1Which Act principally addresses grants of probate, letters of administration and personal representatives' duties in Mainland Tanzania?
A.The Law of Marriage Act
B.The Trustees' Incorporation Act
C.The Land Registration Act
D.The Probate and Administration of Estates Act
Explanation: The Probate and Administration of Estates Act provides the principal framework for these grants and administrative duties. Other legislation can affect particular assets, succession rules or the applicable court procedure.
2Which court has the Act's general jurisdiction over probate and administration, including granting and revoking probate and letters of administration?
A.The District Land and Housing Tribunal
B.The High Court
C.The Fair Competition Tribunal
D.The village land council
Explanation: The Act confers general probate and administration jurisdiction on the High Court. This does not eliminate the distinct statutory functions of district delegates, district courts or primary courts.
3Why should an estate adviser distinguish entitlement to inherit from entitlement to administer?
A.Only administrators can ever be beneficiaries
B.A family nomination necessarily transfers ownership of all assets
C.Distribution rules identify beneficial entitlement, while a grant concerns authority to represent and administer the estate
D.Obtaining a grant automatically makes the grantee sole beneficial owner
Explanation: Administration and beneficial succession answer different legal questions. A representative collects assets and pays liabilities for lawful distribution rather than taking the estate as personal property.
4An application before a District Delegate becomes contentious. Is it safe to assume that every such case must automatically leave that Delegate regardless of the Act's conditions?
A.No; examine the Delegate's statutory jurisdiction, the estate circumstances and any High Court authorization or transfer directions
B.Yes; a caveat always extinguishes the Delegate's appointment
C.Yes; every dispute must instead be decided by a village council
D.No; a Delegate has unrestricted contentious jurisdiction everywhere
Explanation: The Act distinguishes non-contentious and contentious jurisdiction and provides for High Court directions in specified circumstances. Neither automatic exclusion nor unlimited jurisdiction accurately describes that framework.
5Trustees of a qualifying charitable association seek incorporation under the Trustees' Incorporation Act. Which statutory office handles the relevant application?
A.The Registrar of Titles acting on a land transfer
B.The Registrar of Companies acting on a share allotment
C.The probate caveator
D.The Administrator-General under the trustees' incorporation framework
Explanation: The Trustees' Incorporation Act provides an application and certification process administered by the Administrator-General. This is distinct from incorporating a share company or registering a land disposition.
6Before any rightful representative exists, a relative takes estate goods for personal use. Which issue arises under the Act's executor-of-own-wrong provisions?
A.The relative necessarily becomes the lawful executor
B.Unauthorized intermeddling can create accountability without conferring a lawful appointment
C.Possession alone makes the relative the sole heir
D.Every act preserving estate goods is also wrongful intermeddling
Explanation: Unauthorized appropriation can engage liability as an executor of one's own wrong. The Act separately protects specified acts such as preservation and provision for immediate necessities, so those should not be indiscriminately treated as wrongdoing.
7An adviser claims that the Probate and Administration of Estates Act categorically has no relevance whenever customary law affects an estate. What is the best correction?
A.Customary rules automatically displace every court procedure
B.All estates must use an identical procedure regardless of legislation
C.Read the Act's application provision with its specified exceptions and Part IX, and identify the applicable administration regime
D.A family's description of the estate alone determines the court's powers
Explanation: The Act states its application subject to specified provisions, including Part IX on customary-law estates. The correct route requires that statutory analysis rather than a blanket exclusion attributed to the definitions section.
8A grant has been issued by a probate court in another Commonwealth jurisdiction and local recognition is sought. Which Tanzanian procedure should the adviser investigate?
A.High Court resealing under the Act, subject to its conditions
B.Automatic recognition without any local procedure
C.A fresh company incorporation
D.A private declaration by the beneficiaries that no court process is required
Explanation: The Act gives the High Court a resealing jurisdiction for relevant Commonwealth grants. The foreign document and applicable conditions must be checked; a foreign grant does not acquire local effect merely because beneficiaries agree.
9Who may receive probate of a will under the Act?
A.Any creditor who first locates an asset
B.Every beneficiary automatically
C.Any person nominated informally after death
D.An executor appointed by the will, expressly or by necessary implication
Explanation: Probate is granted to an executor whose appointment derives from the will. Where a will exists but no executor can act, administration with the will annexed is a distinct possible route.
10A will does not use the word 'executor' but directs a named person to collect assets, pay liabilities and administer its dispositions. What should the adviser examine?
A.Whether omission of that word necessarily invalidates the entire will
B.Whether the terms appoint an executor by necessary implication
C.Whether the named person automatically becomes sole beneficiary
D.Whether the directions must be ignored as non-operative
Explanation: The Act recognizes appointment by necessary implication as well as express appointment. The substance of the testamentary directions must therefore be interpreted rather than treating one missing label as decisive.

Frequently Asked Questions

Do MCQs replace the official practical assessment?

No. These independent English questions support knowledge and procedural decisions. LST also requires written, continuous, oral and field work within the PLT programme.

Which official assessment languages are allowed?

Permitted delivery and response languages were not established by the official sources reviewed. Obtain the current paper instructions from LST. This bank uses English.

Does this bank determine every heir's share?

No. Entitlement under the applicable succession regime must be established separately from representative appointment and administration. The questions concentrate on verified procedures and duties rather than unverified universal inheritance fractions.
