The Tree Risk area contains eight tasks, and three of them are about the process rather than the tree: performing an assessment within the scope defined by the tree risk manager, communicating with that manager, and examining obligations, liability and negligence. This section covers the reporting and programmatic side of the competency.

Scope of Work Comes First

Every assessment begins with an agreed scope, and the report must reproduce it. The scope answers:

The assessment period is the element most often omitted and the one that most often causes disputes. A risk rating is a statement about likelihood over a stated period. Without a period the rating means nothing, and a failure occurring later can be characterized as a missed call.

Assessor and Risk Manager

The division of responsibility is a recurring exam theme.

  • The tree risk assessor inspects, identifies defects, evaluates likelihood of failure and likelihood of impact, characterizes consequences, produces a risk rating, and presents mitigation options with the residual risk of each.
  • The tree risk manager — the owner, the manager, or their delegate — decides what level of risk is acceptable, selects among the options, authorizes expenditure, and accepts the residual risk.

The assessor does not decide acceptability, and a report that removes the decision from the manager by presenting only one option is professionally weaker, not stronger. Present the range, state the residual risk of each option including the option of taking no action, and let the manager decide on the record.

Photographs with scale and orientation, a site sketch or plan showing tree and target locations, and dated field notes are the evidentiary backbone. Field notes should be retained; they are frequently more persuasive in a dispute than the report itself because they are contemporaneous.

Writing about uncertainty honestly

Risk assessment is probabilistic. Two habits protect both the client and the assessor:

  • Never state or imply that a tree is safe. No tree is without risk. The defensible formulation describes the risk rating over the assessment period given the targets and conditions observed.
  • State what would change the rating. A rating premised on a temporary target — a parked vehicle, a seasonal event, a construction trailer — should say so, and should say that removing or relocating the target reduces the risk without touching the tree. Target management is often the cheapest and most effective mitigation and is frequently omitted from reports.

Notice, Foreseeability and the Inspection Cycle

Liability for tree failure in most common-law jurisdictions turns on whether the owner knew or should have known of the defect.

  • Actual notice — the owner was told. A neighbour's letter, a prior arborist report, a work order, an email. Actual notice creates an obligation to act.
  • Constructive notice — the owner should have known, because a reasonable inspection appropriate to the setting would have revealed the defect. This is where an inspection program either protects the owner or condemns them.

Two further distinctions:

  • Patent defects are visible on reasonable inspection — a large cavity, a hanging limb, a lean with root plate heaving, extensive deadwood.
  • Latent defects are not detectable without advanced techniques — internal decay behind sound bark with no external indicator.

An owner who ran a reasonable, documented inspection program and did not detect a genuinely latent defect is in a fundamentally different position from one who never looked.

Programmatic Risk Management

At population scale — a municipality, a campus, a utility, a park system — risk is managed by policy rather than tree by tree.

Zoning the population by target occupancy is the practical core of a programmatic system. A tree over a playground used daily and a tree in a closed woodland have the same defects but different consequences and different justified inspection frequencies. Setting cycles by occupancy zone allocates finite inspection resources where the consequence is greatest.

The failure to follow a written policy is worse than not having one. A documented three-year cycle that was in fact never performed converts a defensible program into evidence of a known, unmet standard the organization set for itself. Set cycles the organization can actually resource, and record performance against them.

Communicating with Non-Technical Decision Makers

The manager who receives the report is usually not an arborist. Three practices carry most of the weight:

  1. Lead with the decision. State the risk rating, the recommended action, and the residual risk in the first paragraph. The technical analysis follows for those who need it.
  2. Quantify occupancy in ordinary terms. "Occupied approximately eight hours per day, five days per week" communicates more than a category label.
  3. Price the options. A mitigation menu without relative cost is not a decision document. Include the no-action option and its residual risk explicitly, so the record shows the manager was offered it and chose otherwise.
