Business and Professional Licensing
Requirements vary widely by jurisdiction. Check for:
- Business registration and local business licence for each jurisdiction worked in.
- Contractor or tree service licensing, which some states, provinces, and municipalities require specifically for tree work, sometimes with bonding and insurance minimums.
- Arborist licensing or registration where a jurisdiction regulates the title or the practice.
- Pesticide business licence distinct from individual applicator certification.
- Consumer protection registration, including right-of-rescission requirements for door-to-door or in-home residential contracts in many jurisdictions — a real exposure after storms.
Credential is not licence. An ISA credential is a voluntary professional certification and does not by itself authorize practice, confer a licence, or substitute for one where a jurisdiction requires it. Conflating the two is a common exam trap and a real regulatory risk.
Pesticide Law
This is the most heavily regulated activity most tree care firms perform.

- Inspections. Know the process: opening conference, walkaround, employee interviews, closing conference, citation, and contest period.
Motor Carrier and Vehicle Requirements
Tree care runs heavy vehicles and trailers, which engages transport regulation:
- Commercial driver licensing above defined weight thresholds, including combination weight where a chipper is towed;
- Medical certification for drivers where required;
- Hours of service and logging requirements where applicable;
- Vehicle marking, registration, and periodic inspection;
- Load securement for logs, chippers, and equipment;

Misclassification is the highest-frequency employment exposure in tree care. The consequences compound: unpaid payroll taxes, unpaid overtime, uninsured injury, and the loss of the workers' compensation exclusive-remedy protection that would otherwise limit the employer's liability.
Environmental and Species Restrictions
These determine whether and when work may proceed and routinely override project schedules.
- Migratory bird protection. In North America, migratory birds, their active nests, and their eggs are federally protected. Removing a tree containing an active nest can be a violation.
