Commission Terms and the Renewal Clock

A Maine commission is not perpetual — you must renew before the expiration date printed on your certificate or your notarial authority simply stops. The term depends on residency, the same distinction tested in 2.1.

Under RULONA (4 M.R.S. §1922, effective July 1, 2023) the term is a uniform 7 years for everyone; the old shorter non-resident term no longer exists.

The 45-Day Renewal Window

The Secretary of State opens online renewal once your current commission expires within the next 45 days. You cannot renew years early; the system checks the expiration date before letting you proceed. Plan to renew during that final 45-day window but before the actual expiration to avoid any gap in authority.

Online Renewal via Total Notary Solution

Unlike the paper-only initial application, renewals run through the Secretary of State's Total Notary Solution online system. The flow is:

1. Log in to Total Notary Solution at the Maine SOS website.
2. Update your profile — confirm or correct name, address, and contact details.
3. Pass the online exam — the same open-book, gated format (correct answer required to advance).
4. Pay the $50 fee by card.
5. Print the documents — the system does not finish the process electronically.
6. Be re-sworn — appear before a Dedimus Justice with the oath form, then mail the originally signed exam and oath back to the Secretary of State.

Key contrast: renewal starts online but still ends with a Dedimus Justice oath and a mailed, ink-signed oath — it is not fully paperless.

Renewal vs. New Application at a Glance

No Grace Period — The Costly Trap

Maine has no grace period for an expired commission. The consequences are strict:

• The moment your commission expires, you may not perform any notarial act.
• You cannot use the online renewal system; you must file the full paper Form ME NOT APP.
• You must again obtain a registered-Maine-voter endorsement, pass the exam, pay $50, and be re-sworn within 30 days of the new appointment.
• Any notarization performed after expiration is invalid and may expose the notary to liability.

Worked example. Priya's commission expires August 20. On August 25 a client asks her to notarize a power of attorney. Because her commission lapsed five days earlier and Maine grants no grace period, the act would be void; Priya must complete a brand-new paper application before notarizing again.

Because there is no grace period and the online window opens only 45 days out, the safest practice is to set reminders well in advance even though you cannot act on them early.

Why the Re-Exam Exists

Renewal still requires passing the embedded open-book exam, which surprises notaries who expect a rubber-stamp renewal. The reason is continuing competence: notary law, certificate wording, and prohibited acts evolve, and Maine uses the gated exam to confirm a renewing notary still knows current rules. Treat it like the original — open the Course of Study and answer each gated question correctly. There is no shortcut for experienced notaries.

Lapse Recovery, Step by Step

If you miss the window and the commission expires, recovery is not a renewal at all — it is a fresh appointment:

1. Stop all notarial activity immediately; you have no authority.
2. Download the current paper Form ME NOT APP (not the online system).
3. Re-take the embedded exam, pass each gated question, and pay the $50 fee.
4. Obtain a new registered-Maine-voter character endorsement.
5. Mail the packet to Augusta and await the 10–15 business-day processing.
6. Take the oath before a Dedimus Justice within 30 days of the new appointment.

Third worked example. Greg's commission lapsed in February. In May he completes a new paper application and is appointed effective May 10. He must be sworn by June 9. His new 7-year term starts only when the oath is filed — the years he held a prior commission do not carry over, and he gets no credit for his earlier exam.

Exam tip: distinguish renewal (online, 45-day window, no new endorsement) from lapse recovery (paper, new endorsement, full restart). Questions love to swap these two paths.
