a convenient timestamp merely to reduce the requirement.
For a practice problem using the legacy four-times-maintenance-excess assumption, $12,000 of qualifying maintenance excess would imply $48,000 before other limitations. That is an explicitly legacy example; it is not a general four-times rule for every account under the new framework. The current task is to recognize the applicable framework, then apply its calculation and conditions.
A disputed intraday call should go to the margin supervisor with positions, times, funding and house-policy details. Customer experience or trading profitability does not waive an unsatisfied requirement.
Operational Check
- The new intraday framework became effective June 4, 2026.
- Firms can phase in the framework through October 20, 2027.
- A flat closing position does not eliminate intraday margin exposure.
