1In what capacity is public land vested in the President under Mainland Tanzania's Land Act?
A.As private beneficial owner
B.As trustee for the citizens
C.As agent of each registered mortgagee
D.As purchaser under each land sale
Explanation: The Act vests public land in the President in a trustee capacity for the citizens. Individual land rights must therefore be understood through the statutory tenure system rather than presidential private ownership.
2Which list identifies the Land Act's main public-land categories?
A.Urban, residential and industrial
B.Freehold, leasehold and commonhold
C.General, village and reserved
D.Surveyed, occupied and mortgaged
Explanation: General land, village land and reserved land are the statutory categories. Land use, survey status and encumbrances answer different questions from this classification.
3What maximum fixed term does the Land Act provide for a granted right of occupancy?
A.99 years
B.33 years
C.66 years
D.125 years
Explanation: The statutory ceiling for the fixed term is ninety-nine years. A shorter actual grant must be read on its own terms; the maximum does not mean that every occupier receives it.
4An adviser investigates authority to manage village land. Which relationship under the Village Land Act should the adviser recognize?
A.The village chairman personally owns all village land
B.The District Land and Housing Tribunal grants every customary allocation
C.The village council may disregard the village assembly in every transaction
D.The village council manages village land subject to statutory duties and the village assembly's role
Explanation: The village council's management is a statutory trusteeship rather than personal ownership. The Act also gives the village assembly an oversight and approval role that must be checked for the proposed dealing.
5A purchaser dismisses a customary right of occupancy as necessarily inferior to a granted right. What is the correct statutory response?
A.Customary rights are only informal permissions
B.The Village Land Act gives customary rights equal legal status and effect, subject to the applicable statutory rules
C.Customary rights become inferior whenever land is surveyed
D.Only a granted right can constitute a protected land interest
Explanation: The Village Land Act expressly recognizes equal status and effect. Equality of status does not make the acquisition and dealing procedures for the two forms identical.
6A parcel is legally designated as a forest reserve. Which land category should a conveyancer investigate first?
A.General land simply because it is surveyed
B.Village land simply because villagers live nearby
C.Reserved land under the relevant statutory designation
D.Private freehold because timber has commercial value
Explanation: A statutory reserve designation is relevant to reserved-land classification. A conveyancer must examine the governing designation and restrictions before assuming an ordinary unrestricted transaction is available.
7A proposed development site includes a flood-prone riverbank. What is the most appropriate Land Act inquiry before advising that construction can proceed?
A.Investigate hazardous-land designation and the resulting restrictions
B.Assume a sale agreement removes environmental restrictions
C.Treat payment of land rent as a development permit
D.Rely solely on the purchaser's willingness to accept flood risk
Explanation: Hazardous-land provisions address danger to life and environmental degradation. Private contractual risk acceptance does not displace statutory controls on development.
8A proposed village allocation is refused solely because the otherwise eligible applicant is a woman. Which principle should the adviser raise?
A.Female applicants must use a male nominee
B.Custom always displaces the land statutes
C.Marriage automatically removes an adult woman's landholding capacity
D.The land legislation protects women's rights to acquire and deal with land on an equal basis
Explanation: The Land Act and Village Land Act protect women's land rights on an equal basis. An allocation decision must still meet lawful eligibility and land-management requirements, but sex alone is not the stated lawful distinction.
9What does an official Land Registry search principally establish?
A.A guarantee that every building is structurally sound
B.The subsisting registered entries affecting the identified parcel
C.An assurance that every occupant has agreed to leave
D.Approval of the purchaser's mortgage application
Explanation: An official search supplies particulars of the subsisting memorials for the parcel. It must be combined with other inquiries rather than treated as a guarantee of physical condition or vacant possession.
10A proposed mortgage concerns a matrimonial home occupied by the applicant and a spouse. What should the lender's adviser investigate before accepting the security?
A.Whether the applicant alone paid the original purchase price, ending all further inquiry
B.Whether the loan is commercially profitable, replacing consent requirements
C.The marital disclosures, verification duties and required evidence of spousal assent
D.Whether the spouse is named as a borrower, the only relevant test
Explanation: The Land Act imposes particular requirements for mortgaging a matrimonial home and responsibilities concerning marital-status information. Title in one spouse's name does not by itself dispose of the assent inquiry.
