1Which statement best describes a legal norm (právna norma)?
A.A set of rules that binds only entrepreneurs registered in the commercial register
B.A rule of conduct recognised by the state that can be enforced and sanctioned
C.A set of ethical and moral recommendations issued by professional associations
D.An expert interpretation of a court decision published by the Supreme Court
Explanation: A legal norm is a generally binding rule of conduct recognised or issued by the state, whose observance the state can enforce and sanction. Ethical codes and expert commentary may guide behaviour, but they lack this state enforceability. The general part of every NBS sector exam begins with such legal-system basics.
2Under the Slovak Civil Code, which of these persons is NOT a close person (blízka osoba) of the client?
A.The client's brother or sister
B.The client's parent or child
C.The client's spouse
D.The client's cousin
Explanation: Close persons under the Civil Code are relatives in the direct line, siblings and spouses. Other persons in a family or similar relationship count only if harm suffered by one would reasonably be felt by the other as their own. A cousin is not automatically a close person, which is how the official NBS question pool frames it.
3When does a buyer acquire ownership of real estate transferred by a purchase contract in Slovakia?
A.On the day both parties sign the purchase contract
B.When the signatures on the purchase contract are certified by a notary
C.On registration (vklad) of the ownership right in the land register
D.When the buyer pays the full purchase price to the seller
Explanation: Ownership of real estate passes only on registration of the right (vklad) in the land register (kataster nehnuteľností). The purchase contract must be in writing, but signing or paying does not by itself transfer ownership. By contrast, ownership of movables transferred under a contract normally passes on taking delivery.
4Who may carry out financial intermediation in the Slovak Republic?
A.A person in the NBS register who meets the statutory conditions, including professional competence
B.Anyone holding a trade licence (živnostenské oprávnenie) for intermediation and advisory services
C.Only a person with a completed university degree in law or economics
D.Any EU citizen who notifies the local tax office before starting the activity in Slovakia
Explanation: Under Act No. 186/2009 Z. z., financial intermediation may be carried out only by a financial agent who is licensed or registered with Národná banka Slovenska and meets the statutory conditions. These include professional competence, which for most agents means passing the NBS professional examination. Financial intermediation is a regulated activity, not a trade.
5Under §§ 7 and 8 of Act No. 186/2009 Z. z., how does an independent financial agent (SFA) differ from a tied financial agent (VFA) in the deposit-taking sector?
A.An SFA may contract with only one bank, while a VFA may contract with several banks
B.An SFA works through a contract with another agent, while a VFA is licensed directly by the ECB
C.Both may contract with any number of banks; they differ only in the fees they charge
D.An SFA may contract with several financial institutions at once; a VFA with at most one per sector
Explanation: § 7 allows an independent financial agent to have written contracts with several financial institutions at the same time. § 8 limits a tied financial agent to a contract with at most one financial institution in each sector; only in insurance may it have one life insurer and one non-life insurer. A subordinate agent (§ 9) contracts with one SFA at a time.
6Under § 21(4) of Act No. 186/2009 Z. z., what minimum level of professional competence must a tied financial agent (VFA) who is a natural person meet?
A.The medium level, including a passed professional examination
B.The basic level, without a professional examination
C.The higher level, including three years of practice in the sector
D.The highest level, including an examination with certificate
Explanation: § 21(4) requires a tied financial agent who is a natural person, the responsible statutory-body member and its professional guarantor to meet at least the basic level. That level means secondary vocational education plus annual special financial education, with no professional examination. A subordinate financial agent, by contrast, needs the medium level, which includes the examination.
7What does the higher level of professional competence (vyšší stupeň) under § 21(3) of Act No. 186/2009 Z. z. require?
A.Secondary vocational education and annual special financial education only, without any examination
B.A university degree in economics or law and a professional examination that includes an oral part
C.Complete secondary education, seven years of practice and an examination with certificate
D.Secondary vocational education, 3 years' sector practice, the exam and special financial education
Explanation: The higher level requires at least secondary vocational education, at least three years of professional practice in the relevant sector, a passed professional examination and special financial education for each sector. It is the level required for an independent financial agent under § 21(7). The examination must be passed again at least every four years.
8A bank cashier keeps for herself money that a client had entrusted to her, causing small damage. Which criminal offence does this describe?
A.Theft (krádež)
B.Fraud (podvod)
C.Embezzlement (sprenevera)
D.Unauthorised use (neoprávnené používanie)
Explanation: Embezzlement means appropriating someone else's thing that was entrusted to the offender and causing at least small damage. Theft means taking possession of someone else's thing, and fraud means enriching oneself by misleading someone or exploiting their mistake. Here the money was entrusted, so the offence is embezzlement.
9Under § 5(3) of Act No. 186/2009 Z. z., who is a non-professional client (neprofesionálny klient)?
A.A natural person receiving intermediation or advice for personal or household needs
B.Any client who has not passed a financial-literacy test offered by the agent
C.Any small or medium-sized enterprise with fewer than 50 employees and low turnover
D.A client whose total deposits with any one bank do not exceed EUR 100,000
Explanation: § 5(3) defines a non-professional client as a natural person who receives financial intermediation or financial advice for personal needs or the needs of household members. Such clients get the full protection of the conduct rules. A professional client can ask in writing to be treated as non-professional.
10A professional client asks a financial agent to treat it as a non-professional client. What does § 5(4) of Act No. 186/2009 Z. z. provide?
A.The request can be granted only if the client plans to conclude at least two contracts
B.The agent decides at its discretion whether to accept the request
C.The client may request it, by a written declaration that the agent confirms and returns
D.The request can be granted only for contracts worth EUR 10,000 or more
Explanation: § 5(4) entitles a professional client to ask to be treated as a non-professional client. The request is made by a written declaration stating whether it covers one or more financial services in one or more sectors. After receiving it, the agent or adviser confirms receipt in writing and returns one copy to the client.
