Prelicensing is classroom; PC 832 is educational only

CIC 1810.7(a), operative July 1, 2023, is the eligibility-to-examine statute. The applicant shall have completed:

  1. A minimum of 20 hours of classroom education in subjects pertinent to a bail licensee's duties, including related laws and regulations, rights of the accused, ethics, and apprehension of bail fugitives.
  2. A 40-hour power of arrest course certified by POST pursuant to Penal Code section 832. Completion is for educational purposes only and is not intended to confer the power of arrest of a peace officer or public officer, or agent of any federal, state, or local government, unless the person is so employed by a governmental agency. Paragraph (2) applies to a bail fugitive recovery agent and to a "bail" who hires, trains, or designates assignments for recovery agents.

CIC 1810.7(h) is the internet split the exam loves. Nothing in the chapter precludes completing bail agent or bail fugitive recovery agent continuing education through a course of instruction offered via the internet or correspondence. That subdivision shall not be construed to allow completion of the prelicensing education requirements through a course of instruction. A Zoom "20-hour bail school" does not satisfy 1810.7(a)(1).

CDI's BFRA page adds a narrow prelicensing exemption: active bail agents and permittees applying for the recovery-agent license are exempt from repeating the 20 hours. The examination

CIC 1810.5 is the exam gate: the commissioner shall not issue a bail license unless and until the applicant takes and passes an examination given by the commissioner. The prohibition does not apply to persons who were licensed under Chapter 7 during any part of the annual period terminating on the July 1 preceding the period to be covered by the license applied for — a grandfather clause, not a shortcut for a first-time 2026 applicant.

CIC 1677 requires a written qualifying examination of sufficient scope to satisfy the commissioner that the applicant knows the insurance laws of this state, the provisions of the insurance that may be transacted, and the duties of the holder. CIC 1681.5 is the cheating statute. CIC 1810.7(e): a licensee shall complete in each two-year license term not less than 12 hours of continuing education in the 1810.7(a) subjects prior to renewal. CDI's producer pages call this "approved continuing education classroom study" prior to each expiration. CIC 1810.7(h)–(i) then expressly allow CE by internet or correspondence if the student obtains a passing grade of at least 70 percent on a written final examination that is open book and graded by the approved provider. The provider shall issue certificates of completion only to students who passed. The CE provider has 30 days from the course completion date to submit the student roster to the department (CDI BFRA page).

CIC 1810.7(f) is the age-and-tenure exemption: a licensee shall not be required to comply with the CE requirements if the licensee submits proof satisfactory to the commissioner that the licensee has been a licensee in good standing for 30 continuous years in this state and is 70 years of age or older. Both facts are required. Seventy years old with 12 years on the license does not exempt. Thirty years in good standing at age 68 does not exempt.

CIC 1810.9: a renewal license shall be issued upon proof of current licensure, payment of a renewal fee, and completion of the CE required by 1810.7(a). CDI's FAQ adds operational checks: for an on-time renewal, complete the 12 hours, ensure at least one active appointment and one bond are on file (use Check a License), then complete the online renewal and pay fees at Sircon. All bail renewals are processed manually; allow 3–5 business days.

Courtesy notices go to the business email on file, approximately 90 days prior to expiration. Renewal is due whether or not the courtesy notice is received. That sentence is on the agent page twice. An agent who "never got the email" still expires.

California scenario: Hector in Bakersfield is 71 and has held a California bail license continuously since 1994. He skips CE, assuming age 70 is enough. Fees, appointment math, and the no-late-renewal wall

CDI's fee-table footnote is the agent-specific trap: Bail Agents pay $188 per surety company appointment on renewal; Bail Solicitors pay $188. Renewal fees are calculated based on the number of appointments 90 days prior to expiration. CDI tells agents to submit appointment cancellations 120 days in advance of renewal so the fee calculates correctly. Cancellations inside 90 days may delay the renewal. That is why an agent who carries four sureties and meant to drop three can receive a renewal invoice that still counts four appointments.

CIC 1808 is the expiration statute. Applications for renewal may be filed on or before the expiration date upon payment of the 1811 fees. Upon failure to file as provided, the license shall expire on the first day of the next month, but the holder may file an application for a new license. Until that same month and day of the next succeeding year, the fee shall be twice that specified in 1811. An application is not "filed" unless the document was actually delivered and the proper fee paid at the commissioner's office during office hours, or both the document and the fee were filed and remitted under Government Code 11002 and 11003.

CDI translates 1808 into a hard operational rule: no late renewals. Licenses not renewed by the expiration date are inactivated. "Late" means any renewal for which the filing fee, continuing education, and required documents are not on file by the expiration date. For one year after expiration, submit a new application, all required forms, and double the filing fee. Exam trap: A Life-Only producer will tell you CDI allows a 60-day late renewal with a penalty. That is a different license class. Bail has no late-renewal product. The one-year window is a reapplication at double fee, not a grace-period renewal at $188.
