1Which of the following sources of law has the highest legal force in the Slovak Republic?
A.A government regulation (nariadenie vlády)
B.A constitutional act (ústavný zákon)
C.The Civil Code (Občiansky zákonník)
D.A decree (opatrenie) of Národná banka Slovenska
Explanation: Constitutional acts, together with the Constitution itself, sit at the top of the Slovak hierarchy of legal norms. Ordinary acts such as the Civil Code, government regulations and NBS decrees must all comply with them. The general part of every NBS sector exam starts from this kind of legal-system basics.
2Under § 21 of Act No. 186/2009 Z. z., what is the minimum level of professional competence that a subordinate financial agent (podriadený finančný agent, PFA) who is a natural person must meet?
A.The basic level (základný stupeň)
B.The higher level (vyšší stupeň)
C.The medium level (stredný stupeň)
D.The highest level (najvyšší stupeň)
Explanation: § 21(5) of Act No. 186/2009 Z. z. requires a PFA who is a natural person, the responsible member of its statutory body and its professional guarantor to meet at least the medium level. The medium level means at least secondary vocational education, a passed professional examination and special financial education (osobitné finančné vzdelávanie) in each sector.
3A PFA passed the medium-level professional examination in the supplementary pension saving sector. What must the PFA do to keep meeting the competence requirement?
A.Complete special financial education every year and pass the professional examination again at least every four years
B.Complete special financial education every three years; the passed examination then stays valid for the agent's whole career
C.Pass the professional examination again every year; attending special financial education courses is then optional
D.Nothing further, provided the PFA keeps working under the same independent financial agent in the same sector
Explanation: § 22(1) of Act No. 186/2009 Z. z. requires a person who must meet the medium or higher level to complete special financial education every year and to pass the professional examination successfully at least every four years. NBS repeats the four-year rule on its professional competence page.
4Which pair of financial-intermediary categories may operate only after Národná banka Slovenska grants a licence (povolenie) on their own application?
A.Tied financial agent and subordinate financial agent
B.Subordinate financial agent and financial adviser
C.Tied investment agent and ancillary insurance intermediary
D.Independent financial agent and financial adviser
Explanation: Under Act No. 186/2009 Z. z., NBS decides on applications for a licence to act as an independent financial agent (samostatný finančný agent) and as a financial adviser (finančný poradca). Tied agents, subordinate agents, tied investment agents and ancillary insurance intermediaries are instead entered in the register on the proposal of their proposer (navrhovateľ).
5A financial agent registered for the supplementary pension saving sector wants to start charging clients a fee for impartial financial advice in the same sector. What does Act No. 186/2009 Z. z. say?
A.It is allowed if the agent discloses both roles to the client in writing before each meeting and keeps a record
B.A financial agent may not provide financial advice at all; advice is reserved for a licensed financial adviser
C.It is allowed in the two pension sectors only, because long-term pension products need ongoing advice
D.It is allowed if the agent's independent financial agent consents in writing and notifies NBS in advance
Explanation: § 6(1) of Act No. 186/2009 Z. z. states that a financial agent may not provide financial advice, and § 10(1) mirrors this by barring a financial adviser from financial intermediation. Financial advice (finančné poradenstvo) may be provided only by a financial adviser holding an NBS licence and contracting with the client.
6Under Act No. 297/2008 Z. z. on protection against money laundering and terrorist financing, from what value must an obliged person carry out basic customer due diligence for an occasional transaction outside a business relationship (other than a transfer of funds or crypto-assets)?
A.At least EUR 5,000
B.At least EUR 20,000
C.At least EUR 15,000
D.At least EUR 8,000
Explanation: Basic due diligence (základná starostlivosť) is required when establishing a business relationship and also for an occasional transaction outside a business relationship of at least EUR 15,000. A lower EUR 1,000 threshold applies to an occasional transaction that is a transfer of funds or crypto-assets. Both thresholds appear in the official NBS question pool.
7An obliged person identifies an unusual business operation (neobvyklá obchodná operácia). When must it report the operation to the Financial Intelligence Unit (finančná spravodajská jednotka) of the Police Force?
A.Within 24 hours of the operation
B.Within five working days
C.Only after the client has been told about the report
D.Without undue delay
Explanation: Act No. 297/2008 Z. z. requires an unusual business operation, or an attempt to carry one out, to be reported to the Financial Intelligence Unit without undue delay (bez zbytočného odkladu). The obliged person must also keep the report confidential and must not tip off the client.
8Under the Slovak Civil Code, how does a natural person acquire full capacity to perform legal acts (spôsobilosť na právne úkony)?
A.On reaching 18 years of age, or earlier by marrying before that age
B.By birth, together with the capacity to have rights and duties
C.On being issued an identity card at the age of 15
D.On completing compulsory school attendance
Explanation: Full legal capacity is acquired at majority (plnoletosť), which arises at 18 or by marriage before that age. The capacity to have rights and duties is different: it arises at birth. Minors can perform only legal acts appropriate to their intellectual and volitional maturity.
9Under the Civil Code, from when does the general limitation period (premlčacia doba) start to run?
A.From the day the creditor first actually asserted the right
B.From the day the legal relationship between the parties arose
C.From the day the right could have been exercised for the first time
D.From the day a court decision on the obligation becomes final
Explanation: The general limitation period starts from the day the right could have been exercised for the first time. After it expires the right does not disappear, but it cannot be enforced in court if the debtor invokes limitation. Ownership rights are not subject to limitation.
10Which EU principle allows a financial institution authorised in Slovakia to provide its services in another EU member state?
A.The principle of subsidiarity
B.The principle of proportionality of EU action
C.The precautionary principle
D.The free movement of services and capital
Explanation: Cross-border provision of financial services within the EU rests on the internal-market freedoms, in particular the freedom to provide services and the free movement of capital. Subsidiarity and proportionality govern how the EU exercises its competences, not a firm's right to operate abroad.
