8.2 Instructor Certification: MV-523 Application, Tests & MV-524
Key Takeaways
- The hiring licensed school applies for the instructor; current requirements include age, licensing experience, education, acceptable record, tests, and MCCII training.
- The written test is based on MV-21, Part 76, VTL §394, and MV-368; MV-368 states that 80 is passing, while an exact question count and time are not published.
- The MV-524 must be carried while teaching or accompanying a customer to a road test and is valid only for the school named on it.
Certification Is School-Specific
A driving instructor teaches for a licensed driving school under an instructor certificate issued by DMV. The current application is MV-523 when paper filing is used; the licensed school official applies on behalf of a person the school has hired. An applicant may not begin paid instruction before the MV-524 is issued.
Qualifications
Current DMV guidance requires the applicant to be at least 21; hold a driver license valid in New York for the class to be taught; have at least two years of preceding licensed experience in that class; have an acceptable driving record with no suspension or revocation in the prior two years; have a high-school or equivalency diploma; and pass the required vision, road-sign, written, and behind-the-wheel instructor tests. Part 76 also addresses character, physical qualifications, and Commissioner discretion.
Do not substitute invented bright-line rules such as “no more than four points in 18 months,” an automatic three-year DWI bar, or mandatory FBI fingerprinting. The regulation permits DMV to evaluate whether the record shows the qualities and competence desirable for an instructor and normally denies a certificate after a suspension or revocation in the preceding 24 months, subject to the stated discretion.
The 30-hour Methods and Content Course for In-Car Instruction (MCCII) is required under the current program. MV-368 describes the course as 21 classroom hours and nine or more supervised in-car hours. MV-523 instructions affect renewal length when proof has not been submitted. A classroom pre-licensing endorsement has separate training and experience requirements.
Application and tests
The application package includes the current records and documents DMV specifies, such as a recent driving-record abstract, diploma proof, and recent photograph. DMV or an authorized school schedules the tests.
The road-sign and written tests may each be taken twice per application; the behind-the-wheel instructor test may be taken once. A road-test failure voids the application. The behind-the-wheel test evaluates both driving and the ability to instruct in the vehicle type the applicant intends to teach.
The written test is based on the Driver's Manual MV-21, Part 76, VTL §394, and the MV-368 study guide. MV-368 states that 80 is the passing grade. DMV does not publish an exact current written-test question count or time limit on the official instructor page, so “40 of 50 questions” must not be taught as fact.
| Source | What to study |
|---|---|
| MV-21 | Current driving law and safe-driving content |
| MV-368 | Driving tasks, stopping distance, student/instructor/process |
| Part 76 | School, record, vehicle, instructor, instruction, advertising rules |
| VTL §394 | Statutory licensing, enforcement, instructors, penalties |
MV-524 custody and scope
After the applicant passes, DMV issues MV-524 to the employing school. Section 76.15 and the current DMV page require the instructor to carry it while giving instruction and while accompanying a customer to a DMV road-test site, and to present it when requested. The certificate authorizes instruction only for the named school. A school can apply for an additional certificate, and DMV states there is no fee when the instructor already has a valid certificate for another school.
The original certificate generally expires on the last day of the twelfth month after issuance. Approved renewals are generally valid for two years, with specified exceptions, including some out-of-state-license or course-proof situations.
When employment ends, the instructor surrenders the school-specific certificate to the school, and the school uses MV-526—the Instructor Termination Notice—to notify DMV. MV-526 is not a student lesson-record form.
Application scenario
A qualified applicant still cannot teach for hire while the application is pending. Passing a passenger-car test does not authorize every vehicle class. If the instructor changes schools, the certificate is not portable by itself because it names the employer. For renewal, compare current MV-523 instructions with expiration, course proof, license state, document, and fee requirements. Calendar renewal early and continue verifying the underlying driver license.
Study preparation should use the current versions of all four official sources and practice applying them to scenarios. Memorizing obsolete form numbers or an unofficial test length is counterproductive. When MV-368 and a newer operational page differ, use the newer procedure while retaining MV-368's examinable instructional concepts.
Original, renewal, and employment changes
Part 76 distinguishes certificate stages. An original MV-524 generally runs from issuance through the last day of the twelfth following month. An approved renewal is generally issued for two years, while specified circumstances—such as an out-of-state underlying license—can produce a shorter period. Read the current MV-523 instructions because filing method, documents, course proof, and resulting term can change.
Termination does not make the school-specific card portable. The instructor surrenders it to the employer, and the school submits MV-526 with the information required by §76.15. DMV may return an unexpired certificate if the instructor resumes qualifying employment before expiration. Renewal without retesting is available within the regulation's one-year post-expiration window only when the instructor resumes employment and submits the required forms and fee; later filing is treated as original for testing.
Loss of a certificate must be reported promptly in writing so DMV can issue a duplicate of a current credential. The underlying driver license must remain valid for the vehicle taught.
Different authority requires different qualifications
Behind-the-wheel certification does not by itself authorize every classroom or testing role. Teaching the Pre-Licensing Course requires the separate experience and teaching-methodology qualifications described by DMV. Conducting instructor applicant tests for an authorized school has still higher experience and training requirements under Part 76. Always match the MV-524 endorsement, school, vehicle class, and assigned function before instruction begins.
