8.3 School Vehicles, MV-527, Required Equipment & Practical Instruction
Key Takeaways
- Current MV-527 lists school vehicles and is filed with an application and whenever a vehicle is added, dropped, or replaced; the stamped copy is carried for school business and road tests.
- Part 76 requires restraints, an additional instructor mirror, dual foot-brake controls, and STUDENT DRIVER signs with letters at least two inches high and a one-quarter-inch stroke.
- Part 76 does not create the invented six-month/10,000-mile inspection schedule or $100,000/$300,000/$50,000 insurance formula claimed in the original guide.
Report and Equip Every School Vehicle
Part 76 §76.11 says a vehicle owned or controlled by a school may not be used for instruction until the required vehicle information is reported. Current form MV-527 is the List of Driving School Vehicles. It is submitted with each school-license application and whenever a vehicle is added, dropped, or replaced.
The October 2025 MV-527 instructions say school vehicles must be registered in the school's name, all vehicles representing the school must be listed, and the stamped approved copy must be carried whenever the vehicle is used for school business. A stamped copy is presented at road-test appointments. The form also requires specified exterior and interior photographs and certification of insurance, equipment, advertising compliance, and lawful operation.
Equipment under §76.11
Except for the regulation's stated vehicle-class distinctions, school vehicles must have:
- seat belts for the student and instructor or an approved passive restraint;
- an additional rear-view mirror for the instructor;
- an additional instructor side-view mirror when operation requires a Class A, B, or C license;
- dual controls on the foot brakes; a school tractor-trailer combination may instead use a device such as a trolley brake that allows the instructor to halt the combination; and
- STUDENT DRIVER signs visible from front and rear.
The sign letters must be no less than two inches high with a one-quarter-inch stroke on a contrasting background. The complete words STUDENT DRIVER must be visible and unobstructed. A compliant roof sign, front and rear signs, or front and rear bumper stickers may be used as described by the regulation.
The original guide incorrectly cited nonexistent §§76.13 and 76.14, increased the letters to three inches, and invented special insurance limits and a six-month/10,000-mile inspection cycle. Part 76's table of contents moves from §76.12 to §76.15; those claimed sections do not exist in CR-76. School vehicles must be properly insured and must satisfy ordinary New York inspection and roadworthiness rules, but do not attach an unsupported numeric formula to Part 76. New York's general program requires registered vehicles to be inspected at least every 12 months.
| Item | Actual source requirement |
|---|---|
| Vehicle list | Current MV-527; update for additions, drops, replacements |
| Instructor mirror | Additional rear-view mirror; side mirror for specified A/B/C vehicles |
| Brake control | Dual foot brake, with tractor-trailer stopping-device exception |
| Sign | Complete words, at least 2-inch letters, 1/4-inch stroke, contrast, front/rear visibility |
| Inspection | General New York inspection requirements; no special §76.13 six-month rule |
Daily operational check
Before a lesson, verify the instructor brake, mirrors, restraints, tires, lights, glass, wipers, horn, registration, inspection, and warning indicators. A regulatory minimum is not a maintenance plan; frequent checks are prudent for a heavily used school vehicle. Remove a vehicle from service when a safety defect exists.
Training facilities and instruction
Section 76.12 says a school approved for the Pre-Licensing Course must meet Part 7 training-facility rules. It is not the instructor-certificate possession section.
Section 76.16 requires practical training to include oral instruction on rules of the road, safe driving, driver responsibility, pedestrian safety, and safety devices. Actual training includes starting, stopping, shifting, turning, backing, parking, steering, city and highway traffic where practical, and defensive driving. Behind-the-wheel training is actual driving practice while the vehicle is moving, with incidental curbside explanation allowed.
An instructor may not give driving instruction in an area DMV has designated as a road-test area. The instructor can supervise a resident student from or to the residence for instruction outside that area as the regulation permits.
Vehicle-change scenario
A replacement car should not enter service merely because it passed annual inspection. Update MV-527, supply required images and certification, install and test Part 76 equipment, and obtain the stamped approval used for school business and road tests. Drop the old vehicle when applicable. Test the instructor brake at very low speed in a controlled area and confirm removable signs are secure and fully visible.
The instructor should know whether a warning lamp or ADAS intervention affects safe use, but Part 76 equipment remains mandatory even when electronic features offer similar functions. Automatic braking does not replace the instructor's dual foot brake, and a camera does not replace the additional instructor mirror.
