3.6 Pesticide Businesses, Dealers, Solicitors & Financial Responsibility

An individual commercial applicator license is only half the compliance picture. Ohio also licenses the company. ODA puts it directly: a Pesticide Business License is required in Ohio for anyone applying pesticides for hire, soliciting pesticide application services, or performing wood-destroying insect (WDI) inspections - even when no treatment is planned.

The Pesticide Business License

ORC 921.09 prohibits owning or operating a pesticide business without a license from the director.

The registered location change

Ohio's previous budget bill, HB 96, effective October 1, 2025, eliminated the "registered location" type of pesticide business license, and every business previously licensed as a registered location was converted to the Pesticide Business license type. Study material published before late 2025 still describes registered locations as a separate class; treat that as historical.

The Pesticide Dealer License

ORC 921.13 and OAC 901:5-11-06 license pesticide dealers. A dealer license is required to distribute restricted use pesticides to the ultimate user, and ORC 921.24(R) and (S) make it a prohibited act to sell RUPs without a dealer license or to sell them to an unlicensed ultimate user.

Dealer obligations are the mirror image of the applicator's:

  • Verify the buyer's license and the pesticide-use categories on it before the sale.
  • Keep the sales record at the registered location for at least three years (OAC 901:5-11-10(D)).
  • Compile the annual July 1 - June 30 RUP sales report and retain it three years. ODA has announced dealers no longer need to annually submit the report to the department, but the record must remain available on site for inspector review.

The Solicitation License

A pesticide solicitation license covers a person who solicits pesticide application services - the sales role, distinct from applying. ODA's company license application form covers business, dealer, and solicitation licenses together at $35 for the same October-to-September period. A business whose activities are limited to acting as a pesticide solicitor is exempt from the general financial responsibility requirement in OAC 901:5-11-07(B).

Financial Responsibility (OAC 901:5-11-07)

ORC 921.10 requires an effective liability insurance policy or other evidence of financial responsibility. The rule sets the numbers.

Who must carry paragraph (B) coverage

All pesticide businesses except those whose activities are limited to: conducting WDI diagnostic inspections; application of boat antifoulants; seed treatment; or acting as a pesticide solicitor.

Paragraph (B) limits - general pesticide business

Every covered business must have a commercial general liability policy and either a separate professional liability policy or an endorsement covering properties under the business's care, custody, and control, for each category in which its commercial applicators are licensed. The policy must cover each registered location and provide coverage for bodily injury, property damage, products, and completed operations, plus third-party claims, with minimum limits of:

  • $300,000 policy general aggregate
  • $300,000 per occurrence
  • $300,000 products and completed operations aggregate

Paragraph (C) - wood-destroying insect diagnostic inspection

A business licensed in Category 12 must add a specific liability policy or endorsement covering errors and omissions in performing WDI diagnostic inspections, with minimum limits of:

  • $100,000 policy general aggregate
  • $50,000 per occurrence

Paragraph (D) - aerial pest control

A business conducting aerial applications must carry a comprehensive chemical liability policy covering bodily injury, property damage, products, and completed operations, with minimum limits of:

  • $100,000 property damage coverage per occurrence
  • $100,000 bodily injury (excluding passengers) per person
  • $300,000 bodily injury (excluding passengers) per occurrence

Paragraph (E) - the certificate

Every applicant submits with the license application a certificate of insurance or binder naming the issuing company and its address, the insured pesticide business and its address, and the address of each registered location associated with the business. ODA maintains a dedicated address for insurance documents, PesticideInsurance@agri.ohio.gov.

Putting It Together

A residential pest control company in Ohio needs, at minimum: a pesticide business license ($35, Oct 1 - Sept 30) with proof of $300,000/$300,000/$300,000 coverage; at least one licensed commercial applicator on staff in the relevant categories; written trained serviceperson training verification for every unlicensed technician; and, if it performs real estate WDI inspections, a Category 12 applicator plus the extra errors-and-omissions coverage.
