1.3 Board Composition, Powers, and Duties
Key Takeaways
- The Governor appoints seven Board members: four PTs, one PTA, and two public members.
- Professional members have Arizona practice requirements; public members may not have specified health-profession affiliations or financial interests.
- Regular terms are four years, with limits on successive and consecutive service.
- The Board determines qualifications and passing standards, issues licenses, investigates and disciplines, adopts rules, maintains public information, and administers continuing competence.
Board Composition, Powers, and Duties
The Arizona Board of Physical Therapy is the state regulator created by the Legislature. On the exam, distinguish what the Legislature placed in statute from what the Board may implement by rule. The Board cannot contradict the statute, but it has express authority to determine qualifications, administer licensure, regulate practice and enforce the chapter.
Seven-member composition
Under A.R.S. § 32-2002, the Governor appoints seven members:
| Seats | Current statutory qualification |
|---|---|
| Four PT members | Unrestricted Arizona PT license and at least five years actively practicing physical therapy in Arizona before appointment |
| One PTA member | Unrestricted Arizona PTA license and at least five years performing selected interventions in Arizona under a PT's direction and supervision before appointment |
| Two public members | No affiliation with a health profession, no current or former licensure by a health-profession regulatory board, and no financial interest in a health profession |
The mix prevents the Board from being composed only of the profession it regulates. Public members bring the consumer perspective; professional members bring subject-matter knowledge. Do not add requirements from an older act, such as a special January expiration date or an automatic partial-term exception, unless they appear in the current statute.
Terms and continuity
Members serve staggered four-year terms. A member may not serve more than two successive full terms or more than ten consecutive years. A majority of the Board may extend a member's term until the Governor appoints a successor or reappoints the member. The Governor's removal authority in this section is exercised on the Board's request. The Board elects officers from its membership as part of its statutory duties.
Core powers and duties
A.R.S. § 32-2003 directs the Board to:
- evaluate applicant qualifications and determine examinations and passing scores;
- issue licenses and regulate the practice of PTs and the work of PTAs;
- adopt rules needed to administer the chapter;
- keep records of Board proceedings and make appropriate records available for public inspection;
- establish continuing-competence requirements;
- maintain a list of licensees and employ personnel or contract for services;
- investigate alleged violations and impose authorized discipline after the required process;
- report disciplinary information to appropriate national databases and publish final disciplinary actions and declaratory rulings;
- provide public information about Board functions and licensee status; and
- submit required reports and collect fees established by law and rule.
The Board may receive complaints and may begin an investigation on its own initiative when it has reason to believe a violation may have occurred. It may subpoena witnesses and documents, order competence examinations, and take emergency action when the statutory standard is met. Those enforcement powers are addressed in the discipline sections of this guide.
Records and public protection
The Board's public list includes licensure and practice information described in A.R.S. § 32-2051, while home addresses and telephone numbers are generally confidential unless they are the only address or number on record. Complaint investigation information remains confidential until disclosure is authorized by law or occurs in a proceeding. Final discipline is public. A public advisory letter is nondisciplinary, but it may be considered in a later case.
Compact-specific responsibilities
Arizona has enacted the Physical Therapy Licensure Compact. A.R.S. § 32-2056 requires the Board to post notice on its website within 30 days after a Compact Commission action that may affect a PT's license. It also bars the Board from spending money collected from non-Compact applicants or licensees on Compact obligations. These are Board-level safeguards; they do not convert a Compact privilege into an Arizona license.
Exam method
When asked whether the Board can act, identify the source and the procedural condition. The Board may set a passing score because statute authorizes it. It may impose only disciplinary actions the statute authorizes and only after the applicable process. It may make rules within its delegated authority, but a policy statement cannot rewrite a statute or rule.

Authority and process drill
If an applicant challenges a passing standard, the Board can point to its statutory authority to determine examinations and scores. If a clinic challenges a new obligation found only in an informal website sentence, ask whether the obligation comes from statute, a valid rule, an order, or an applicable policy interpreting existing law. The Board's expertise does not eliminate the hierarchy of authority.
Board action also changes character over time. Complaint material begins confidential; an advisory letter can become a public nondisciplinary document; a final censure is public discipline. Public access to status and final action supports consumer protection, while patient-identifying and investigative information remains protected. Questions that use the single word “confidential” without identifying the record or stage should be read carefully.
