Why environmental hazards are tested

The national exam treats environmental hazards as material facts: physical conditions that could affect a buyer's decision or health. A licensee is not expected to be an environmental engineer, but must recognize a hazard when it appears, disclose what is known, and refer the parties to a qualified professional. The recurring trap is the answer that has the agent diagnose or remediate the problem; the correct role is almost always disclose and refer.

A second recurring trap is confusing the hazard's source with its danger. Several hazards (asbestos, lead, mold) are only dangerous under specific conditions. Knowing the trigger condition lets you eliminate distractors quickly.

Lead-based paint (the most tested hazard)

Lead-based paint was banned for residential use in 1978. The federal Residential Lead-Based Paint Hazard Reduction Act (Title X) requires, for target housing built before 1978:

  • Give the buyer/tenant the EPA pamphlet Protect Your Family From Lead in Your Home.
  • Disclose any known lead-based paint and provide available records/reports.
  • Include a Lead Warning Statement and signatures in the contract.
  • Give the buyer a 10-day period (purchase only) to conduct a lead inspection or risk assessment. The buyer may waive or shorten this by mutual agreement.

Lead is most dangerous to children under 6 and pregnant women. Exemptions include housing built in 1978 or later, zero-bedroom units (studios, lofts), and housing for the elderly with no children. Note: there is no required testing — only disclosure of what is known and the chance for the buyer to test.

Asbestos, radon, mold, and wetlands

Asbestos was used in insulation, pipe wrap, floor tile, and roofing before the late 1970s. It is hazardous only when friable — crumbling so fibers become airborne. Intact, sealed asbestos is generally safe. Because removal disturbs fibers, encapsulation (sealing in place) is frequently safer and cheaper than abatement. Wrong answers tell you to rip it out immediately.

Radon is a naturally occurring, colorless, odorless radioactive gas from uranium decay in soil and rock. It seeps in through foundation cracks and basements and is the second leading cause of lung cancer. The EPA action level is 4.0 pCi/L (picocuries per liter). The standard fix is active sub-slab depressurization — a vent pipe and fan that draws gas from under the slab to the outside.

Mold requires three things: moisture, organic material, and time. The exam answer is always fix the water source (leak, humidity, flooding); surface cleaning without removing moisture lets mold return.

Wetlands are protected under the federal Clean Water Act, administered by the Army Corps of Engineers and EPA. Filling, dredging, or building on wetlands typically needs a federal permit. A buyer planning to develop must be told the buildable area may be restricted.

Worked example: the 10-day window and a radon reading

A buyer signs a purchase contract on a 1962 house on March 3. Under Title X the buyer has 10 days for a lead inspection unless the parties agree otherwise. Counting from March 4 (day after signing), the period runs through March 13. If the buyer takes no action and does not extend, the right lapses — there is no automatic remedy after the window closes. This is why agents document the start date precisely.

Now a numeric environmental judgment. A radon test returns 6.2 pCi/L. Because that exceeds the EPA action level of 4.0 pCi/L, mitigation is recommended. After installing a sub-slab depressurization system, a retest reads 1.8 pCi/L — below the action level, so the system is working. The exam may ask you to compare a reading to 4.0; anything at or above triggers the recommendation, anything below does not. A reading of exactly 4.0 is at the action level and warrants mitigation.

Other named hazards

Expect brief mentions of underground storage tanks (USTs) — old heating-oil or fuel tanks that can leak and create cleanup liability; groundwater/well contamination; urea-formaldehyde foam insulation (UFFI) off-gassing; PCBs in old transformers; and carbon monoxide from faulty combustion appliances. For each, the agent's job is the same: note the visible sign, disclose it, and refer to a specialist. Do not let an answer choice turn the agent into the inspector.

California-Specific Environmental Disclosures

The federal hazards above all apply in California, but the state mandates several additional disclosures the DRE tests directly.

Proposition 65 Warnings

The Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) requires warnings when a property may expose occupants to listed carcinogens or reproductive toxicants. In real estate it most often surfaces as a posted warning in apartment buildings, parking garages, and common areas. An agent should ensure required Prop 65 notices are disclosed; failing to pass along a known exposure is a disclosure failure.

Water-Conserving Fixtures and Smoke/CO Devices

California Civil Code 1101.4 requires that single-family homes built before 1994 have water-conserving plumbing fixtures, and the seller must disclose whether the property complies. Separately, the seller must confirm working smoke detectors and, since 2011, carbon monoxide detectors (Health & Safety Code 13260 et seq.) in dwellings with a fuel-burning appliance, fireplace, or attached garage.

Defensible Space and Wildfire Hardening

For homes in a State Responsibility Area or designated Very High Fire Hazard Severity Zone, Public Resources Code 4291 requires 100 feet of defensible space, and sellers must disclose compliance and, under recent law, provide a wildfire-hardening disclosure. A Worked Compliance Check

A seller lists a 1980 single-family home in a Very High Fire Hazard Severity Zone with an attached garage. The salesperson should verify: pre-1994 means water-conserving fixtures must be disclosed; the attached garage triggers a carbon-monoxide detector requirement; and the fire zone triggers defensible-space and wildfire-hardening disclosures.
